Block 2. Lot 3 (Final —O.13Acres) Located south of Interstate Highway 37 and east of Suntide Road. After Staff's prementadon, the floor was opened for comments and discussion by commissioners. There being none, the public hearing was opened with no one coming forward and the public hearing was closed. Vice Chairman Hamilton called for a motion. Motion to approve New Plats Case Nos. OO1308O-NPO3O.0O13OG7-PO4O.O713O78-0PU45.O7240O5-P030.0D13097-NPO5Oand 0813101'NP001 was made by Commissioner Braselton and seconded by Commissioner Lippincott. Motion passed with Chairman Ramirez absent. B. ZONING New Zoning Annika Gunning, Development Services, addressed the commission. Ms. Gunning read New Zoning Case No. 0813-03 into record as shown below. Ms. Gunning stated the purpose of the requested change of zoning was to allow construction of a 100-unit apartment complex for student housing. Ms. Gunning continued the subject property is located in the Southeast Area Development Plan and is planned for low and medium density residential uses and the proposed rezoning is partially consisted with the adopted Future Lane Use Plan. Ms. Gunning stated the property has been vacant since it was platted in 1946. Case No. 0813-03 — Hammond Jones Real Estate Development, LLC: A rezoning from the "RS-6" Single-Family 6 District to the "RM-1" Multifamily 1 District, resulting in a iartial chanQe to the Future Land Use Plan. The property to be rezoned is described as the south 24 feet of Lot 1, all of Lots 2-10, the north 33 feet of Lot 19. and all of Lots 20-24, Block 2, Wood lawn Esbyb*e, located on the south side of McArdle Road between Wood lawn and Daly Drives. Ms. Gunning presented several aerial views of the property and the site plan. Ms. Gunning continued that the applicant is requesting the rezoning to develop an apartment complex consisting of three three-story buildings resulting in a medium density residential use. The subject property contains approximately fourteen (14) undeveloped single-family lots. Ms. Gunning stated thirty-five (35) notices were mailed to property owners within the 200 foot notification area and four were mailed outside the notification area. Ms. Gunning continued that 10 percent of the owners were opposition to the proposed rezoning and Staff recommended approval. Planning Commission Regular Meeting August 28, 2013 Page 3 IV. PUBLIC HEARING AGENDA ITEMS — POSSIBLE DISCUSSION AND ACTION B. ZONING New Zoning — Case No. 0813-03 (cont.) After Staff's presentation, the floor was opened for discussion and comments by commissioners. After discussion and comment concluded by commissioners, the public hearing was opened. Theresa Kinney, 1309 Woodlawn Drive, stated she was speaking on behalf of the property owners that own the three houses facing the vacant lot across the street. Ms. Kinney continued they have been in the neighborhood for approximately 30 years and have watched their grandchildren play in the neighborhood. Ms. Kinney continued in addition to the increased traffic associated with construction of the proposed apartment complex along with the school traffic, the danger increases for children crossing the street going and coming from school. 8onniaAoutia. 1405 Wood lawn Drive, voiced concern regarding the parking problems created with the Auto Nation Car Dealership and the delivery of vehicles on the 18-wheeler trucks onto Daly Drive. Ms. Acuna stated there would be even more traffic combined with the students living in the apartment complex along with their guests. Danny Brionaa, 1408 Wood lawn Orivm, stated construction of the apartment complex will be a huge impact on the neighborhood if the proposed rezoning was approved and the apartment complex would not be a positive move for the neighborhood. Frank Couk, 1401 Wood lawn Oriva, stated having an apartment complex constructed on the property would drastically change the impact of the neighborhood and having the complex across from schools will increase even more traffic into an area that is already congested. Steven Yuyknevin, 1346 Wood lawn Ohve, voiced concern regarding the increase in crime, noise and traffic. Lily Cook, 1401 Wood lawn Orive, stated they moved to the neighborhood approximately eight yeara ago because they fell in love with the area because of the quiet and family-oriented feeling. Mac Jones, 456 Cape Creek, Austin, Texas, stated he was the developer of the property and he has been in business for 35 years. Mr. Jones continued the proposal is to construct an up-scale project at a total cost of $14 million. Mr. Jones stated the complex will have a lot of amenities that will enhance the neighborhood instead of having a negative impact on the neighborhood. Mr. Jones stated the residents of the complex will have parking available inside the complex and there will be no parking in the surrounding neighborhoods. Mr. Jones stated they were willing to be good neighbors. After Mr. Jones concluded his comments, the public hearing was closed. Commissioner Adame asked about the school district's response to the proposed location of the apartment complex being so close to the school and Ms. Gunning stated that a public notice was sent to the administration and to the principals of both school, but no response was received. After all comments and discussion concluded, Vice Chairman Hamilton called for a motion. A motion to approve the rezoning from the "RS-6" Single-Family 6 District to the "RM-1" Multifamily 1 District was made by Commissioner Lippincott and seconded by Commissioner Villarreal. PUBLIC HEARING AGENDA ITEMS — DISCUSSION AND POSSIBLE ACTION ZONING Mr. So|doMa stated the next two zoning cases were PUDs and they are to be voted on separately. Planned Unit Development Ms. Gunning read PUD Case no. 0813-04 into record as shown below. Ms. Gunning stated the purpose of the requested change of zoning was to allow construction of a 23-unit townhouse development that deviates from the typical development standards for townhouses. Ms. Gunning continued that the subject property is located in the Mustang-Padre Island Area Development Plan and is planned for tourist uses. The requested rezoning is consistent with the adopted Future Land Use Plan. Case 0813-04 — Doug Shaw: A rezoning from the^RM-AT/I0" Multifamily AT District with an Island Overlay and the "RS-6/0r Single-Family 6 District with an Island to the ^RKn-AT710/PUD^ Multifamily AT District with an Island Ovedoy, not resulting in a chanqe to the Future Land Use Plan. The property to be rezoned is described as Lots 5 and 14-18, Block 2, Section E. Padre Island-Corpus Christi, located between Aruba and Leeward Dhvae, approximately 200 feet south of Running Light Drive. Ms. Gunning presented several aerial views of the property. Ms. Gunning continued two hundred fifteen (215) public notices were mailed to owners within the notification area, three (3) to owners outside the notification area and no notices were returned. Ms. Gunning stated Staff recommends approval of the change of zoning subject to ten (10) conditions that were read into record. After Staffs pnsoontation, the floor was opened for discussion and comments by commissioners. There being nonm, the public hearing was opened with no one coming forward and the public hearing was closed. Vice Chairman Hamilton called for a motion. A motion to approve a rezoning from the ^RKn-AJ707 Multifamily AJ' District with an Island Overlay and the ^RS-O/[T Single-Family 6 District with an Island Overlay to the ^RK8-AJ70VPUD^ Multifamily AT District with an Island Overlay and a Planned Unit Development Overlay subject to ten (10) conditions as outlined by Staff, was made by Commissioner Castillo and seconded by Commissioner Adame. After Staffs presentation, the floor was opened for comments and discussion by commissioners. There being nono, the public hearing was opened with no one coming forward and the public hearing was closed. Vice Chairman Hamilton called for a motion. After Staffs presentation, the floor was opened for comments and discussion by commissioners. Motion to approve Plat Case No. 0813091- P033 was made by Commissioner Lippincott and seconded by Commissioner Rock. Motion passed with Chairman Ramirez absent. V.
