HomeMy WebLinkAbout023019 ORD - 07/29/1997AN ORDINANCE AMENDING CHAPTER 18, FIRE PREVENTION CODE, ARTICLE I, GENERAL, CHAPTER 4, PERMITS AND CERTIFICATES, SECTION 403, PERMIT FEES, OF THE CITY CODE OF ORDINANCES BY INCREASING EXISTING FEES AND ADDING NEW FEES IN THE CORPUS CHRISTI FIRE DEPARTMENT FIRE PREVENTION PERMIT FEE SCHEDULE; REPEALING ALL PREVIOUS PROVISIONS OF SECTION 403; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE OF AUGUST 1, 1997. WHEREAS, the City of Corpus Christi desires to amend the City of Corpus Christi Fire Prevention Code with certain additions, deletions, and changes for regulatory purposes and in the interest of life and property protection; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Code of Ordinances of the City of Corpus Christi is hereby amended by increasing existing fees and adding new fees in the Corpus Christi Fire Department Fire Prevention Permit Fee Schedule by repealing Chapter 18, Fire Prevention Code, Article I, General, Chapter 4, Permits And Certificates, Section 403, Permit Fees,as follows: ARTICLE I. GENERAL. Sec. 18-1 Fire Prevention Code. Chapter 4. Permits and Certificates. Section 403 Permit Fees. Churches that do not have day care facilities must pay a one-time fee for an assembly accupancy. If a site does not meet the standards for issuance of a permit after two (2) inspections, the applicant must submit a new application and pay a permit fee before any subsequent inspections will be conducted. Burning permits will not be issued unless both the Fire Prevention and the Environmental Control Division approve the material to be burned. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 3. This ordinance becomes effective August 1, 1997.
