HomeMy WebLinkAbout020940 ORD - 06/26/1990AN ORDINANCE ORDERING A SPECIAL ELECTION TO BE HELD ON AUGUST 11, 1990, IN THE CITY OF CORPUS CHRISTI FOR THE ADOPTION OF AN ADDITIONAL ONE-HALF OF ONE PERCENT SALES AND USE TAX WITHIN THE CITY, PROVIDING PROCEDURES FOR HOLDING OF SUCH ELECTION; PROVIDING FOR NOTICE OF ELECTION AND PUBLICATION THEREOF; PROVIDING FOR ESTABLISHMENT OF BRANCH ABSENTEE POLLING PLACES; DESIGNATING POLLING PLACE LOCATIONS; ENACTING PROVISIONS INCIDENT AND RELATING TO THE SUBJECT AND PURPOSE OF THIS ORDINANCE; AND DECLARING AN EMERGENCY. WHEREAS, it is provided in Section 3.004 of the Texas Election Code that the governing body shall order elections pertaining to municipal affairs, give notice and appoint election officers to hold the election; WHEREAS, the City Council desires to implement the provisions of the Development Corporation Act of 1979, as amended, by the levy of an additional one-half of one percent sales and use tax for the promotion of economic development, creation of new job opportunities and the enhancement of existing job opportunities. WHEREAS, through local self-determination the City desires to encourage economic development by establishing a viable working relationship between the public and private sectors. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That a special election for the adoption of an additional one-half of one percent sales and use tax within the City shall be held in the City of Corpus Christi, Texas, on August 11, 1990. SECTION 2. That at said election herein ordered all the qualified voters of the City of Corpus Christi shall be permitted to vote. SECTION 3. Only voters residing inside the City limits may vote. Said election shall be held in accordance with the election laws of the State of Texas. The polls shall be open from 7:00 a.m. to 7:00 p.m. on the day of the election. SECTION 4. The City Secretary, Armando Chapa, whose office is situated at the Office of the City Secretary, First Floor, City Hall, 1201 Leopard Street, Corpus Christi, Texas, is hereby appointed as the authority and officer responsible for the conduct of said election and is hereby authorized and directed to make all necessary arrangements for the holding of said election in accordance with and subject to the laws of this State. The City Secretary is hereby appointed the Absentee Voting Clerk for the voting. Absentee voting shall be conducted at the absentee polling places as provided herein. SECTION 5. Voting machines shall be used for the conduct of said election on election day and paper ballots shall be used for conducting absentee voting. Absentee voting in person shall be conducted from 8:00 a.m. to 6:00 p.m., Monday through Friday, beginning on July 23, 1990 and ending August 7, 1990. Absentee voting in person may be conducted at the main absentee polling place located in the lobby of City Hall, the same being designated as the office of the City Secretary, 1201 Leopard, or at the temporary branch polling places hereby established as follows: Northwest Site Westside Site Southside Site Flour Bluff Site - 3202 McKenzie 4040 Greenwood 5151 McArdle 10110 Compton Rd. Northwest Branch Library Greenwood Sr. Citizen Center C.C. Area Council For The Deaf Nueces County Bldg. Each branch polling place and the main absentee polling place shall serve all election precincts. SECTION 6. An election is hereby ordered to be held on August 11, 1990 in the City of Corpus Christi for the imposition of an additional one-half of one percent sales and use tax in accordance and for the purposes prescribed by the Development Corporation Act of \RP\90RP001.030.mm 8 1979, as amended, at which election shall be submitted to the voters the following proposition as it shall appear on the ballot ECONOMIC DEVELOPMENT PROPOSITION For "The adoption of an additional one-half of one percent sales and use tax within the City for economic development to Against promote new and existing business and industry, including industrial development, community facilities and education enhancements." SECTION 7. The City Secretary is directed to post and publish such election notices as are required by the Election Laws of the State of Texas. SECTION 8. By approving and signing this ordinance, the Mayor officially confirms as her action all matters recited in this ordinance which by law come within her jurisdiction. SECTION 9. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purposes. SECTION 10. The fact that it is necessary and essential that the governing body of the City of Corpus Christi shall order elections pertaining to municipal affairs, that the notice of such election should be promptly posted and published, that the requirements of the Voting Rights Act of 1965 may be timely met, and immediate action is necessary for the efficient and effective administration of the City's affairs to comply with all applicable laws, creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance shall be passed finally on the date of its introduction but that such ordinance shall be read at three several meetings of the City Council, \RP\90RP001.030.mm 9 and the Mayor, having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORD,GLY SO ORDAINED, this the c:D4c day of CttL , 19LfC .
