AMENDING ORDINANCE NO. 026717 TO ORDER A SPECIAL
ELECTION TO BE HELD ON NOVEMBER 7, 2006, IN THE CITY OF
CORPUS CHRISTI ON THE QUESTIONS OF AMENDING THE CHARTER
OF THE CITY OF CORPUS CHRISTI TO PROVIDE FOR A PUBLIC
PEDESTRIAN -SAFE BEACH BETWEEN PACKERY CHANNEL AND
PADRE BALLI PARK AND PROHIBITING ANY RESTRICTION OF
VEHICULAR ACCESS IN ORDER TO CREATE VEHICLE -FREE
BEACHES UNLESS APPROVED BY A MAJORITY OF QUALIFIED
VOTERS OF THE CITY WHO VOTE AT AN ELECTION HELD FOR THAT
PURPOSE; PROVIDING FOR PROCEDURES FOR HOLDING SUCH
ELECTION; PROVIDING FOR NOTICE OF ELECTION AND
PUBLICATION THEREOF; PROVIDING FOR ESTABLISHMENT OF
BRANCH EARLY POLLING PLACES; DESIGNATING POLLING PLACE
LOCATIONS; AUTHORIZING A JOINT ELECTION WITH NUECES
COUNTY; AND ENACTING PROVISIONS INCIDENT AND RELATING TO
THE SUBJECT AND PURPOSE OF THIS ORDINANCE; AND
PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE
WHEREAS, on March 28, 2006 the City Council ordered a special election, to be held on
the first Saturday in April. 2007, to place before the electorate of the City of Corpus Christi
a proposed amendment to the Charter of the City of Corpus Christi;
VIiIEREAS, on June 29 2006, a referendum petition, seeking the repeal Ordinance No.
026716 which restricted vehicular traffic on the beach between Packery Channel and
Padre Balli Park. was submitted and said petition was verified on July 18, 2006;
WHEREAS, on August 3, 2006, a petition seeking to amend the Charter to prohibit
vehicular access to the Gulf beach unless approved by a majority vote at an election held
for that purpose. was submitted and said petition was verified on August 17, 2006;
WHEREAS, City Council desires to amend the ordinance calling the special election to
change the date of the election to November 7, 2006, and to expand the proposed
amendment to provide for a public pedestrian -safe beach between Packery Channel and
Padre Balli Park and to include a petition- requested Charter amendment;
WHEREAS, it is provided in Section 3.004 of the Texas Election Code that the
governing body shall order elections pertaining to municipal affairs, give notice and
appoint election officers to hold the election; and
V*IEREAS, Nueces County will also be conducting a general election on November 7,
2X6;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS, THAT:

SECTION 1. A Special City election (hereinafter the "Election ") previously called for the
first Saturday in April, 2007. shall be held in the City of Corpus Christi, Texas, on
November 7 2006. for the purpose of submitting to the voters of the City consideration of
an amendment to the Charter of the City of Corpus Christi.
SECTION 2. At the Election all the qualified voters of the City of Corpus Christi shall be
permitted to vote
SECTION 3 The eSlate direct recording equipment (DRE) shall be employed at the
election in accordance with the Texas Election Code and the Election shall be held at
the polling places in the regularly prescribed precincts of the City of Corpus Christi, as
set forth on Attachment A hereto incorporated by reference and made part of this
ordinance (said Attachment A to be approved and attached when the polling places in
the regularly prescribed precincts are finally determined by Nueces County). The
Election shall be held in accordance with the election laws of the State of Texas. The
polls shall be open frorr 7:00 a m. to 7 :00 p.m on the day of the Election.
SECTION 4. The City Secretary shall conduct the Election as directed by ordinance of
the City Council and by law in accordance with the joint election agreement to be
entered into with Nueces County (the agreement with Nueces County shall be approved
and attached hereto as Attachment B and incorporated herein). He is directed to
request consideration by the U. S. Department of Justice of the submission of any
change herein which requires preclearance, and to provide such demographic data and
information as required by law
SECTION 5. The eSlate direct recording equipment shall be used for the conduct of the
Election on Election Day and for early voting. Early voting in person at each of the
temporary branch polling places shall be conducted as follows:
Such early voting in person may be conducted at the main early voting polling place
located in the first floor lobby of Nueces County Courthouse, 901 Leopard, and at the
temporary branch polling places set forth in Attachment C, to be approved and attached
when the temporary branch polling places are determined by Nueces County and then
incorporated by reference and made a part of this ordinance
In addition, early voting in person may be conducted at the mobile temporary branch
paling places set forth in Attachment D, to be approved and attached when the mobile
temporary branch polling places are determined by Nueces County and then
incorporated by reference and made a part of this ordinance, during the days and hours
specified therein. The City Secretary is authorized, in the event of an emergency,

