Home My WebLink About023126 ORD - 11/11/1997AN ORDINANCE AMENDING THE COMPREHENSIVE PLAN OF THE CITY OF CORPUS CHRISTI BY AMENDING CORPUS CHRISTI POLICY STATEMENTS, THE SOUTHSIDE AREA DEVELOPMENT PLAN, AND THE OSO PARKWAY PLAN ELEMENTS BY PROVIDING POLICY GUIDELINES FOR MAINTAINING CURRENT TRANSPORTATION PLANS AND FOR DESIGN OF COLLECTOR STREET SYSTEMS; BY ADDING ADDITIONAL COLLECTOR STREETS IN THE SOUTHSIDE AREA DEVELOPMENT PLAN; BY ADDING POLICIES CONCERNING BIKEWAYS IN THE SOUTHSIDE AREA DEVELOPMENT PLAN AND OSO PARKWAY PLAN; BY REVISING THE BIKEWAY SYSTEM IN THE OSO PARKWAY PLAN; AND PROVIDING FOR SEVERANCE. WHEREAS, the Planning Commission has forwarded to the City Council its report and recommendations concerning adopting amendments to the Corpus Christi Policy Statements, the Southside Area Development Plan, the Oso Parkway Plan as elements of the Comprehensive Plan of the City of Corpus Christi; WHEREAS, in accordance with proper notice to the public, a public hearing was held on Wednesday, August 6, 1997, during a meeting of the Planning Commission and on Tuesday, October 28, 1997, during a meeting of the City Council, in the Council Chambers at City Hall in the City of Corpus Christi allowing all interested persons to appear and be heard; and WHEREAS, the City Council has determined that the hereinafter set forth adoption would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Comprehensive Plan of the City of Corpus Christi, Texas is amended by making the change hereinafter set out. SECTION 2. That the Corpus Christi Policy Statements, an element of the Comprehensive Plan the City of Corpus Christi, are hereby amended by adding new policy statements in Section V, Transportation, Policies -General, Subparagraphs h, i, j, and k as follows: "h. TO ASSURE AN UP TO DATE TRANSPORTATION PLAN, THE CITY SHOULD EVALUATE THE NEED FOR TRANSPORTATION PLAN UPDATES ON A REGULAR BASIS BOTH AS A WHOLE AND AS INCREMENTAL CHANGES ARE APPROVED TO THE TRANSPORTATION SYSTEM DURING THE DEVELOPMENT PROCESS. A holistic review of the transportation network should be an ongoing effort at various levels. These levels include regional transportation review, citywide review, area development plan reviews, and specific site review when developments are approved. Overall R72817A1.309 ,NICROFIL.MEd "i. ".j. transportation plan amendments should be considered at Least every five years or sooner as needed. However, when specific sites are considered for development during the permitting process which, if approved, result in deviations to the Transportation Plan, the City should also address the need for transportation plan amendments. BETWEEN ARTERIAL STREETS, IN AN URBANIZING AREA CREATE FOUR WAY ARTERIAL/COLLECTOR INTERSECTIONS AT APPROXIMATELY 1/2 MILE INTERVALS. Such four-way intersections provide the future opportunity for: "- future traffic signalization. Otherwise, there is greater difficulty in satisfying traffic signal warrants, as well as the possibility of more frequent signal spacings. "- more efficient consolidation of arterial traffic. Otherwise, tee intersections result in more difficult control of arterial traffic with conflicting stacking movements in the arterials center left turn lane. CREATE EFFICIENT ACCESS TO SCHOOLS, WITHOUT HEAVY RELIANCE ON ACCESS BY ARTERIALS. THIS SHOULD BE ADDRESSED BOTH WITHIN AND EXTERNAL TO ARTERIAL GRIDS. AS UNFORSEEN DEVELOPMENT PATTERNS EMERGE AND WHERE FEASIBLE, CREATE A -COLLECTOR STREET LOOPS AROUND COMMERCIAL OR HIGH DENSITY RESIDENTIAL DEVELOPMENT LOCATED AT ARTERIAL STREET INTERSECTIONS TO FACILITATE TRAFFIC MOVEMENT AND TO SEPARATE INCOMPATIBLE LAND USES ON THE ABSENCE OF SUCH COLLECTORS BEING SPECIFICALLY DELINEATED ON THE TRANSPORTATION PLAN)." SECTION 3. That the Corpus Christi Policy Statements, an element of the Comprehensive Plan the City of Corpus Christi, are hereby amended by replacing the existing map of