APPROVING AND AUTHORIZING THE MAYOR TO EXECUTE A
PROJECT COOPERATION AGREEMENT FOR THE FINAL DESIGN,
BIDDING, AND CONSTRUCTION FUNDING FOR PACKERY CHANNEL
DREDGING FOR BEACH NOURISHMENT WITH THE GENERAL LAND
OFFICE; PROVIDING FOR SEVERENCE; AND DECLARING AN
EMERGENCY.
WHEREAS, construction of the North Padre Island Storm Damage Reduction and
Environmental Restoration Project at North Padre Island, Corpus Christi Bay, Texas
("Packery Channel Project"), was authorized by the Water Resources Development Act of
1999; and
WHEREAS, the City of Corpus Christi is the Non-Federal Sponsor of the Packery
Channel Project with the U. S. Army Corps of Engineers ("USACE"); and
WHEREAS, it has been determined that the preferred method of addressing erosion on
North Padre Island is to use approximately 688,000 cubic yards of sand, which is
dredged during the Packery Channel Project, to renourish the beach in front of the
seawall on North Padre Island; and
WHEREAS, the Texas General Land Office ("TGLĀ©"), under the authority of the
Coastal Erosion Planning and Response Act has agreed to execute a Supplemental
Agreement to a Memorandum of Understanding between TGLO and USACE, which will
provide $1,725,000 to transport the sand from Packery Channel to the Gulf of Mexico
shoreline adjacent to and southwest of Packery Channel.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. The Project Cooperation Agreement with the General Land Office for the
final design, bidding, and construction funding for Packery Channel dredging for beach
nourishment is approved.
SECTION 2. The Mayor is authorized to execute the Project Cooperation Agreement
with the General Land Office for the final design, bidding, and construction funding for
Packery Channel dredging for beach nourishment with the general land office.
SECTION 3. If for any reason any section, paragraph, subdivision, clause, phrase,
word, or provision of this ordinance is held invalid or unconstitutional by final judgment
of a court of competent jurisdiction, it does not affect any other section, paragraph,
subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite
intent of this City Council that every section, paragraph, subdivision, clause, phrase,
word or provision of this ordinance be given full force and effect for its purpose.
SECTION 4. That upon written request of the Mayor or five Council members, copy
attached, the City Council (1) finds and declares an emergency due to the need for

immediate action necessary for the efficient and effective administration of City affairs
and (2) suspends the Charter rule that requires consideration of and voting upon
ordinances at two regular meetings so that this ordinance is passed and takes effect

For the reasons set forth in the emergency clause of the foregoing ordinance an
emergency exists requiring suspension of the Charter rule as to consideration and
voting upon ordinances at two regular meetings: I/we, therefore, request that you
suspend said Charter rule and pass this ordinance finally on the date it is introduced, or
at the present meeting of the City Council.