preventing any of the designated polling places from being utilized, to provide for
suitable replacement locations
Each branch polling place and the main early polling place shall serve all election
precincts
SECTION 6. The City Secretary is directed to post and publish such election notices as
are required by the Election Laws of the State of Texas. The City Secretary is further
appointed as the authority and officer responsible for the conduct of said election and is
hereby authorized and directed to make all necessary arrangements for the holding of
said election in accordance with and subject to the laws of this State including but not
limited to coordinating the election process, including use of tabulation equipment, and
supplies. in accordance with the joint election agreement to be executed with Nueces
County The City Secretary is authorized to approve all lawful changes and additions to
the procedures provided herein in order to implement such agreement, including, but
not limited to provisions for substations and mobile voting sites.
SECTION 7_ At the Election, the voters shall be presented with the following
propositions (in English and Spanish) in the form prescribed by the Texas Election
Code:

Effect of Amendment:
Adoption of the Charter Amendment would amend the City Charter, ARTICLE X,
GENERAL POWERS AND PROVISIONS, by adding a new Section, Public pedestrian-
sae beach areas as follows, and renumbering the remaining sections of Article X
accordingly:

A public pedestrian -safe beach area is authorized on the Gulf beach extending
approximately 7,200 feet from the south jetty of Packery Channel southward and
along the seaward side of the Gulf seawall to the northern boundary line of Padre
Balli Park. The ,ity council is authorized to adopt ordinances restricting vehicular
traffic on the public pedestrian -safe beach, except for emergency vehicles, vehicles
used to maintain the beach or other authorized vehicles, and establishing the
conditions required before the creation of the public pedestrian -safe beach. The
ordinance effecting the creation of a public pedestrian -safe beach is not subject to
initiative or referendum

THAT PURPOSE
Effect of Amendment
Adoption of the Charter Amendment would amend the City Charter, ARTICLE X,
GENERAL POWERS AND PROVISIONS, by adding a new Section, Certain restrictions of
vet icular access to the Gulf beach as follows, and renumbering the remaining provisions
of Article X accordingly:
Section Certain restrictions of vehicular access to the Gulf beach.
Vehicular access to and on the Gulf beach may not be restricted unless approved
by a majority vote of qualified voters of the City, voting at an election duly called for
such purpose Thereafter, the City Council may take appropriate action to restrict
vehicular access to and on specific portions of the Gulf beach and comply with all
other requirements necessary to implement the result of the election. The approval
at election requirement shall not apply when vehicles are restricted from access to
areas of the Gulf beach for public necessity. "Public necessity" shall be limited to
environmental emergencies. public health and safety emergencies, and
government functions whose importance justifies the restriction of vehicular access.
The restriction of vehicular access for public necessity shall be limited to the
smallest possible area and for the shortest possible duration.

SECTION 8. If for any reason any section, paragraph, subdivision, clause, phrase, word
or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a
court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision,
clause, phrase, word. or provision of this ordinance, for it is the definite intent of this City
Council that every section, paragraph subdivision, clause, phrase, word or provision of
this ordinance be given full force and effect for its purpose.
SECTION 9. This ordinance shall take effect upon and after publication of this ordinance.

CITY OF CORPUS CHRISTI, DEL MAR COLLEGE DISTRICT,
CORPUS CHRISTI INDEPENDENT SCHOOL DISTRICT
AND
NUECES COUNTY
JOINT ELECTION AGREEMENT
This Agreement ( "Agreement ") is made and entered into on 7th day of November, 2006, by
and between Nueces County ( "County "), and the City of Corpus Christi ( "City "), and Del
I1r College District ( "DMCD "), and Corpus Christi Independent School District (CCISD)
for the purposes and considerations stated below:
WITNESSETH
VINIEREAS, the County will hold a general election within the boundaries of the County on
7th day of November, 2006; and
NWIEREAS, the City will hold a special election within the boundaries of the City on 7th day
ofNovember, 2006; and
WIEMEREAS, the DMCD will hold a general election within the boundaries of the DMCD on
7th day of November, 2006; and
WHEREAS, the CCISD will hold a general election within the boundaries of the CCISD on
71 day of November, 2006; and
WHEREAS, it is the finding of the governing bodies of the parties hereto that it would be
mutually beneficial for the County, the City, DMCD and the CCISD to jointly enter into an
Agreement to hold the elections jointly and also to enter into an Election Services Contract for
a provision of certain election services with the County Election Officer of Nueces County,
Texas;
THEREFORE, pursuant to Chapter 271 of the Texas Election Code, the County, and the
City, and DMCD and CCISD agree as follows:
I.
ELECTION RESPONSIBILITIES
1. In accordance with Chapter 271 (Joint Elections) of the Texas Election Code, the County
agrees to oversee and coordinate the conduct of said election for City, DMCD, and
CCISD and oversee and coordinate the provision of services to prepare for and facilitate

