HomeMy WebLinkAbout023001 ORD - 07/29/1997AN ORDINANCE ACCEPTING A FIFTY THOUSAND DOLLAR ($50,000) GRANT FROM THE CORPUS CHRISTI INDUSTRIAL DEVELOPMENT CORPORATION FOR A STUDY OF THE OLD NUECES COUNTY COURTHOUSE; AUTHORIZING THE APPROPRIATION OF FIFTY THOUSAND DOLLARS ($50,000) IN THE NO. 162 FEDERAL/STATE GRANTS FUND FOR SUCH STUDY OF THE COURTHOUSE; ESTABLISHING AN OBJECTIVE AD HOC ADVISORY COMMITTEE OF THE CITY OF CORPUS CHRISTI TO ASSIST IN DETERMINING THE FEASIBILITY OF RESTORING THE OLD NUECES COUNTY COURTHOUSE; AND DECLARING AN EMERGENCY. WHEREAS, the restoration or demolition of the Old Nueces County Courthouse has been a source of division within the community; and WHEREAS, the City Council has determined that a definitive study of the cost and feasibility of restoration of the Old Nueces County Courthouse will establish the appropriate status of the Courthouse; and WHEREAS, the City Council desires to accept and appropriate a grant from the Corpus Christi Industrial Development Corporation to fund such definitive study of the cost and feasibility of restoration of the Old Nueces County Courthouse; and WHEREAS, it is necessary and desirable to have the assistance of an ad hoc committee to assist in the study; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That there is hereby accepted a grant from the Corpus Christi Industrial Development Corporation in the amount of Fifty Thousand Dollars ($50,000) for a study of the Old Nueces County Courthouse. SECTION 2. That there is hereby appropriated Fifty Thousand Dollars ($50,000) in the No. 162 Federal/State Grants Fund for a study of the Old Nueces County Courthouse, such funds being a grant from the Corpus Christi Industrial Development Corporation. SECTION 3. That there is hereby established the Ad Hoc Old Nueces County Courthouse Advisory Committee of the City of Corpus Christi which shall: A. Assist in the selection of an architectural/engineering firm to study the cost and feasibility of restoring the Old Nueces County Courthouse; B. Work with the architecturallengineering firm in developing the firm's report to the City 97N110610.117 Council regarding the feasibility of restoring the Old Nueces County Courthouse; C. Consist of no more than 12 members of which two members are appointed by the City's Landmark Commission, one member of the Texas Historical Commission appointed by the Commission, and up to nine members appointed by the City Council, with each Council Member having the right to appoint one Committee Member. Ad hoc Committee Members appointed by the City should have absolutely no affiliation nor be prominently identified with any position, pro or con, with regard to the Old Nueces County Courthouse. D. Terminate upon the delivery of the report to the City Council regarding the feasibility of restoring the Old Nueces County Courthouse or July 31, 1998, whichever is earlier. The term of the Committee may be extended by Motion of the City Council. SECTION 4. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the definite intent of this City council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 5. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs, and to meet the grave emergency created by severe drought to immediately make available new water supplies to Corpus Christi and its water service area, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at two regular meetings so that this ordinance passed and shall take effect upon first reading as an emergency measure this the o?Q/12 day of 19 ity Secretary THE CITY OF CORPUS CHRISTI APPROVED THIS THE 24TH DAY OF JULY 1997: JAMES R. For the reasons set forth in the emergency clause of the foregoing ordinance an emergency exists requiring suspension of the Charter rule as to consideration and voting upon ordinances at two regular meetings: I/we, therefore, request that you suspend said Charter rule and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
