CLOSING AND ABANDONING A 4,031 -SQUARE FOOT PORTION OF A 7.5 -
FOOT WIDE UTILITY EASEMENT IN LOTS 7 AND 8, SECTION 13, FLOUR
BLUFF AND ENCINAL FARM AND GARDEN TRACTS; SUBJECT TO
COMPLIANCE WITH THE SPECIFIED CONDITIONS AND THE OWNER
REPLATTING WITHIN 180 DAYS AT OWNERS EXPENSE.
WHEREAS, there exists a 4,031 -square foot portion of a 7.5 -foot wide utility easement in
Lots 7 & 8, Section 13, Flour Bluff and Encinal Farm and Garden Tracts, shown by plat recorded
in Volume A, Pages 41-43, of the Map Records of Nueces County, Texas that Lexington Joint
Venture ("Owner") wishes to have closed and abandoned.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI:
SECTION 1. That a 4,031 -square foot area of a 7.5 -foot wide utility easement in Lots 7
and 8, Section 13, Flour Bluff and Encinal Farm and Garden Tracts, as shown by plat recorded in
Volume 56, Page 87, of the Map Records of Nueces County, Texas, is hereby closed for public use
and every municipal purpose, subject to the following specified conditions as part of closure:
1) That Owner dedicate a 7.5 -foot wide by 555.0 -foot long utility easement adjacent to
the new adjoining property line of Lot 1, Block 1, Dusty Hills Subdivision in lieu of
paying fair market value for the utility easement proposed to be closed.
2) That Owner does not have to replat Lots 7 and 8, Section 13, Flour Bluff and Encinal
Farm and Garden Tracts because there are more than 5 acres remaining in the
approved preliminary replat of Lots 7 and 8, Section 13, Flour Bluff and Encinal
Farm and Garden Tracts.
