ORDERING A SPECIAL ELECTION TO BE HELD ON NOVEMBER 4,
1997, IN THE CITY OF CORPUS CHRISTI ON THE QUESTION OF
AUTHORIZING, FOR NEEDED COMMUNITY PROJECTS, A SALES AND
USE TAX PURSUANT TO SECTION 4B OF ARTICLE 5190.6, VERNON'S
TEXAS CIVIL STATUTES; PROVIDING FOR PROCEDURES FOR
HOLDING SUCH ELECTION; PROVIDING FOR NOTICE OF ELECTION
AND PUBLICATION THEREOF; PROVIDING FOR ESTABLISHMENT OF
BRANCH EARLY POLLING PLACES; DESIGNATING POLLING PLACE
LOCATIONS; AUTHORIZING A JOINT ELECTION WITH NUECES
COUNTY; ENACTING PROVISIONS INCIDENT AND RELATING TO THE
SUBJECT AND PURPOSE OF THIS ORDINANCE; AND DECLARING AN
EMERGENCY.
WHEREAS, the Community Progress Partnership ("the CPP"), whose members represent
many diverse interests within the Corpus Christi community, gathered broad-based public input,
including many public hearings over more than one year, in order to develop, prioritize and
recommend projects and programs which will meet the community's current and future needs and
to recommend funding options and an implementation process; and
WHEREAS, the City Council has carefully considered the CPP's recommendations and
recommendations of other community groups and individuals; and
WHEREAS, the Texas Legislature in Section 4B of Article 5190.6, Vernon's Texas Revised
Civil Statutes, has empowered local communities with the means of improving the economic health
and prosperity of their citizens; and
WHEREAS, the City Council finds that the citizens of Corpus Christi should have the
opportunity to approve at an election the program for economic betterment of the community
developed in the CPP process; and
WHEREAS, the City Council finds that the projects to be presented to the voters, as
specified in Section 7 below, are each authorized by said Section 4B of Article 5190.6, as amended
by the Seventy -Fifth Texas Legislature;
WHEREAS, it is provided in Section 3.004 of the Texas Election Code that the governing
body shall order elections pertaining to municipal affairs, give notice and appoint election officers
to hold the election; and
WHEREAS. Nueces County will also be conducting an election on State Constitutional
amendments on November 4, 1997.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS, THAT:

SECTION 1. A special City election (hereinafter "the Election") shall be held in the City
of Corpus Christi, Texas, on November 4, 1997, for the purpose of submitting to the voters of the
City a ballot proposition that authorizes a corporation governed by Section 4B of Article 5190.6,
Vernon's Texas Civil Statutes, to use a sales and use tax of three-eighths of one percent for projects
authorized by said statute.
SECTION 2. At the Election all the qualified voters of the City of Corpus Christi shall be
permitted to vote.
SECTION 3. Precinct ballot counters shall be employed at the election in accordance with
the Texas Election Code and the Election shall be held at the polling places in the regularly
prescribed precincts of the City of Corpus Christi, as set forth on Attachment A hereto incorporated
by reference and made part of this ordinance. The Election shall be held in accordance with the
election laws of the State of Texas. The polls shall be open from 7:00 a.m. to 7:00 p.m. on the day
of the Election, Testing of the precinct ballot counting equipment shall be conducted as prescribed
by the Secretary of State's directive "Alternate Method of Testing Precinct Ballot Equipment".
SECTION 4. The City Secretary shall conduct the Election as directed by ordinance of the
City Council and by law. He is directed to request consideration by the U. S. Department of Justice
by the submission of any change herein which requires preclearance, and providing such
demographic data and information as required by law.
SECTION 5. Paper ballots and precinct ballot counters shall be used for the conduct of the
Election on election day and for early voting. Early voting in person at each of the temporary branch
polling places shall be conducted as follows:
October 20 through October 24, 1997
October 25, 1997
October 26, 1997
October 27 through October 29, 1997
October 30 and 31, 1997
8:00 a.m. - 5:00 p.m.
7:00 a.m. - 7:00 p.m.
12:00 p.m. - 5:00 p.m.
8:00 a.m. - 5:00 p.m.
7:00 a.m. - 7:00 p.m.
Such early voting in person may be conducted at the main early voting polling place located
in the first floor lobby of Nueces County Courthouse, 901 Leopard, or at the temporary branch
polling places hereby established as follows:

