AMENDING THE ZONING ORDINANCE UPON APPLICATION BY DAVID
K. BRAUN, BY CHANGING THE ZONING MAP IN REFERENCE TO
ASSESSORS MAP 138, TRACT 9 FROM "R -1B" ONE -FAMILY DWELLING
DISTRICT TO "B-1" NEIGHBORHOOD BUSINESS DISTRICT;
PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council its reports and
recommendations concerning the application of David K. Braun, for amendment to the zoning map
of the City of Corpus Christi;
WHEREAS, in accordance with proper notice to the public, a public hearing was held on
Wednesday, June 11, 1997, during a meeting of the Planning Commission and on Tuesday, July 15,
1997, during a meeting of the City Council, in the Council Chambers at City Hall in the City of
Corpus Christi allowing all interested persons to appear and be heard; and
WHEREAS, the City Council has determined that the hereinafter set forth amendment
would best serve public health, necessity and convenience and the general welfare of the City of
Corpus Christi and its citizens.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended
by making the change hereinafter set out.
SECTION 2. That Assessors Map 138, Tract 9, located on the west side of Rand Morgan
Road, approximately 200 feet south of Interstate Highway 37, be changed from "R -1B" One -family
Dwelling District to "B-1" Neighborhood Business District, metes and bounds description attached
as Exhibit A.
SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the
same is hereby amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas,
approved on the 27th day of August, 1973, as amended from time to time, except as herein changed,
shall remain in full force and effect.
SECTION 5. That, to the extent that the amendment to the Zoning Ordinance set forth
herein above represents a deviation from the Comprehensive Plan, the Comprehensive Plan is hereby
amended to conform to the Zoning Ordinance as amended herein.
SECTION 6. That all ordinances or parts of ordinances in conflict herewith are hereby
expressly repealed.

SECTION 7. Publication shall be made in the official publication of the City of Corpus
Christi as required by the City Charter of the City of Corpus Christi.
SECTION 8. That upon written request of the Mayor or five Council members, copy
attached, to find and declare an emergency due to the need for immediate action necessary for the
efficient and effective administration of City affairs, such finding of an emergency is made and
declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at
two regular meetings so that this ordinance is passed and shall take effect upon first reading as an

A 1.49 acre tract, more or less, out of Survey No. 422, being the same land described in a
Warranty Deed from Henry T. Berndt to I. E. Crane, dated December 21, 1961, recorded in
Volume 947, Page 96, Deed Records of Nueces County, Texas; save and except a tract of land
40 feet by 159.69 feet out of the northeast corner of Tract No. 3, which was heretofore included
in the conveyance from I. E. Crane to Texas Star Distributing Company, dated November 20,
1967, recorded in Volume 1246, Page 237, Deed Records of Nueces County, Texas and more
particularly described by metes and bounds as follows;
BEGINNING AT A POINT on the West right-of-way line of Rand Morgan Road, the southeast
corner of Lot 1-R, Block 1, Guth Parkside Annex, as shown on Plat of Record in Volume 36,
Page 79, Nueces County, Texas Plat Records,for the corner of the tract herein described;
THENCE South along said west right-of-way line Rand Morgan Road, 160 feet, more or less, to
a point on said right-of-way line, the point of intersection with the easterly extension of the north
line of Lot 4-A, Block 1, Guth Parkside Annex, as shown on Plat of Record in Volume 46, Page
48, Nueces County, Texas Plat Records, for the southeast corner of this tract;
THENCE West with the north line of said Lot 4-A, 357.40 feet, more or less, to a point, for the
southwest corner of this tract;
THENCE North along the west line of the tract herein described to its intersection with the south
line of Lot 2, Block 1, Guth Parkside Annex or its westerly extension (said Lot 2, shown on Plat
