Home My WebLink About022964 ORD - 06/17/1997AN ORDINANCE AMENDING THE CODE OF ORDINANCES, CITY OF CORPUS CHRISTI, CHAPTER 2, ADMINISTRATION, BY ESTABLISHING THE STORM WATER MANAGEMENT ADVISORY COMMITTEE; PROVIDING FOR THE ABOLITION OF THE COMMITTEE; PROVIDING FOR SEVERANCE; AND PROVIDING FOR PUBLICATION. WHEREAS, the bays and estuaries of the Corpus Christi area are a vitally important natural resource of our region; AND WHEREAS, those waters, their marine populations, and bay users are potentially subject to pollution from a number of sources, including runoff and discharge from the City's Municipal Separate Stormwater Sewer System; AND WHEREAS, runoff and discharge from the City's Municipal Separate Stormwater Sewer System is regulated by EPA under authority granted by the Federal Clean Water Act; AND WHEREAS, that appropriate municipal policy towards such runoff and discharge requires a thorough understanding of the ecology of the receiving waters, the composition of the runoff and discharge, the methods for altering the composition of such runoff and discharge, and the relative costs and benefits of City and its Citizens utilizing these various methods; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. Article IV of Chapter 2, Administration, Code of Ordinances, City of Corpus Christi, is amended by adding Division 21 to read as follows: DIVISION 21. STORMWATER MANAGEMENT ADVISORY COMMITTEE Sec. 2-231. Composition. organization. and duties. (a) Composition. (1) There is a Stormwater Management Advisory Committee. which consists of eleven (11) members. representatives of the various community interests, (2) The advisory committee is appointed by the Mayor with the approval of the Council. All committee members shall serve without compensation. (b) Organization. • IR(5 4 R73411A2.169 hi1:,RUFILMED 2 (1) The advisory committee shall adopt its own rules of procedures (2) At the first meeting after creation of the committee. a majority of the whole committee shall elect a chairperson and vice -chairperson to serve during the first term. Thereafter. a committee chairperson and vice -chairperson shall be elected by a majority of the whole committee to serve one-year terms expiring each June 30th. (3) The advisory committee shall meet not less than six times per year. nor more than twelve times per year. with the support and cooperation of the City Manager or his designees. (c) Duties. (2) Monitor compliance with and enforcement of the City's current ordinances relating to runoff and discharge of stormwater and the elimination of pollutants therefrom (3) Advise the Mayor and Council on the appropriateness of the City's current ordinances relating to runoff and discharge of stormwater and the elimination of pollutants therefrom. (6) Advise the Mayor and Council on these issues and activities within a strate2y of com • fiance at minimum feasible cost. that is to assure that the steps taken by the city in the above matters minimize the expenditure of funds by the City and its Citizens. and impose the least possible burden on the conduct of their business. while complying with the CleanWater Act. Unless the City Council, by resolution, extends the term of the Stormwater Management Advisory Committee, the Stormwater Management Advisory Committee, which is created by Section 1 of this ordinance, shall be abolished on June 17, 1999. SECTION 3. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 4. Publication shall be made in the official publication of the City of Corpus Christi as required by the City Charter of the City of Corpus Christi.