In addition, early voting in person may be conducted at the mobile temporary branch polling
places set forth in Attachment B. incorporated by reference and made a part of this ordinance, during
the days and hours specified therein. The City Secretary is authorized, in the event of an emergency.
preventing any of the designated polling places from being utilized. to provide for suitable
replacement locations.
Each branch polling place and the main early polling place shall serve all election precincts.
SECTION 6. The City Secretary is directed to post and publish such election notices as are
required by the Election Laws of the State of Texas. The City Secretary is further appointed as the
authority and officer responsible for the conduct of said election and is hereby authorized and
directed to make all necessary arrangements for the holding of said election in accordance with and
subject to the laws of this State including but not limited to contracting with Nueces County for the
use of tabulation equipment, supplies and printing of ballots.
SECTION 7. At the Election. the voters shall be presented with the following proposition
(in English and Spanish) in the form prescribed by the Texas Election Code:

The adoption of a Section 4B sales and use tax at the rate of three-eighths
of one percent to undertake, pursuant to Section 4B of Article 5190.6, the 36
items listed below (provided however, no project may be financed for a
period exceeding 20 years from the date the sales and use tax is first
received):
1) Youth Park Complex Improvements: Price, Waldron, Northwest, South
Guth, Greenwood/Horne, Bill Witt, Ben Garza ($8,440,00 present value
estimate from sales tax);
2) Facility to Provide Special Programs for At -Risk Youth, including
vocational training, through Academy of Transitional Studies Charter
School ($3,180,000 present value estimate from sales tax);
3) New Flour Bluff Library, New Southside Library, and Expansion of
Northwest Library ($4,210,000 present value estimate from sales tax);
4) JFK Causeway Elevation Project ($2,500,000 present value estimate from
sales tax);
5) 78415 Area Park & Learning Center ($2,340,000 present value estimate
from sales tax);
6) Southside Park Senior Citizen Center ($940,000 present value estimate
from sales tax);

athletic, entertainment, and public park purposes and events, including
stadiums, ball parks, auditoriums, amphitheaters, concert halls, learning
centers, parks and park facilities, open space improvements, municipal
buildings, museums, and related store, restaurant, concession, and automobile
parking facilities, related area transportation facilities, and related roads,
streets and water and sewer facilities, and other related improvements that
enhance any of those items; (estimated initially at $1,500,000 annually),
which Trust Fund automatically terminates 20 years after the date the sales
and use tax is first received;
33) Trust Fund for Community Projects, Equally Divided Between the
Single -member City Council Districts, including projects: a) required or

suitable for professional and amateur (including children's) sports, athletic,
entertainment, tourist. convention and public park purposes and events,
including stadiums, ball parks, auditoriums, amphitheaters, concert halls,
learning centers, parks and park facilities, open space improvements,
municipal buildings, museums, exhibition facilities, and related store,
restaurant, concession, and automobile parking facilities, related area
transportation facilities, and related roads, streets and water and sewer
facilities, and other related improvements that enhance any of those items, b)
which promote or develop new or expanded business enterprises. including
public safety facilities, streets and roads, drainage and related improvements,
demolition of existing structures, general municipally owned improvements,
as well as any improvements or facilities that are related to any of those
projects and any other project determined to promote or develop new or
expanded business enterprises, c) required or suitable for promotion of
development and expansion of affordable housing; (estimated initially at
$1,000,000 annually), which Trust Fund automatically terminates 20 years
after the date the sales and use tax is first received;
34) Trust Fund for Fire Fighting, Fire Prevention, Emergency Medical, and
Related Facilities and Equipment, (estimated initially at $750,000 annually)
which Trust Fund automatically terminates 20 years after the date the sales
and use tax is first received;
35) Trust Fund for Operation and Maintenance of the above-described
Projects which are Publicly Owned and Operated, (estimated initially at
$1,250,000 annually), which Trust Fund automatically terminates 20 years
after the date the sales and use tax is first received;
36) Surplus not necessary for the projects described in Items 1-31, above,
(which shall be divided proportionately between the trust funds in items 32,
33, 34, and 35 based on the ratio of their initially estimated funding)]
SECTION S. The election is expected to be conducted in accordance with an agreement
between Nueces County and the City of Corpus Christi to hold a joint election on November 4, 1997
(a substantial copy of which is attached hereto as Attachment C and incorporated herein), and the
City Secretary is authorized to enter into such an agreement with Nueces County and to approve all
lawful changes and additions to the procedures provided herein in order to implement such
agreement, including but not limited to provisions for substations and mobile voting sites.
SECTION 9. By approving and signing this ordinance, the Mayor officially confirms as his
action all matters recited in this ordinance which by law come within his jurisdiction.
SECTION 10. If for any reason any section, paragraph, subdivision, clause, phrase, word,
or provision of this ordinance or the ballot herein shall be held invalid or unconstitutional by final
judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph,
subdivision, clause, phrase, work, or provision of this ordinance, for it is the definite intent of this

