A RESOLUTION
IN SUPPORT OF LEGISLATION PERTAINING TO FUNDING OF
MEDICAL TRANSPORTATION SERVICES
WHEREAS, it is anticipated in excess of $3.3 million will be
needed to provide medical transportation services to the citizens of
Corpus Christi, Nueces County, Texas, during fiscal year 1990-91; and
WHEREAS, fees collected will provide only about $700,000 of this
projected cost; and
WHEREAS, medical transportation and treatment on an emergency
basis should be equally available to all citizens of the City of Corpus
Christi and residents of Nueces County, Texas; and
WHEREAS, the RTA was created under V.T.C.S., Art. 1118x, to meet
the public transportation needs of the citizens of this area; and
WHEREAS, the opportunity to receive emergency medical services
is many times contingent on the ability to be transported to medical
facilities; and
WHEREAS, the operation of basic transportation services should
also include medical transportation services; and
WHEREAS, the City Council on 10/16/90 passed Motion 90-269 in
support of pursuing legislation including medical transportation services
in the definition of mass transportation and dedicating RTA funds from the
1/2* sales tax to EMS;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the City Council of the City of Corpus Christi
respectfully requests that the Nueces County Delegation to the Texas
Legislature introduce and promote passage of legislation that would
include medical transportation services in the definition of mass
transportation and dedicating one-fourth (1/4) of the RTA revenues from
the local sales and use tax levied under Art. 1118x, V.T.C.S., to be used
for public provided medical transportation services within the RTA service
areas.

A BILL TO BE ENTITLED
AN ACT
relating to the establishment and operation of medical transportation
services by a rapid transit authority.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Art. 1118x, V.T.C.S., Section 2 (e) is amended
to read as follows:
Section 2. The following words and terms, wherever used and
referred to in this Act, have the following respective meanings,
unless a different meaning clearly appears from the context:
(e) "Mass transit" means transportation of passengers and
hand carried packages and/or baggage of said passengers by means of
motorbus, trolley coach, street railway, rail, suspended overhead
rail, elevated railways, subways, or any other surface, overhead or
underground transportation (except taxicabs), or by any combination of
the foregoing and, for an authority created before January 1, 1980, in
which the principal city has a population of less than 1,200,000 as
determined by the most recent federal decennial census, includes the
establishment and operation of public parking facilities, and for an
authority created before January 1, 1986, in which the principal city
has a population of less than 300,000 as determined by the most recent
federal decennial census, includes the establishment, operation,
and/or contracting for medical transportation services with public
providers.
SECTION 2. Art. 1118x, V.T.C.S., Section 6 is amended by
adding subsection (w), as follows:
Section 6. (w) An authority created before January 1, 1986
in which the principal city has a population of less than 300,000
according to the most recent federal decennial census, shall provide
medical transportation services. Under this section, if the authority
levies, collects, or imposes a local sales and use tax under Sec. 11B
of this Act, the authority shall spend a minimum of 1/4 of the tax so
collected on the provision through operation of or contracting for
medical transportation services.
