HomeMy WebLinkAbout021023 ORD - 11/13/1990AN ORDINANCE ORDERING A SPECIAL ELECTION TO BE HELD ON JANUARY 19, 1991, IN THE CITY OF CORPUS CHRISTI TO CONSIDER AMENDMENTS TO THE CHARTER OF THE CITY OF CORPUS CHRISTI; PROVIDING THAT THE SPECIAL ELECTION BE HELD JOINTLY WITH THE CORPUS CHRISTI INDEPENDENT SCHOOL DISTRICT SPECIAL ELECTION; PROVIDING PROCEDURES FOR HOLDING OF SUCH ELECTION; PROVIDING FOR NOTICE OF ELECTION AND PUBLICATION THEREOF; PROVIDING FOR ESTABLISHMENT OF BRANCH ABSENTEE POLLING PLACES; DESIGNATING POLLING PLACE LOCATIONS; ENACTING PROVISIONS INCIDENT AND RELATING TO THE SUBJECT AND PURPOSE OF THIS ORDINANCE; AND DECLARING AN EMERGENCY. WHEREAS, it is provided in Section 3.004 of the Texas Election Code that the governing body shall order elections pertaining to municipal affairs, give notice and appoint election officers to hold the election; and WHEREAS, the City Council desires to place before the electorate of the City of Corpus Christi proposed amendments to the Charter of the City of Corpus Christi; WHEREAS, the Corpus Christi Independent School District desires to conduct a joint election with the City of Corpus Christi; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That a special election for the consideration of amendments to the Charter of the City of Corpus Christi shall be held in the City of Corpus Christi, Texas, on January 19, 1991. That said special election be held jointly with the Corpus Christi Independent School District. SECTION 2. That at said election herein ordered all the qualified voters of the City of Corpus Christi shall be permitted to vote. SECTION 3. That voting machines shall be employed at the election herein ordered in accordance with the Texas Election Code and said election shall be held at the polling places in the regularly prescribed precincts of the City of Corpus Christi, such voting precincts and polling places being set forth on Attachment A hereto, incorporated by reference and made part of this ordinance. Said election shall be held in accordance with the election laws of the State of Texas. The polls shall be open from 7:00 a.m. to 7:00 p.m. on the day of the election. SECTION 4. The City Secretary, Armando Chapa, whose office is situated at the Office of the City Secretary, First Floor, City Hall, 1201 Leopard Street, Corpus Christi, Texas, is hereby appointed as the authority and officer responsible for the conduct of said election and is hereby authorized and directed to make all necessary arrangements for the holding of said election in accordance with and subject to the laws of this State. The City Secretary is hereby appointed the Absentee Voting Clerk for the joint absentee voting of the respective elections by the City of Corpus Christi and the Corpus Christi Independent School District. Joint absentee voting shall be conducted at the absentee polling places as provided herein. \ord-res\90184 1 SECTION 5. Voting machines shall be used for the conduct of said election on election day and paper ballots shall be used for conducting absentee voting. Absentee voting in person shall be conducted from 8:00 a.m to 5:00 p.m., Monday through Friday, beginning on December 31, 1990, and ending January 15, 1991. Absentee voting in person may be conducted at the main absentee polling place located in the lobby of City Hall, the same being designated as the office of the City Secretary, 1201 Leopard, or at the temporary branch polling places hereby established as follows: Northwest Site Westside Site Southside Site Flour Bluff Site 3202 McKenzie 4040 Greenwood 5151 McArdle 10110 Compton Rd. Northwest Branch Library Greenwood Sr. Citizen Center C.C. Area Council for the Deaf Nueces County Building Each branch polling place and the main absentee polling place shall serve all election precincts. SECTION 6. An election is hereby ordered to be held on January 19, 1991, in the City of Corpus Christi for the consideration of amendments to the Charter of the City of Corpus Christi, at which election shall be submitted to the voters the following proposed charter amendments to the Charter of the City of Corpus Christi: Charter Amendment 1 - Limit of Utility Rate Increases to 6% per annum Amending Article IX, Section 10, of the Charter of the City of Corpus Christi, by adding a subsection 10(a), to read as follows: (a) The rate for each utility service operated by the City shall not be increased in any fiscal year by more than six percent (6%) over the rate charged the preceding year; provided, however, in the event of an emergency declared by the council with all members voting 'aye' on the increase, then a higher rate may be adopted on a temporary basis for the next fiscal year. Effective on voter approval. This Charter Amendment proposition to appear on the ballot as follows: Charter Amendment 1 For Amending Article IX, Section 10, of the Charter of the City of Corpus Christi to provide for a new subsection (a) to read as Against follows: (a) The rate for each utility service operated by the City shall not be increased in any fiscal year by more than six percent (6%) over the rate charged the preceding year; provided, however, in the event of an emergency declared by the council with all members voting 'aye on the increase, then a higher rate may be adopted on a temporary basis for the next fiscal year. Charter Amendment 4 - City Council Election Date Amending Article II, Section 1, of the Charter of the City of Corpus Christi so that the last sentence of subsection (b) thereof reads as follows: The regular election shall be held in odd -numbered years on the first Saturday in April unless the city council designates an alternative Saturday in April or the next available uniform election date allowed by state law at least six months prior to the regular election. The Charter Amendment proposition to appear on the ballot as follows: Charter Amendment 