AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO EXECUTE
A USE PRIVILEGE AGREEMENT WITH THE CLOWER COMPANY FOR
THE RIGHT TO CONSTRUCT, INSTALL, OPERATE, AND MAINTAIN A
CANVAS AWNING STRUCTURE THAT WILL BE ATTACHED TO THE
BUILDING FRONT AND OVERHANG A PORTION OF THE PUBLIC
RIGHT-OF-WAY LOCATED AT 415 STARR STREET; ESTABLISHING A
FEE OF $100.00; AND DECLARING AN EMERGENCY.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS, THAT:
SECTION 1. That the City Manager, or his designee, is hereby authorized to execute a Use
Privilege Agreement with The Clower Company for the right to construct, install, operate, and
maintain a canvas awning structure that will be attached to the building front and overhang a portion
of the public right-of-way located at 415 Starr Street.
SECTION 2. That The Clower Company pay consideration of $100.00 and comply with
the terms and conditions of the Use Privilege Agreement, a copy of which is on file with the City
Secretary, and subject to the following specified conditions as part of the Use Privilege Agreement:
1. The Owner must construct the canvas awning structure at least 9 -feet above the
lowest point or projection of the public right-of-way.
2. The Owner must extend the canvas awning structure no more than 4 -feet from the
face of the building by means of cantilever connection. There will be no end
supports to the canvas awning structure into the existing 10 -foot wide sidewalk.
3. The Owner must design and construct the entire canvas awning structure to meet City
Code for wind load (105 mile per hour wind load).
4. The Owner must construct the canvas awning structure using combustible materials
which must be protected with not less than one-hour fire resistance coating.
SECTION 3. That upon written request of the Mayor or five Council members, copy
attached, to find and declare an emergency due to the need for immediate action necessary for the
efficient and effective administration of City affairs, such finding of an emergency is made and
declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at
two regular meetings so that this ordinance is passed and shall take effect upon first reading as an
emergency measure this the /33/1 day of yi(Q(1 , 1997.

For the reasons set forth in the emergency clause of the foregoing ordinance an emergency exists
requiring suspension of the Charter rule as to consideration and voting upon ordinances at two
regular meetings: I/we, therefore, request that you suspend said Charter rule and pass this ordinance
finally on the date it is introduced, or at the present meeting of the City Council.
