HomeMy WebLinkAbout023016 ORD - 07/29/1997AN ORDINANCE AMENDING THE CORPUS CHRISTI ZONING ORDINANCE ARTICLE 7A, "T -1A" TRAVEL TRAILER PARK, "T -1B" MANUFACTURED HOME PARK DISTRICT AND "T -1C MANUFACTURED HOME SUBDIVISION DISTRICT REGULATIONS, ARTICLE 25, SPECIAL PERMIT REGULATIONS, ARTICLE 28, "PUD" PLANNED UNIT DEVELOPMENT, SECTION 28-5, PROCEDURE AND ARTICLE 33, PERMITS, PLATS, AND FILING FEES, SECTION 33-1, PERMITS AND SECTION 33-3, FILING FEES, BY ADDING PROCESSING FEES FOR SCREENING FENCE EXCEPTIONS FOR TRAVEL TRAILER PARKS, MANUFACTURED HOME PARKS AND MANUFACTURED HOME SUBDIVISIONS, AND FOR TIME EXTENSIONS FOR SPECIAL PERMITS AND BY INCREASING PUD PROCESSING FEES, CONDITIONAL SIGN PERMIT FEES, FILING FEES FOR ZONING DISTRICT CLASSIFICATION CHANGES, AND FENCE EXCEPTION FEES; AND PROVIDING FOR SEVERANCE. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning an amendment to the Zoning Ordinance of the City of Corpus Christi; WHEREAS, in accordance with proper notice to the public, a public hearing was held on Wednesday, July 9, 1997, during a meeting of the Planning Commission and on Tuesday, July 22, 1997, during a meeting of the City Council, in the Council Chambers at City Hall in the City of Corpus Christi allowing all interested persons to appear and be heard; and WHEREAS, the City Council has determined that the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI TEXAS: SECTION 1. That the Zoning Ordinance, Article 7A, "T -1A" Travel Trailer Park Regulations, "T -1B" Manufactured Home Park District Regulations, and "T -1C Manufactured Home Subdivision District Regulations, Section 7A-2, Use Regulations of the "T -1A" Travel Trailer Park District, Subparagraph (8) is hereby amended as follows: Section 7A-2 Use Regulations of the "T -1A" Travel Trailer Park District. An area or premises shall be used and developed according to the following regulations: (1) - (7) Omitted. 97NH2830.205 / 7-14-97 Zoning Fees MICROFILMED (8) The travel trailer park shall be screened from public streets, highways, and adjacent property by a standard screening fence, unless this requirement is modified or waived by City Council action after a hearing and recommendation of the Planning Commission in accordance with the provisions of Article 30 and Section 33-3.02. (9) - (16) Omitted. SECTION 2. That the Zoning Ordinance, Article 7, "T -1A" Travel Trailer Park Regulations, "T -1B" Manufactured Home Park District Regulations, and "T -1C Manufactured Home Subdivision District Regulations, Section 7A-3, Use Regulations of the "T -1B" Manufactured Home Park District, Subparagraph (6) is hereby amended as follows: Section 7A-3 Use Regulations of the "T -1B" Manufactured Home Park District. An area or premises shall be used and developed according to the following regulations: (1) - (5) Omitted. (6) The manufactured home park shall be screened from public streets, highways, and adjacent property by a standard screening fence, unless this requirement is modified or waived by City Council action after a hearing and recommendation of the Planning Commission in accordance with the provisions of Article 30 and Section 33-3.02. (7) - (11) Omitted. SECTION 3. That the Zoning Ordinance, Article 7, "T -1A" Travel Trailer Park Regulations, "T -1B" Manufactured Home Park District Regulations, and "T -1C Manufactured Home Subdivision District Regulations, Section 7A-4, Use Regulations for "T -1C" Manufactured Home Subdivision District, Subparagraph (5) is hereby amended as follows: Section 7A-4 Use Regulations for "T -1C" Manufactured Home Subdivision District. An area or premises shall be used and developed according to the following regulations: (1) - (4) Omitted. (5) Unless modified or waived by City Council action, after a hearing and recommendation by the Planning Commission, the manufactured home subdivision shall be surrounded by a standard screening fence in which case such fence shall become a part of abutting lots, unless otherwise designated as part of the common open space in accordance with the provisions of Article 30 and Section 33-3.02. 