the joint election to be held on 7th day of November, 2006, County, City, DMCD, and
CCISD agree that early voting and regular election day voting shall be conducted jointly.
2. In accordance with Chapter 31, Subchapter D of the Texas Election Code, City, DMCD
and CCISD agree jointly to enter into an Election Services Contract with the County
Election Officer of Nueces county, Texas, for the provision of those certain election
services described in the Election Services Contract attached hereto as Exhibit A and
incorporated herein by reference. The County Election Officer, Diana T. Barrera, is
hereby designated the Election Officer responsible for conduct and provision of the
election services identified in the Election Services Contract attached as Exhibit A. Said
County Election Officer will serve as the Early Voting Clerk, and her designee will serve
as the Counting Station Manager of the Central Counting Station for the joint election.
3. Armando Chapa is hereby designated the primary representative of City to oversee and
coordinate with the County Election Officer in the conduct of the elections. J. L. Alaniz is
hereby designated the primary representative of DMCD to oversee and coordinate with
the County Election Officer in the conduct of the elections. Dr. Manuel Flores is hereby
designated the primary representative of CCISD to oversee and coordinate with the
County Election Officer in the conduct of the elections. In addition, Armando Chapa, as
the City's Election Authority, J. L. Alaniz , as the DMCD's Election Authority, and Dr.
Manuel Flores as the CCISD's Election Authority will perform or cause to be performed
the following services
a. Coordinate with County on the conduct of all aspects of City, DMCD and CCISD's
elections, including (1) selection and establishment of early voting sites, and conduct
of early voting (locations of early voting substation are attached to this Agreement as
Exhibit B), and (2) designation of precincts, and polling places for use on election day
(a list of polling places is included with this Agreement as Exhibit C).
b. Coordinate the handling and disposition of City, DMCD and CCISD election returns,
voter ballots, and tabulation of unofficial returns, and preparation of the tabulation for
the official canvass by governmental entities.
c. Provide information services for voters and election officers relating to City, DMCD
and CCISD elections.
d. Maintain custody of City, DMCD and CCISD returns for a period as required by the
Texas Election Code.
II
PAYMENT
The City, DMCD and CCISD agree to pay Nueces County for their share of the expenses of
the election on a prorated basis dependent upon the number of entities participating in the
joint election. Such payments will be made within 30 days of receipt from the County
Election Officer of an itemized statement of the exact costs, expenses incurred and
outstanding expenses related to the performance of election services, with City, DMCD,
CCISD and County each paying their respective shares of such costs and expenses.

MISCELLANEOUS
1. County will not be responsible for preparing and filing a joint submission on behalf of
City, DMCD, and CCISD to the Justice Department for pre - clearance as may be required
under Section 5 of the Voting Rights Act of 1965, as amended. Any amendments to the
joint submission shall be prepared and submitted by each respective party.
2. Each party will be responsible for posting or publication requirements necessitated by
federal, state or local laws as they may pertain to implementation of the respective issues
placed on the ballot.
3. Each party will be responsible for receipt and processing filings of financial report
statements by special purpose committees relating to the party's own respective elections.
4. County will order separate City ballots for City, DMCD and CCISD containing all
propositions and regent candidates, respectively, to be voted on at the joint polling places,
but a voter may not be permitted to vote on a City ballot containing a proposition, or a
DMCD ballot containing candidates and a proposition, or a CCISD ballot containing

