HomeMy WebLinkAbout022822 ORD - 01/14/1997ORDINANCE AUTHORIZING THE CITY MANAGER, OR DESIGNEE, TO EXECUTE AN ASSIGNMENT OF LEASE AGREEMENT FROM PITTENCRIEFF AMERICA, INC. TO PITTENCRIEFF (GULF COAST), INC. AND FLETCHER CHALLENGE PETROLEUM CORPORATION OF A 2.07 ACRE SURFACE LEASE FOR DIRECTIONAL DRILL SITES AT THE LAGUNA MADRE WASTEWATER TREATMENT PLANT, 201 JESTER; PROVIDING FOR PUBLICATION; AND PROVIDING FOR SEVERANCE. WHEREAS,on August 13, 1980 the City Council adopted Ordinance No. 015684, which authorized a surface lease for directional drilling of an oil & gas well at the Laguna Madre Wastewater Treatment Plant, 201 Jester, to Exxon Corporation and Sun Oil Company; and WHEREAS, on March 8, 1981 the City Council adopted Ordinance No. 016098, which authorized additional drillsites in consideration of increased payments; and WHEREAS, on June 2, 1982 the City Council adopted Ordinance No. 017067, which authorized an 8% annual increase in the fee paid for the surface lease and authorized a temporary additional working area for workover equipment; and WHEREAS, on April 9, 1991 the City Council adopted Ordinance No. 021133, which authorized the assignment of the surface lease from Exxon Corporation to Headington Oil Company; and WHEREAS, on July 12, 1994 the City Council adopted Ordinance No. 021985, which authorized the assignment of the surface lease from Headington Oil Company to Pittencrief America, Inc. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, THAT: SECTION 1. That the City Manager, or designee, is hereby authorized to execute an assignment of lease agreement from Pittencrieff America, Inc. to Pittencrieff (Gulf Coast), incorporated and Fletcher Challenge Petroleum Corporation for a 2.07 acre surface lease for directional drill sites at the Laguna Madre Wastewater Treatment Plant, 201 Jester. SECTION 2. Publication shall be made in the official publication of the City of Corpus Christi as required by the City Charter of the City of Corpus Christi. SECTION 3. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. ag5000.147.1a 02282?