the Development Plan Study Areas at Appendix A, page A-8, with a new Development Plan Study Area map, a copy of which is attached hereto and made a part hereof for all purposes, marked Exhibit A. SECTION 4. That the Corpus Christi Policy Statements, an element of the Comprehensive Plan the City of Corpus Christi, are hereby amended by replacing the existing Appendix B, Area Development, Other Planning Studies, & Master Service Plans, with a new Appendix B, a copy of which is attached hereto and made a part hereof for all purposes, marked Exhibit B. SECTION 5. That the Southside Area Development Plan, an element of the Comprehensive Plan the City of Corpus Christi, is hereby amended by adding new Policy Statement subparagraphs C.5 and C.6 in Section C, Transportation, as follows: R72817A1.309 2 "C.5 - POLICY STATEMENT "Create a bikeway/pedestrian route along Ditch 31. "This is consistent with the Oso Parkway Plan. "C.6 - POLICY STATEMENT "Coordinate with property owners and/or develop a joint -use agreement with Central Power and Light Company to create a bikeway/pedestrian route, within the CPL transmission line easement from Saratoga Boulevard to Cimarron Boulevard. "A bikeway/pedestrian route in this easement will provide good north/south access from neighborhoods surrounding Kaffie Middle School and the adjacent city park. This CPL easement extends from Holly Road to the Oso Creek. Future amendments to the Southside Plan should consider expansion of this recommendation for bikeway/pedestrian access between Holly Road to the Oso Creek. SECTION 6. That the Southside Area Development Plan, an element of the Comprehensive Plan the City of Corpus Christi, is hereby amended by replacing the existing Figure 5, Southside Area Development Plan, Transportation Plan, with a new Figure 5, a copy of which is attached hereto and made a part hereof for all purposes, marked Exhibit C. SECTION 7. That the Oso Parkway Plan, an element of the Comprehensive Plan the City of Corpus Christi, is hereby amended by adding a new Policy Statement subparagraph D.5 in Section D, Transportation, as follows: "POLICY "STATEMENT "D.5 "Designation of bike trails along utility easements/drainage ditches are intended to provide a recreational benefit to the neighborhood, as well as serve as possible commuter routes and provide greater connectivity/convenience to the overall bikeway system. Minimal design, safety, and maintenance objectives for bike paths (two way) along drainageways should: "- satisfy or exceed AASHTO's "Guide for the Development of Bicycle Facilities"; "- be placed on both sides of a drainageway with the option of confining the bike path/pedestrian path to only one side if: "- AASHTO's standards cannot be met on one of the sides; "- drainage maintenance operations warrant; or "- if abutting development makes bike path/pedestrian path infeasible. R72817A1.309 3 "- bikeway / pedestrian routes along drainage right-of-ways should have provision for access to street frontages at distances not exceeding one-half mile." SECTION 8. That the Oso Parkway Plan, an element of the Comprehensive Plan the City of Corpus Christi, is hereby amended by replacing the existing Figure 4, Oso Parkway Plan, with a new Figure 4 and Figure 4A, a copy of which is attached hereto and made a part hereof for all purposes, marked Exhibit D. SECTION 9. That the Corpus Christi Policy Statements, Southside Area Development Plan, and Oso Parkway Plan amendments together with previously adopted plans except for portions herein amended, establishes the City of Corpus Christi's policies for growth, development, and aesthetics for the area described by said plans, a portion of the master and general plan of the City. SECTION 10. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 11. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgement of clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose.
