SUPPORTING THE PROPOSED CONSUMER CREDIT
COMMISSIONER'S RULES REGULATING PAWNSHOPS,
EXCEPT FOR THE SITING OF PAWNSHOP RULE.
Whereas, the Office of Consumer Credit Commissioner on July 27,
1990, proposed new rules regulating pawnshops in 15 Tex. Reg.
4279 - 4287; and
Whereas, the Office of Consumer Credit Commissioner asserts the
exclusive authority to regulate a pawnshop; and
Whereas, the City of Corpus Christi as a home -rule city asserts
that it has and does not relinquish authority to regulate
pawnshops under the Constitution and laws of the State of Texas;
and
Whereas, the City of Corpus Christi particularly
state agency does not have the power to regulate
home -rule city; and
Whereas, the City of Corpus Christi supports most
regulations by the Consumer Credit Commissioner.

NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
Section 1. That the City of Corpus Christi has the authority
under the Constitution and laws of the State of Texas to regulate
pawnshops, and, particularly, the regulation of location through
zoning, and does not by this act or any other relinquish that
authority.
Section 2. That the City of Corpus Christi supports and endorses
the proposed rules and regulations regulating pawnshops as
proposed by the Office of Consumer Credit Commissioner and as
published in 15 Texas Register 4279 et seq. on July 27, 1990,
known as 7 TAC 85.1, 85.2, 85.4, 85.12, 85.22, 85.30, 85.50,
85.57, and 85.58, except as noted herein. The City of Corpus
Christi strongly endorses requiring thumbprints on pawn tickets;
proper record keeping; a 30 day hold on goods pawned, reasonable
hours of operation; prohibition on acquiring goods with defaced,
altered, or removed serial numbers; and siting of pawnshops in
compliance with City zoning ordinances.

Section 3. That the City of Corpus Christi strongly opposes
those proposed rules and regulations proposed by the Office of
Consumer Credit Commissioner which diminish home -rule cities'
authority to control the location of businesses through zoning.
The City of Corpus Christ strongly opposes in this regard
proposed rule 7 TAC 85.2(f) and 85.09 (sic). The City favors
siting of pawnshops and other businesses in accordance with City
zoning ordinances.
Section 4. That the City Secretary forward a certified copy of
this Resolution to the Office of Consumer Credit Commissioner for
inclusion in the official record of the proposed pawnshop
regulation.
