HomeMy WebLinkAbout023128 ORD - 11/11/1997AN ORDINANCE AMENDING THE CODE OF ORDINANCES CHAPTER 49 - STREETS AND SIDEWALKS, ARTICLE I, SECTION 49-17 - CONDITIONS AND REQUIREMENTS FOR PERMIT, BY CLARIFYING THAT THE MANAGING TENANT'S APPROVAL, AND, IF VACANT, THE MANAGING PROPERTY OWNER'S APPROVAL IS REQUIRED FOR A TEMPORARY STREET CLOSURE; BY ADDING A NEW REQUIREMENT PROVIDING FOR AT LEAST 90% APPROVAL OF THE MANAGING TENANTS OR, IF VACANT, MANAGING PROPERTY OWNERS OF THE PROPERTY ABUTTING THE AFFECTED STREET SECTION TO BE TEMPORARILY CLOSED FOR A PUBLIC EVENT WITHIN THE DOWNTOWN MANAGEMENT DISTRICT AREA; PROVIDING FOR PUBLICATION; AND PROVIDING FOR PENALTIES. WHEREAS, the persons most affected by a temporary street closure to vehicular traffic are those persons whose businesses abut the street temporarily being closed; and WHEREAS, the existing practice has been for the organization requesting a street closure to contact the business owner, who is not necessarily the property owner, for approval of the street closure, and this ordinance is needed to clarify and codify that practice; and WHEREAS, the Downtown Managment District has requested that, for the Downtown Management District area only, the requirement for approval of the abutting managing tenant or owner, if the property is vacant, be reduced from 100% to 90% for the entire area where the street closure is being requested. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Code of Ordinances Chapter 49 - Streets and Sidewalks, Article I Section 49-17, is hereby amended as follows: item (f): Written approval for the temporary street closure must be obtained from;.(i) one hundred (100) per cent of the managing tenants or. if the property is vacant. managing property owners of the property abutting that portion property --owners of the street to be closed to vehicular traffic: and (ii) for the Downtown Management District area only (bounded by Lower Broadway. Interstate 37. Shoreline Boulevard (including the marina areas). and Kinney Street). ninety (90%) percent of the managing tentants. or, if the property is vacant. managing property owners of the property abutting that portion of the street to be closed to vehicular traffic. SECTION 3. A violation of this temporary street closure to vehicular traffic may result in a citation being issued and a fine being assessed.
