WITH THE RAILROAD COMMISSION OF TEXAS FOR A PERMIT TO CONSTRUCT AND OPERATE A COMMERCIAL LANDTREATMENT FACILITY FOR OIL AND GAS WASTES IN THE LAKE TEXANA WATERSHED AND SUPPORTING THE LAVACA- NAVIDAD RIVER AUTHORITY'S REQUEST FOR A PUBLIC HEARING ON THE PERMIT APPLICATION AND URGING THE RAILROAD COMMISSION TO DENY THE PERMIT APPLICATION WHEREAS, the City of Corpus Christi (City) has contracted with the Lavaca- Navidad River Authority for the purchase of up to 41,840 acre-feet per year of water from Lake Texana to provide additional water supplies for use in the Corpus Christi area; and WHEREAS, the water supply available to the City of Corpus Christi from Lake Texana is derived from flows in the Navidad River watershed upstream of Lake Texana and is of excellent water quality; and WHEREAS, the Nueces River Authority and the Port of Corpus Christi Authority, under contract with the City, are constructing a 104 -mile, $115 million pipeline to convey water from Lake Texana to the Corpus Christi area; and WHEREAS, the City is to begin receiving water from Lake Texana via the pipeline by August, 1998; and WHEREAS, Spur Environmental, Inc. of Edna, Texas has proposed to construct and operate a landtreatment facility for oil and gas wastes on 91.23 acres of land at a site approximately ten miles north of Edna, Texas, adjacent to Stem Branch Creek, which is a tributary of the Navidad River and contributes flow into Lake Texana; and WHEREAS, the construction and operation of the proposed landtreatment facility in Jackson County, located in the Lake Texana watershed, would pose a serious threat to the quality of the water supply obtained by the City from Lake Texana; and WHEREAS, the Lavaca-Navidad River Authority has petitioned the Railroad Commission of Texas, requesting that a public hearing be held on the Spur Environmental, Inc. permit application and that the Railroad Commission deny the permit. MICitUFILMED NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City of Corpus Christi strongly opposes the Spur Environmental, Inc. application to the Railroad Commission of Texas for a permit to construct and operate an oil and gas waste landtreatment facility in Jackson County, Texas; and SECTION 2. That the City of Corpus Christi supports the Lavaca-Navidad River Authority in its actions requesting that the Railroad Commission of Texas hold a hearing on the Spur Environmental, Inc. application and deny the permit in order to protect water quality in the Navidad River and Lake Texana; and SECTION 3. That copies of this resolution be sent to: the Chairman of the Railroad Commission of Texas; Texas State Senators and Representatives from the Corpus Christi area; and other interested officials, urging them to support the Lavaca-Navidad River Authority's efforts to prevent Spur Environmental, Inc from receiving a permit to construct and operate this or any other landtreatment facility that poses a potential harm to the water quality of the Navidad River and Lake Texana.
