PLAN I EMPLOYEES, AS FOLLOWS: SUBSECTION 951.1, VACATION LEAVE ACCRUAL; SUBSECTION 951.2 RENUMBERED TO 951.2(a) AND NEW SUBSECTION 951.2 (b) ADDED TO DEFINE WORKING HOURS CHARGED FOR VACATION USAGE; SUBSECTION 951.4, TO PROVIDE FOR ANNUAL ACCUMULATION OF VACATION LEAVE AND PAYMENT OF ACCRUED VACATION LEAVE UPON TERMINATION, RETIREMENT, OR DEATH; SUBSECTION 951.5 TO PROVIDE FOR CASH -IN OF ACCRUED VACATION LEAVE; SUBSECTION 951.8, TO PROVIDE FOR GRANTING AND TAKING OF PERSONAL LEAVE; SUBSECTION 951.9, TO PROVIDE FOR SICK LEAVE ACCRUAL AND ACCUMULATION; ADDITION OF A NEW SUBSECTION 951.11(a) TO DEFINE WORKING HOURS CHARGED FOR SICK LEAVE USAGE; SUBSECTION 951.12 TO PROVIDE FOR PAYMENT OF SICK LEAVE UPON TERMINATION; SUBSECTION 951.13, TO PROVIDE FOR CASH -IN OF ACCRUED SICK LEAVE. SUBSECTION 900.4 TO DEFINE HOLIDAY PAY AND HOLIDAY COMPENSATORY TIME FOR AIRPORT PUBLIC SAFETY OFFICERS WHO WORK SHIFTS OF 24 HOURS ON/48 HOURS OFF. PROVIDING FOR SEVERANCE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION I: That Ordinance 8127, as amended, Section 951.1 be amended to read as follows: 951.1 Vacation Leave Accrual. LAI Plan I Employees, except Airport Public Safety Officers who work a shift of 24 hours on and 4R hours off, earn vacation leave by pay period on the basis of 40 base hours per week or, if less than 40 hours per week, on a pro -rated basis. Accrual rates are as follows: Years of Service Accrual Rate/Hours Less than Beginning Beginning Beginning 6 years of service the 6th year the 16th year the 31st year 88 104 144 168 (¢) Airport Public Safety Officers who work shifts of 24 hours on and 48 hours off earn vacation leave by pay period on the basis of 12 hour shifts with the following accrual rates: 411:k alLMEO Years of Service Accrual Rate/Hours Less than 6 years of service Beginning the 6th year Beginning the 16th year Beginning the 31st year 132 156 216 252 1231'75 Page 2 SECTION II. That Ordinance 8127, as amended, Section 951.2 be renumbered as 951.2(a) and a new Subsection 951.2(6) be added to read as follows: 951.2(b) For Airport Public Safety Officers scheduled to work 24 hours on and 48 hours off 12 hours shall be counted as one working day taken for vacation purposes. SECTION III. That Ordinance 8127, as amended, Section 951.4 be amended to read as follows: 951.4(a) Accumulation and Carryover of Vacation Leave. Vacation leave credit may be accumulated by Plan I Employees, except for Airport Public Safett Officers who work shifts of 24 hours on and 48 hours off. to a maximum of 240 hours plus their current annual accrual rate during the calendar year. Vacation Accrual which exceeds 240 hours as of the last pay period of the calendar year will be deleted if not used prior to that date. The City Manager may authorize exceptions based on extraordinary circumstance, work requirements or for other purposes deemed beneficial to the City Service. 951.4(b) Vacation leave credit may be accumulated by Airport Public Safety Officers who work shifts of 24 hours on and 48 hours off. up to a maximum of 360 hcurR plus their current annual accrual rate during the calendar year. Vacation Accrual which exceeds 360 hours as of the last pay period of the calendar year will be forfeited if not used prior to that date. The City Manager may authorize exceptions based on extraordinary circumstance. work requirements. or for other purposes deemed beneficial to the City Service. 951.4(c) Payment of Accrued Vacation Leave Upon Termination. Retirement. or Death. No more than 240 hours of accumulated vacation credit will be paid to a Plan I Employee, except for Airport Public Safety Officers who work shifts of 24 hours on and 48 hours off, or his/her beneficiary upon termination, retirement, or death. No vacation credit shall be paid at termination unless the employee has been employed for period of time in excess of twelve (12) months. Page 3 951.4 (d) payment to Airport Public Safety Officers of Accrued Vacation Leave Upon Termination, Retirement. or Death. No more than 360 hours of accumulated vacation credit will be paid to an Airport Public Safety Officer who works shifts of 24 hours on and 48 hours off. or hisIher beneficiary upon termination. retirement. or death. No vacation credit shall be paid at termination unless the employee has been employed for a period in excess of twelve (12) months. SECTION IV. That Ordinance 8127, as amended, Section 951.5, be amended to read as follows: 951.5(a) Cash -in of Vacation Leave. Plan I Employees with more than 120 hours of accumulated vacation credit, except for Airport Public Safety Officers who work shifts o 4 ho on and 48 ho o , will be allowed to "cash -in" vacation hours at the rate of 8 hours of equivalent pay for each 8 hours of vacation actually taken off during the calendar year, up to a maximum of 40 hours. 