PETERS STREET RIGHT-OF-WAY OUT OF THE PROPOSED LOT 70, BLOCK 2, HIGHLAND OAKS TOWNHOMES UNIT 4; SUBJECT TO COMPLIANCE WITH THE SPECIFIED CONDITIONS; AND THE OWNER REPLATTING THE PROPERTY WITHIN 180 DAYS AT HIS EXPENSE; AND DECLARING AN EMERGENCY WHEREAS, there exists a 0.026 acre (1,152 -square foot) portion of surplus St. Peters Street right-of-way out of the proposed Lot 70, Block 2, Highland Oaks Townhomes Unit 4, shown by plat recorded in Volume A, Page 41-43, of the Map Records of Nueces County, Texas that Urban Engineering, on behalf of Cliff Zarsky ("Owner") wish to have closed and abandoned. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI: SECTION 1. That a 0.026 acre (1,152 -square foot) portion of surplus St. Peters Street right- of-way out of the proposed Lot 70, Block 2, Highland Oaks Townhomes Unit 4, shown by plat recorded in Volume A, Page 41-43, of the Map Records of Nueces County, Texas, is hereby closed for public use and every municipal purpose, subject to the following specified conditions as part of closure: 1) That Owner pay fair market value for the 1,152 -square foot portion of St. Peters Street right-of-way that was appraised by the City staff at $80.00. 2) That Owner must replat his property within 180 days at his expense; provided however, the City Engineer may extend the time limit for an additional 180 days if extenuating circumstances outside the Owner's control necessitate an extention. 3) That Owner dedicate a 10 -foot wide utility easement along the east side of the St. Peter's Street ROW frontage of Lot 70, Block 2, Highland Oaks Unit 4 for an existing 6 -inch water main SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at 022938 AG\97\5000.185.1a 00,00 2 two regular meetings so that this ordinance is pasted and shall take effect upon first reading as an , 1997.