4 For Amending Article II, Section 1, of the Charter of the City of Corpus Christi, providing for elections on a Saturday in April or the next available uniform election date Against selected by the City Council at least six months prior to the regular election. Charter Amendment 5 - Length of Service Limitation on City Boards and Commissions Amending Article VI, Section 1, of the Charter of the City of Corpus Christi, to revise the last sentence thereof to read as follows: No person may serve as a voting member of a board, commission, or committee of the city for a period longer than six years consecutively, unless such service is required by virtue of the person's position or title as the result of employment or to complete an unexpired term. The Charter Amendment proposition to appear on the ballot as follows: fiord-res\90164 4 Charter Amendment 5 For Amending Article VI, Section 1, of the Charter of the City of Corpus Christi, clarifying the six-year length of service Against limitation on citizens appointed to city boards and commission. Charter Amendment 6 - City Purchasing Contracts Amending Article X, Section 2, of the Charter of the City of Corpus Christi, to replace it in its entirety with the following: (a) All contracts shall be authorized by the city council, except that the city manager may authorize contracts which do not require expenditures exceeding the limit at which competitive bids are required under the Texas Local Government Code, as amended, and may exceed that sum in the case of emergency which shall be reported to the council. (b) No contract shall be binding until it has been (1) signed by the city manager or the manager's authorized representative, and (2) approved or objected to in writing by the city attorney, which objection shall be filed with the city secretary. Provided, however, as to standard contracts for multiple transactions, the city attorney need only approve the standard form. (c) All contracts must be competitively bid or proposed as required by state law. After approval of specifications by the city manager, advertisement of such contracts shall be published in a newspaper of general circulation in the city at least once in each week for two consecutive weeks, inviting competitive bids or proposals. All bids or proposals submitted shall be sealed and delivered in the manner required by the specifications. At the time announced in such notice, the bids or proposals shall be opened in the presence of one or more city employees designated by the city manager and in the presence of those bidders desiring to be present, except that confidentiality may be provided in accordance with state law. The council shall determine the most advantageous bid or proposal for the city. The city shall always have the right to reject any and all bids or proposals. In the event all bids or proposals are rejected, the city may call for new bids or proposals at its discretion, which shall be advertised in like manner as the original. (d) No contract shall ever be made which binds the city to pay for personal services to be rendered for any stated period of time; but all contracts for personal service shall be restricted to the doing of some particular act or thing, and upon its completion no further liability shall exist on the part of the city. The Charter Amendment proposition to appear on the ballot as follows: Charter Amendment 6 For Amending Article X, Section 2, of the Charter of the City of Corpus Christi authorizing city procurement through Against competitive bids and proposals as authorized by state law. fiord-res\90184 5 Charter Amendment 7 - Conforming the Provisions on the Issuance of City Bonds to the Requirements Set by State Law Amending Article VIII, Section 2(b), of the Charter of the City of Corpus Christi to read as follows: (b) No bonds shall be issued for a term of longer than one year or to refund outstanding bonds at the same or a higher rate of interest and for such maturities that the aggregate amount to be paid on refunding, principal and interest, on the entire outstanding bonds proposed to be refunded, unless approved by a majority vote of the qualified voters of the city voting at an election called for such purpose, except as authorized by state law. The Charter Amendment proposition to appear on the ballot as follows: Charter Amendment 7 For An Amendment to Article VIII, Section 2, of the Charter of the City of Corpus Christi, conforming the provisions on the issue of City Against bonds to the requirements set by state law. SECTION 7. The City Secretary is directed to publish such Charter Amendments as required by the Local Government Code and to post and publish such election notices as are required by the Election Laws of the State of Texas. SECTION 8. By approving and signing this ordinance, the Mayor officially confirms as her action all matters recited in this ordinance which by law come within her jurisdiction. SECTION 9. If for any reason any section, paragraph, subdivision, clause, phrase word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purposes. SECTION 10. The fact that it is necessary and essential that the governing body of the City of Corpus Christi shall order elections pertaining to municipal affairs, that the notice of such election should be promptly posted and published, that the requirements of the Voting Rights Act of 1965 may be timely met, and immediate action is necessary for the efficient and effective administration of the City's affairs to comply with all applicable laws, creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance shall be passed finally on the date of its introduction but that such ordinance shall be read at three several meetings of the City Council, and the Mayor, having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT 15 ACCORDINGLY SO ORDAINED, this the X 3 7 /4 day of JV 1 V e ti ante, 1990.
