for O.N. Stevens Water Treatment Plant is a sole source
procurement; and authorizing the City Manager, or designee, to
execute a supply agreement with Hach Company of Loveland,
Colorado, for the purchase of chemkeys and reagents for a total
amount not to exceed $825,780.23 for a three-year term, with an
annual step price increase.
WHEREAS, the chemkeys and reagents for O.N. Stevens Water Treatment Plant
will be purchased for use by the Water Department;
WHEREAS, these chemkeys and reagents for O.N. Stevens Water Treatment
Plant will be used to test and maintain the quality and safety of our drinking water for our
citizens;
WHEREAS, State law provides that such procurements, as outlined above, are
subject to statutory procurement requirements, including competitive bids, unless an
exception applies;
WHEREAS, there is also a statutory exception for this procurement in Local
Government Code, Section 252.022(a) (7) (A), as this purchase is available from only
one source due to special processes or patents.
Be it resolved by the City Council of the City of Corpus Christi, Texas:
Section 1. The City Council specifically finds that the foregoing statements included in
the preamble of this resolution are true and correct and adopts such findings for all intents
and purposes related to the authorization of this procurement.
Section 2. The City Manager, or designee, is authorized to execute a supply agreement
for Chemkeys and Reagents for O.N. Stevens Water Treatment Plant from Hach Company
of Loveland, Colorado, based on a sole source for a total amount not to exceed
$825,780.23.

for the current fiscal year's portion of the contract, agreement, obligation or expenditure described
below is in the Treasury to the credit of the Fund specified below, from which it is to be drawn, and has
not been appropriated for any other purpose. Future payments are subject to annual appropriation
by the City Council.