951.5(b) Cash -in of Vacation Leave for Airport Public Safety Officern. Airport Public Safety Officers who work shifts of 24 hours on and 48 hours off. who accumulate more than 180 hours of vacation. will be allowed to "cash -in" vacation hours at the rate of 12 hours of equivalent pay for each 12 hours of vacation taken during the calendar year, up to maximum of 60 hours. SECTION V. That Ordinance 8127, as amended, Section 951.8, be amended to read as follows: 951.8 Personal Leave. Effective August 1 of each year, each eligible Plan I Employee except for Airport Public Safety Officers who work shifts of 24 hours on and 48 hours off shall receive 24 hours of personal leave to be used under guidelines promulgated by the City Manager. Personal leave hours are non -cumulative and must be taken within the fiscal year received. 951.8 (b) Page 4 Personal Leave for Airport Public Safety Officers. Effective August 1 of each year. each eligible Airport Public Safety Officer who works shifts of 24 hours on and 48 hours off will receive 36 hours of personal leave to be used under guidelines promulgated by the City Manager. Personal leave hours are non- cumulative and must be taken within the fiscal year received. SECTION VI. That Ordinance 8127, as amended, Section 951.9, be amended to read as follows: 951.9(a' Sick Leave Accrual and Accumulation. All eligible Plan I Employees, except for Airport Public Safety Officers who work a shift of 24 hours on and 48 hours off, earn and are allowed sick leave at the rate of 96 hours for each year of continuous service, accrued on the basis of 26 bi-weekly pay periods. Sick leave may be accumulated to a maximum of 960 hours. 951.9(b) Sick Leave Accrual and Accumulation for Airport Public Safety Officers. All eligible Airport Public Safety Officers who work a shift of 24 hours on and 48 hours off. earn and are allowed sick leave at the rate of 144 hours for each year of continuous service. accrued on the basis of 26 bi- weekly pay periods. Sick leave may be accumulated to a maximum of 1.440 hours. SECTION VII. That Ordinance 8127, as amended, be amended by adding a new Subsection 951.11(a) to read as follows: 951 11(a) For Airport Public Safety Officers who work a schedule of 24 hours on and 48 hours off. 12 scheduled working hours shall be counted as one work shift for sick leave purposes. Page 5 SECTION VIII. That Ordinance 8127, as amended, be amended by amending Section 951.12 to read as follows: 951.12(a) Payment of Sick Leave Upon Termination. If the employment of a Plan I Employee, except for Airport Public Safety Officers who work shifts of 24 hours on and 48 hours off. terminates due to TMRS disability or service retirement or termination at age 60 upon completion of a minimum of ten years continuous service or upon death, the employee or his designated beneficiary shall be eligible for payment of accumulated sick leave credit on a two- for-one basis. Up to 720 hours of accumulated sick leave credit may be cashed in for the equivalent of up to 360 hours of pay. Payment shall be calculated at the rate of the employee's last monthly salary or hourly rate. 951.12(b) Payment of Sick Leave Upon Termination for Airport public Safety Officers. If the employment of an Airport Public Safety Officers who work shifts of 24 hours on and 48 hours off terminates due to TMRS disability or service retirement or termination at age 60 upon completion of a minimum of ten years continuous service or upon death. the employee or his designated beneficiary shall be eligible for payment of accumulated sick leave credit on a two- for-one basis. Up to 1,080 hours of accumulated sick leave credit may be cashed in for the equivalent of up to 540 hours of pay. Payment shall be calculated at the rate of the employee's last monthly salary or hourly rate. SECTION IX. That Ordinance 8127, as amended, be amended by amending Section 951.13 to read as follows: 951.13(a) Cash -in of Sick Leave. A Plan I Employee, except for Airport Public Safety Officers who work shifts of 24 hours on and 48 hours off. who has at least 240 hours of accumulated sick leave and who has not taken more than 32 hours of sick leave in the previous calendar year, may cash in up to 32 hours of accumulated sick leave in a calendar year at 50% of salary or hourly rate of pay. Page 6 951.13(b) Cash -in of Sick Leave by Airport Public Safety Officer. pjl Airport Public Safety Officer who works shifts of 24 hours on and 48 hours off and who has at least 360 hours of accumulated sick leave and who has not taken more than 48 hours of sick leave in the previous calendar year. may cash in up to 4R hours of accumulated sick leave in a calendar year at 50% of salary or hourly rate of pay. SECTION X. That Ordinance 8127, as amended, be amended by replacing Section 900, Holidays, Subsection 900.4, to read as follows: 900.4 Holiday pay is defined as equivalent to 8 hours of work, except for Airport Public Safety Officers who work shifts of 24 hours on and 48 hours off. Holiday pay and holiday compensatory time for these Airport Public Safeco Officers will be counted as 12 hours per shift. Further (-Exceptions to this a holiday defined as equivalent to 8 hours of work may be granted by the City Manager, or designee, for employees who are assigned to a work schedule which exceeds 8 hour per day. SECTION XI. If, for any reason, any section, paragraph, subdivision, clause, phrase, word or provision of this Ordinance shall be held invalid or unconstitutional by final judgement of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this Ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose.