City Council that every section, paragraph, subdivision, clause, phrase, word. or provision hereof
be given full force and effect for its purpose.
SECTION 11. The fact that it is necessary and essential that the governing body of the City
of Corpus Christi order elections pertaining to municipal affairs, that the notice of such election
should be promptly posted and published. that a special City election shall be held on
November 4, 1997, and that the requirements of the Voting Rights Act of 1965 may be timely met,
and immediate action is necessary for the efficient and effective administration of the city's affairs,
creates a public emergency and an imperative public necessity requiring the suspension of the charter
rule that no ordinance shall be passed finally on the date of its introduction, but that such ordinance
shall be read at two meetings of the City Council, and the Mayor, having declared that such
emergency and necessity exist, having requested the suspension of the charter rule and that this
ordinance be passed finally on the date of its introduction and take effect and be in full force and
effect from and after its passage, the Council hereby finds that such emergency and necessity do
exist, and IT IS ACCORDINGLY SO ORDAINED, this the day of August, 1997.

AGREEMENT TO CONDUCT
JOINT ELECTION
WHEREAS,
ATTAC
1. The City of Corpus Christi, Texas ("City") has ordered a special election on
November 4, 1997, for consideration of certain measures to be determined by qualified voters
of the City.
2. The Governor has ordered a special election on November 4, 1997, for consideration
of certain constitutional amendments, and it is the duty of Nueces County, Texas ("County")
to conduct that election.
3. City and County desire to minimize expenses to the taxpayers by conducting a joint
election.
FOR THE REASONS STATED, CITY AND COUNTY AGREE AS FOLLOWS:
1. Pursuant to Chapter 271 of the Texas Election Code, the City and County elections
on November 4, 1997, shall be conducted jointly in the Voting Precincts and Polling Places
listed in Attachment A, incorporated herein.
2. The appropriate County officials shall appoint election officers to conduct the joint
election. The County Clerk shall oversee the conduct of the joint election and assure that it
is conducted in accordance with the law.
3. Early voting shall be conducted jointly to the fullest extent permitted by Texas
Election Code, Section 271.006 at such times and places as designed by the appropriate
County officials. The County Clerk is appointed as the early voting clerk for joint early
voting. Mobile voting shall be jointly conducted at such times and places, if any, as may be
designed by appropriate County authorities. Early voting by mail will be received by the
Early Voting Clerk at the Nueces County Courthouse, 901 Leopard, Corpus Christi, Texas.
4. Pursuant to Election Code, Section 271.007, ballots containing all propositions
to be voted on at joint polling places shall be used, but a voter may not be permitted to use
a ballot containing a proposition on which the voter is ineligible to vote.
5. One set of ballot boxes shall be used at each common polling place for deposit of all
the ballots, pursuant to Election Code, Section 271.008.
6. The County Clerk shall prepare and maintain forms and records for the common
polling places in a manner convenient and adequate to record and report the election results
for the City and the County, pursuant to Election Code, Section 271.009. The County Clerk
is appointed as the general custodian of the election records of the joint election, pursuant
to Election Code, Section 271.010.

7. Each party will canvass the returns for the ballot items for which it has the duty to
conduct the election; there will be no joint canvass pursuant to Election Code. Section
271.011.
8. City will reimburse County in accordance with the following formula: (total costs
including early voting and election day expenses divided by total number of election
precincts and early voting sites multiplied by total number of precincts and early voting sites
used by City divided by two). Costs shall include without limitation, supplies, printing,
publication costs, ballots, voting machines, compensation for election officers, County staff
overtime, and transportation costs. Managerial and fixed staff costs associated with
oversight will not be billed to the City, and no separate administrative fee will be charged.
The County Clerk shall deliver a statement of costs to the City after the election, and the City
shall deliver it reimbursement to the County within 30 days of receipt of the statement.
9. The County Clerk shall prepare and file a joint submission for Voting Rights Act
preclearance, and shall be responsible for posting or publication requirements related to the
joint election.
10. The City by and through its City Secretary and the County by and through the County
Judge may amend this agreement in the event federal, state, or local law requires actions by
the election authority beyond the scope of this agreement.
