AN ORDINANCE
CLOSING AND ABANDONING A 750 -SQUARE FOOT PORTION OF A 5 -
FOOT WIDE UTILITY EASEMENT IN LOT 1, BLOCK 1, BEHMANN
SUBDIVISION AND A 2803 -SQUARE FOOT PORTION OF A 5- AND 10 -
FOOT WIDE UTILITY EASEMENT IN LOT 12D, BLOCK 1, BEHMANN
SUBDIVISION, SUBJECT TO CERTAIN CONDITIONS, INCLUDING THE
REQUIREMENT THAT THE OMNI GROUP, INC. REPLAT THE
AFFECTED LOTS WITHIN 180 DAYS AFTER PASSAGE OF THIS
ORDINANCE; AND DECLARING AN EMERGENCY.
Under the conditions listed below, the City of Corpus Christi has determined that it is
both feasible and advantageous to abandon: 1) a 750 -square foot portion of a 5 -foot wide utility
easement in Lot 1, Block 1, Behmann Subdivision; and 2) a 2803 -square foot portion of a 5- and
10 -foot wide utility easement in Lot 12D, Block 1, Behmann Subdivision.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CORPUS CHRISTI:
SECTION 1. A 750 -square foot portion of a 5 -foot wide utility easement in Lot 1, Block
1, Behmann Subdivision, which is more particularly described in Exhibit 1, is closed for public
use and every municipal purpose, subject to the conditions listed below.
SECTION 2. A 2803 -square foot portion of a 5- and 10 -foot wide utility easement in
Lot 12D, Block 1, Behmann Subdivision, which is more particularly described in Exhibit 2, is
closed for public use and every municipal purpose, subject to the conditions listed below.
SECTION 3. These easement closures are made subject to the following conditions:
A. After the sale of Lot 1, Block 1, Behmann Subdivision and a portion of Lot 12D,
Block 1, Behmann Subdivision, Omni Group, Inc. will replat the affected lots as
Lots 12E and 12F, Block 1, Behmann Subdivision.
B. With the replat of Lots 12E and 12F, Omni Group, Inc. will dedicate a 3,250 -
square foot utility easement. Omni Group will pay all costs associated with
relocating an 8 -inch sanitary sewer line and a 4 -inch Southwestern Bell Telephone
Company duct from the easements to be closed to the new utility easement.
C. The 750 -square foot easement fair market value is $2.65/s.f for an easement
closure cost of $1,987.50. The 2803 -square foot easement fair market value is
$1.25/s.f. for an easement closure cost of $3,503.50. Thus, the total appraised fair

market value for the closed easements is $5,491.
The 3250 -square foot easement to be dedicated has an appraised fair market value
of $1.25/s.f. or $4,062.50.
The fair market value of the closed easements is $1,428.50 greater than the fair
market value of the easement to be dedicated. Thus, Omni Group, Inc. will be
required to pay the City $1,428.50.
D. Replatting of the affected lots will occur within 180 days after passage of this
ordinance. Omni Group, Inc. will pay the fees and costs associated with
replatting.
SECTION 4. That upon written request of the Mayor or five Council members, copy
attached, to find and declare an emergency due to the need for immediate action necessary for the
efficient and effective administration of city affairs, such finding of an emergency is made and
declared requiring suspension of the Charter rule as to consideration and voting upon ordinances
at two regular meetings so that thisordinance in�s passed and shall take effect upon first reading as
an emergency measure this the4/day of Ha/7th , 1997.

closed; said 0.017 acre tract being out of and a part of Lot 1, Block 1, Behmann

being more particularly described by Metes and Bounds as follows:
BEGINNING at a 5/8" iron rod set for the most Westerly corner of said Lot 1, Block 1,

most Southerly right-of-way line of Gollihar Road, said iron rod being the most Northerly
corner of said Lot 1, Block 1, and also being an exterior corner of this easement to be
closed;
THENCE South 61°37'15" East, a distance of 5.00 feet to a point for an exterior corner
of this easement to be closed;
THENCE South 28°22'45" West, a distance of 150.00 feet to a point in the common
Southwesterly line of said Lot 1, Block 1 and an interior line of said Lot 12-B, Block 1,
same said point being the most Southerly corner of this easement to be closed;
THENCE North 61°37'15" West, a distance of 5.00 feet to the POINT OF BEGINNING
and containing 0.017 acres, (750 square feet) of land, more or less.

For the reasons set forth in the emergency clause of the foregoing ordinance an emergency exists
requiring suspension of the Charter rule as to consideration and voting upon ordinances at two
regular meetings: I/we, therefore, request that you suspend said Charter rule and pass this ordinance
finally on the date it is introduced, or at the present meeting of the City Council.
