HomeMy WebLinkAbout022818 ORD - 01/14/19971 AN ORDINANCE CLOSING AND ABANDONING A 1,100 -SQUARE FOOT AREA OF A 10 - FOOT WIDE UTILITY EASEMENT IN LOT 21, BLOCK 4, YORKSHIRE ESTATES (JONES ELEMENTARY SCHOOL); SUBJECT TO COMPLIANCE WITH THE SPECIFIED CONDITIONS; AND THE CORPUS CHRISTI INDEPENDENT SCHOOL DISTRICT (CCISD) FILING A CORRECTED EASEMENT IN THE DEED OF RECORDS OF NUECES COUNTY; AND DECLARING AN EMERGENCY. WHEREAS, there exists a 1,100 -square foot area of a 10 -foot wide utility easement in Lot 21, Block 4, Yorkshire Estates (Jones Elementary School), shown by plat recorded in Volume 54, Page 67 of the Map Records of Nueces County, Texas. WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said utility easement, subject to the provisions listed below; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI: SECTION 1. That a 1,100 -square foot area of a 10 -foot wide utility easement in Lot 21, Block 4, Yorkshire Estates (Jones Elementary School), shown by plat recorded in Volume 54, Page 67 of the Map Records of Nueces County, Texas, is hereby closed for public use and every municipal purpose, subject to the following specified conditions as part of closure: 1) payment of fair market value for the 1,100 -square foot portion of a 10 -foot wide utility easement that was appraised by city staff at $335; 2) that the Owner file a corrected copy of the utility easement in the Deeds Records of Nueces County, Texas; and 3) that the Owner re-route the fire hydrants in the corrected easement as needed to provide fire protection for the new building, at owner's expense. SECTION 2.
