HomeMy WebLinkAbout020982 ORD - 09/11/1990AN ORDINANCE AUTHORIZING THE EXECUTION OF AN INTERIM LEASE AGREEMENT WITH ROYAL IN-FLITE CATERING, INC. FOR THE OPERATION OF THE IN- FLIGHT CATERING CONCESSION AT CORPUS CHRISTI INTERNATIONAL AIRPORT FOR 12 MONTHS; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager is hereby authorized to execute an interim lease agreement with Royal In-Flite Catering, Inc. for the operation of the in-flight catering concession at Corpus Christi International Airport for 12 months, all as more fully set forth in the interim lease agreement, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit A. SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need of executing the abovementioned interim lease agreement at the earliest practicable date, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the day of 19 ATTEST: City Secretary APPROVED: DAY OF HAL GEORGE, CITY ATTORNEY By Assistant City Attorney ORD-RES\90124 MP'OR , 19 THE ITY OF CORPUS CHRISTI .SHORT-TERM LEASE AGREEMENT WITH ROYAL IN-FLITE CATERING THIS INTERIM LEASE AGREEMENT ("Agreement") is entered into by and between the City of Corpus Christi, a municipal corporation having home -rule powers under the laws of the State of Texas ("City") and Royal In-Flite Catering, Inc. a corporation doing business in Texas ("Royal"); WHEREAS, the City owns and operates the City of Corpus Christi International Airport, located at 1000 International Drive, Corpus Christi, Nueces County, Texas ("Airport"); and WHEREAS, Royal wishes to continue to provide airline food catering services at the Airport. NOW, THEREFORE, the parties agree as follows: (1) LEASED PREMISES. The City leases to Royal, and Royal takes from the City, facilities for in flight catering services identified in exhibit A, attached hereto and made a part hereof for all purposes. (2) TERM OF AGREEMENT. The term of this Agreement shall be for one (1) year, commencing upon its execution, with either party having the right to cancel this Agreement upon thirty (30) days written notice. In no event will this Short -Term Lease Agreement exceed twelve (12) months from the date of commencement. (3) TERMS AND CONDITIONS. The terms and conditions of the Short -Term Lease Agreement shall be the same as the terms and conditions of the long term Lease Agreement dated August 20, 1985, a copy of which is attached to Ordinance No. 18985 and on file in the City Secretary's office and made a part hereof for all purposes as if fully set out herein. The only exceptions being the term, which shall be as set out above, the minimum monthly business fee which shall be $750.00 or 6 percent of gross income, whichever is higher, and that this is a non-exclusive in-flight catering Lease Agreement.
