APPROVING AMENDMENT NO. 4 TO THE ENGINEERING SERVICES
CONTRACT WITH SMITH & RUSSO TO DESIGN IMPROVEMENTS TO
AYERS STREET, FROM BALDWIN BOULEVARD TO SANTA FE STREET,
FOR A FEE NOT TO EXCEED $17,987; AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. That there is hereby approved Amendment No. 4 to the
Engineering Services Contract with Smith & Russo to design improvements to Ayers Street,
from Baldwin Boulevard to Santa Fe Street, for a fee not to exceed $17,987, all as more fully
set forth in Amendment No. 4, a substantial copy of which is attached hereto and made a part
hereof, marked Exhibit A.
SECTION 2. That upon written request of the Mayor or five Council members,
copy attached, to find and declare an emergency due to the need of executing the
abovementioned Amendment No. 4 at the earliest practicable date, such finding of an
emergency is made and declared requiring suspension of the Charter rule as to consideration
and voting upon ordinances at three regular meetings so that this ordinance is p $sed and shall

The City of Corpus Christi, Texas, hereinafter called "City" and Smith
and Russo, Inc., hereinafter called "Engineer", agree to the following
amendment to the Contract for Engineering Services for the Ayers Street
Improvements, Santa Fe to Norton, as authorized by Ordinance No. 19737, passed
May 12, 1987, and amended by Resolution No. 20110, passed December 17, 1987,
and amended on July 28, 1989, and amended on July 30, 1990.
Section II, Scope of Services, Subsection B (Design Phase), shall be
amended to revise project plans, specifications, contract and bidding
documents as necessary to bid and construct that portion of Ayers Street
between Santa Fe and Baldwin Boulevard, as outlined in the attached Task
Listing.
Section III, Fees, shall be amended to provide additional compensation to
the Engineer in an amount not to exceed $17,897.00 for added services as
herein defined. Payment will be made monthly based upon submitted invoices and
the rate schedule attached.
All other terms and conditions of the contract approved on May 12, 1987,
and amended on December 17, 1987, July 28, 1989, and July 30, 1990, between
the City and Engineer not specifically addressed herein, shall remain in full
force and effect.

The City Engineering Department shall furnish all field
surveying necessary to effect plan preparation.
* Engineer shall provide three 100% submittal sets for final review and
approval. City shall provide all project plans and specifications
reproduction requirements for bidding.

For the reasons set forth in the emergency clause of the foregoing
ordinance an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances at three regular
meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance finally on the date it is introduced, or at
the present meeting of the City Council.
