AMENDING THE ZONING ORDINANCE UPON APPLICATION OF ALL
SAINTS' EPISCOPAL CHURCH BY GRANTING A SPECIAL COUNCIL
PERMIT FOR A DAY NURSERY AND FOUR FREE STANDING SIGNS ON
LOTS 11 THROUGH 15 AND THE SOUTHWEST 10 FEET OF LOT 10,
BLOCK 42, LINDALE SUBDIVISION, LOCATED AT THE EAST CORNER OF
SOUTH STAPLES STREET AND McCLENDON STREET; AND DECLARING AN
EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City
Council its reports and recommendations concerning the application of
All Saints' Episcopal Church for amendment to the zoning map of the
City of Corpus Christi.
WHEREAS, public hearing was held at which hearing all
persons wishing to appear and be heard were heard to consider the same
before the City Council of the City of Corpus Christi, in accordance
with proper notice to the public, said public hearing having been held
on Tuesday, November 6, 1990, during a meeting of the City Council in
the Council Chambers at City Hall in the City of Corpus Christi; and
WHEREAS, by motion duly made, seconded and carried, it was
decided by the City Council that to approve the hereinafter set forth
amendment would best serve public health, necessity and convenience
and the general welfare of the City of Corpus Christi and its
citizens:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus
Christi, Texas, is amended by making the change hereinafter set out.
SECTION 2. That a Special Council Permit be granted on
Lots 11 through 15 and the southwest 10 feet of Lot 10, Block 42,
Lindale Subdivision, situated in the City of Corpus Christi, Nueces
County, Texas, located at the east corner of South Staples Street and
McClendon Street, and further described by metes and bounds attached
hereto as Exhibit A, for a day nursery and four freestanding signs,
according to the site plan and sign elevation plan, copies of which
are attached hereto and made a part hereof, marked Exhibits B and C,
subject the following conditions:
1. Use: The only use authorized by this Special Permit in addition
to basic "R -1B" uses is a day nursery.
2. Signs: The property may not have more than one (1) double-faced
freestanding identification sign and three (3) single -faced,
freestanding directional signs;

3. Sign Area: The area of the identification sign shall not exceed
32 square feet per face. The area of each directional sign shall
not exceed 6.25 square feet.
4. Sign Height: The height of each freestanding sign permitted on
the property shall not exceed 5.5 feet;
and subject to all other considerations of "R -1B" One -family District.
In the event the Board of Adjustment grants any special
exception or variance to the Zoning Ordinance, applicable to the
Special Permit herein granted, other than the one specified in this
Special Permit, said Special Permit shall be void and of no force and
effect whatsoever.
SECTION 3. That the official zoning map of the City of
Corpus Christi, Texas, be and the same is hereby amended as herein
ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of
Corpus Christi, Texas, approved on the 27th day of August, 1973, as
amended from time to time, except as herein changed, shall remain in
full force and effect.
SECTION 5. That all ordinances or parts of ordinances in
conflict herewith are hereby expressly repealed.
SECTION 6. That upon written request of the Mayor or five
Council members, copy attached, to find and declare an emergency due
to the need for efficient administration of City affairs by granting
the aforesaid zoning change, such finding of an emergency is made and
declared requiring suspension of the Charter rule as to consideration
and voting upon ordinances at three regular meetings so that this
ordinance is passed and shall to effect upon fi eadigr}g� aslan

42, Lindale Park Subdivision Section 3, a map of which is
recorded in Volume 12, Page 3S, Map Records, Nueces County,
Texas, said southwest 10' of Lot 10 is further described by metes
and bounds is follows:
Beginning at the westernmost corner of said Lot 10 for the
westernmost corner of this tract and being in the southeast
right-of-way line of McClendon Street:
Thence along said southeast right-of-way line of McClendon Street
N58°54'00"E 10.00' to a point for the northernmost corner of this
tract:
Thence S31°06'00"E 127.93' to a point in the southeast boundary
line of said Lot 10 for the easternmost corner of this tract;
Thence S58°54'00"W 10.00' to a point for the southernmost corner
of said Lot 10 and of this tract:
Thence N31°06'00"W 127.93' along the common boundary line between
said Lots 10 and 11 to the Point of Beginning.

For the reasons set forth in the emergency clause of the foregoing
ordinance an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances at three regular
meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance finally on the date it is introduced, or at
the present meeting of the City Council.