JOINT ELECTION AGREEMENT
This Agreement ( "Agreement ") is made and entered into on 7th day of November, 2006, by
mid between Nueces County ( "County"), and the City of Corpus Christi ( "City"), and Del
Mar College District ( "DMCD "), and Tuloso Midway Independent School District (TMISD)
far the purposes and considerations stated below:
WITNESSETH
WHEREAS, the County will hold a general election within the boundaries of the County on
7th day of November, 2006; and
WHEREAS, the City will hold a special election within the boundaries of the City on 7th day
4November, 2006; and
WHEREAS, the DMCD will hold a general election within the boundaries of the DMCD on
7th day of November, 2006; and
WHEREAS, the TMISD will hold a general election within the boundaries of the TMISD on
7th day of November, 2006; and
WHEREAS, it is the finding of the governing bodies of the parties hereto that it would be
mutually beneficial for the County, the City, DMCD and the TMISD to jointly enter into an
Agreement to hold the elections jointly and also to enter into an Election Services Contract for
a provision of certain election services with the County Election Officer of Nueces County,
Texas;
THEREFORE, pursuant to Chapter 271 of the Texas Election Code, the County, and the
City, and DMCD and TMISD agree as follows:
I.
ELECTION RESPONSIBILITIES
1. In accordance with Chapter 271 (Joint Elections) of the Texas Election Code, the County
agrees to oversee and coordinate the conduct of said election for City, DMCD, and

TMISD and oversee and coordinate the provision of services to prepare for and facilitate
the joint election to be held on 7th day of November, 2006, County, City, DMCD, and
TMLSD agree that early voting and regular election day voting shall be conducted jointly.
2. In accordance with Chapter 31, Subchapter D of the Texas Election Code, City, DMCD
and TMISD agree jointly to enter into an Election Services Contract with the County
Election Officer of Nueces county, Texas, for the provision of those certain election
services described in the Election Services Contract attached hereto as Exhibit A and
incorporated herein by reference. The County Election Officer, Diana T. Barrera, is
hereby designated the Election Officer responsible for conduct and provision of the
election services identified in the Election Services Contract attached as Exhibit A. Said
County Election Officer will serve as the Early Voting Clerk, and her designee will serve
as the Counting Station Manager of the Central Counting Station for the joint election.
3. Armando Chapa is hereby designated the primary representative of City to oversee and
coordinate with the County Election Officer in the conduct of the elections. J. L. Alaniz is
hereby designated the primary representative of DMCD to oversee and coordinate with
the County Election Officer in the conduct of the elections. Dr. Cornelio Gonzalez is
hereby designated the primary representative of TMISD to oversee and coordinate with
the County Election Officer in the conduct of the elections. In addition, Armando Chapa,
as the City's Election Authority, J. L. Alaniz, as the DMCD's Election Authority, and Dr.
Cornelio Gonzalez as the TMISD's Election Authority will perform or cause to be
performed the following services:
a. Coordinate with County on the conduct of all aspects of City, DMCD and TMISD's
elections, including (1) selection and establishment of early voting sites, and conduct
of early voting (locations of early voting substation are attached to this Agreement as
Exhibit B), and (2) designation of precincts, and polling places for use on election day
(a list of polling places is included with this Agreement as Exhibit C).
b. Coordinate the handling and disposition of City, DMCD and TMISD election returns,
voter ballots, and tabulation of unofficial returns, and preparation of the tabulation for
the official canvass by governmental entities.
c. Provide information services for voters and election officers relating to City, DMCD
and TMISD elections.
d. Maintain custody of City, DMCD and TMISD returns for a period as required by the
Texas Election Code.
II
PAYMENT
The City, DMCD and TMISD agree to pay Nueces County for their share of the expenses of
election on a prorated basis dependent upon the number of entities participating in the
joint election. Such payments will be made within 30 days of receipt from the County
ection Officer of an itemized statement of the exact costs, expenses incurred and

outstanding expenses related to the performance of election services, with City, DMCD,
TMED and County each paying their respective shares of such costs and expenses.
MISCELLANEOUS
1. County will not be responsible for preparing and filing a joint submission on behalf of
City, DMCD, and TMISD to the Justice Department for pre - clearance as may be required
under Section 5 of the Voting Rights Act of 1965, as amended. Any amendments to the
joint submission shall be prepared and submitted by each respective party.
2. Each party will be responsible for posting or publication requirements necessitated by
federal, state or local laws as they may pertain to implementation of the respective issues
placed on the ballot.
3. Each party will be responsible for receipt and processing filings of financial report
statements by special purpose committees relating to the party's own respective elections.
4. County will order separate City ballots for City, DMCD and TMISD containing all
propositions and regent candidates, respectively, to be voted on at the joint polling places,
but a voter may not be permitted to vote on a City ballot containing a proposition, or a
DMCD ballot containing candidates and a proposition, or a TMISD ballot containing
candidates and a proposition on which the voter is ineligible to vote.
