HomeMy WebLinkAbout022911 ORD - 04/22/1997ORDINANCE APPROPRIATING $89,835.75 IN THE NO. 250 SANITARY SEWER CAPITAL PROJECTS FUND PAID BY SSP PARTNERS UNDER A SETTLEMENT AGREEMENT WITH THE CITY CONCERNING THE CARROLL LANE TRUNK MAIN REHABILITATION PHASE I PROJECT; AMENDING THE FY 96-97 CAPITAL BUDGET, ADOPTED BY ORDINANCE NO. 022742, BY ADDING $89,835.75 TO THE SANITARY SEWER PROGRAM; AND DECLARING AN EMERGENCY The city has made a settlement agreement with SSP Partners ("SSP") concerning the Carroll Lane Trunk Main Rehabilitation Phase I Project and relating to the release of petroleum products in the vicinity of 4214 Carroll Lane, Corpus Christi. Under that agreement, SSP has paid the city $89,835.75, a 5% portion of which may be refundable to SSP. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. SSP's $89,835.75 payment is appropriated in the No. 250 Sanitary Sewer Capital Projects Fund. SECTION 2. The FY 96-97 Capital Budget, adopted by Ordinance No. 022742, is amended by adding $89,835.75 to the Sanitary Sewer Program. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient and effective administration of city affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at two regular meetings so that J}>tis prdinance i,.y passeli and shall take effect upon first reading as an emergency measure this theMn day of .( , 1997.