97NH2830.205 / 7-14-97 Zoning Fees (5) - (7) Omitted. SECTION 4. That the Zoning Ordinance, Article 25, Special Permit Regulations is amended by adding a new Section 25-5 as follows: Section 25-5 A request to extend the time for which a special permit is valid must be submitted in writing to the Department of Planning and Development prior to the expiration of the special permit. The fee for processing such request is Fifty and No/100ths dollars ($50.00). SECTION 5. That the Zoning Ordinance, Article 28, "PUD" Planned Unit Development, Section 28-5, Procedure, Subparagraph (C) is hereby amended as follows: (C) Plan of Development. To utilize the provisions of this article, ten (10) copies of the proposed plan of development accompanied by processing fees, as prescribed in the following schedule, shall be submitted to the Department of Planning. The plan of development shall include the following drawing or drawings prepared at the scale of 1" = 50': (1) A dimensioned layout of any buildings, open spaces, recreational areas and other elements basic to the proposed use, including the amounts of the 97NH2830.205 / 7-14-97 Zoning Fees proposed uses in square feet or acres, with identifiable matching designation of the total number of units and/or habitable improvements to be placed within each delineated area or space. (2) Locations, amounts and types of non-residential uses within the area proposed to be developed. In the event that these non-residential uses are of the type intended to serve only the residents of the PUD, documentation shall be attached as specified in Section 28-4(B) of this article. (3) (a) The size and location of all vehicular and pedestrian access points to the PUD. (b) The number, dimensions overall, and location of all parking spaces. (c) The pattern, estimated traffic volumes, width, and type of paving proposed for all vehicular movement areas. (d) The pattern, width and type of paving for all sidewalks and other pedestrian movement areas. (e) All proposed screening and/or lighting of parking and other areas, shall also be illustrated. The plan of development shall also include at an appropriate scale or in some appropriate form as determined within the guidelines of this ordinance and the Platting Ordinance by the Director of Planning as to (a) hereof, and by the City Attorney as to (b) hereof, the following: (a) A plot plan showing contours and elevations. (b) The required legal documents as specified in Section 28-4 (H) of this article. Included as part of these documents shall be proof of the financial responsibility of the established entity to maintain the common area as required in Section 28-4(1) of this article. The required legal documents will include deed restrictions and common and part -wall agreements. (c) In the event that the PUD is to be developed in stages or phases a staging plan with estimated times of development is to be included as part of the plan of development. SECTION 6. That the Zoning Ordinance, Article 33, Permits, Plats, And Filing Fees, Section 33-1, Permits, Subparagraph 33-1.05 is hereby amended as follows: 33-1.05 Any person, firm, or corporation, upon filing a request with the Department of Planning for a conditional permit for a sign as required of Subsection 33-1.01, shall be required to pay in advance the sum of Two Hundred Fifty -Nine ($259.00) 97NH2830.205 / 7-14-97 Zoning Fees SECTION 7 Section 33-3, Filing An application for a conditional permit initiated by the City Council, the Planning Commission, or any City Staff member acting in his capacity as City Staff member shall be without fee. Any person, firm, or corporation, upon filing a request with the Department of Planning for an exception to the requirements of Subsections 27-3.01.06. 7A-2(8). 7A-3(6). 7A-4(5) of this ordinance, necessitating the sending of notices and publication of notices in the newspaper, shall be required to pay in advance Three Hundred Fifty -Three ($353.00) Thrcc IIundred Thirty Six Dollars ($336). In the event the Planning Commission does not favorably recommend the fence exception and the applicant withdraws his request before it is forwarded to the City Council for public hearing and determination as provided in Article 30 of this ordinance, then 35 percent of the application fee shall be refunded upon written request by the applicant. SECTION 8. This ordinance to become effective August 1, 1997. SECTION 9.
