AMENDING ORDINANCE NO. 023044 BY ADDING TO THE ELECTION
BALLOT FOR NOVEMBER 4, 1997, A PROPOSITION FOR THE
CREATION OF THE CORPUS CHRISTI CRIME CONTROL AND
PREVENTION DISTRICT DEDICATED TO CRIME REDUCTION
PROGRAMS AND THE ADOPTION OF A PROPOSED SALES AND USE
TAX AT A RATE OF ONE-EIGHTH OF ONE PERCENT; AND
DECLARING AN EMERGENCY.
WHEREAS, on September 9, 1997, the Temporary Directors of the Proposed Corpus Christi
Crime Control and Prevention District ordered an election on the creation of the Corpus Christi
Crime Control and Prevention District dedicated to crime reduction programs and the adoption of
a proposed sales and use tax at a rate of one-eighth of one percent, and requested the City Council
to add the proposition to the election ballot for the November 4, 1997 election ordered in Ordinance
No. 023044.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS, THAT:
SECTION 1. The special City election to be held in the City of Corpus Christi, Texas, on
November 4, 1997, shall include the purpose of submitting to the voters of the City a ballot
proposition on the creation of the Corpus Christi Crime Control and Prevention District dedicated
to crime reduction programs and the adoption of a proposed sales and use tax at the rate of one -E ght
of one percent.
SECTION 2. Ordinance No, 023044 (incorporated herein by reference), adopted by the City
Council on August 26, 1997 to order a special election on November 4, 1997 on the question of
authorizing a sales and use tax pursuant to Section 4B of Article 5190.6, Vernon's Texas Civil
Statutes, is hereby amended by adding an "s" to the word "proposition" in the first phrase, then
adding the following to Section 7 immediately after the words "At the Election, the voters shall be
presented with the following propositions (in English and Spanish) in the form prescribed by the
Texas Election Code:"

In addition, the words "PROPOSITION FOR COMMUNITY PROJECTS" in said Section 7 are
amended to read "PROPOSITION 2. COMMUNITY PROJECTS". All other parts of Section 7
remain unchanged.

SECTION 3. If for any reason any section, paragraph, subdivision, clause, phrase, word,
or provision of this ordinance or the ballot herein shall be held invalid or unconstitutional by final
judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph,
subdivision, clause, phrase, work, or provision of this ordinance, for it is the definite intent of this
City Council that every section paragraph, subdivision, clause, phrase, word, or provision hereof be
given full force and effect for its purpose.
SECTION 4. The fact that it is necessary and essential that the governing body of the City
of Corpus Christi order elections pertaining to municipal affairs, that the notice of such election
should be promptly posted and published, that a special City election shall be held on November 4,
1997, and that the requirements of the Voting Rights Act of 1965 may be timely met, and immediate
action is necessary for the efficient and effective administration of the city's affairs, creates a public
emergency and an imperative public necessity requiring the suspension of the charter rule that no
ordinance shall be passed finally on the date of its introduction, but that such ordinance shall be read
at two meetings of the City Council, and the Mayor, having declared that such emergency and
necessity exist, having requested the suspension of the charter rule and that this ordinance be passed
finally on the date of its introduction and take effect and be in full force and effect from and after
its passage, the Council hereby finds that such emergency and necessity do exist, and IT IS
ACCORDINGLY SO ORDAINED, this the ALL day of st, 1997.

For the reasons set forth in the emergency clause of the foregoing ordinance an emergency exists
requiring suspension of the Charter rule as to consideration and voting upon ordinances at two
regular meetings: I/we, therefore, request that you suspend said Charter rule and pass this ordinance
finally on the date it is introduced, or at the present meeting of the City Council.
