Chairman Cabasos called the meeting to order and asked if everyone had reviewed the minutes
for the April 26,2006 meeting and asked for a motion to approve. On a motion by Mr. Jacobs, seconded
by Mr. Cooper,the minutes were unanimously approved.
Consideration on a request from Southwestern Energy Company to perform a 3-I)seismic survey
in the Mustang Island and Corpus Christi Bay areas per Chapter 35 Oil and Gas Wells Section 35-88
began. Mr. Rhodes, with Southwestern Energy Company, provided a map outlining the survey and
depicting the source and receiver locations. He stated they would be using air guns in the bay and Gulf
areas, vibrators on the island and shotholes when the other methods could not be utilized. Mr. Cantu
asked for confirmation that they would only be utilizing the land between Hwy 361 and the Gulf around
the condominiums to lay cables and they confirmed. Mr. Rhodes said about half of the property owners
have been permitted and they are continuing to work on contacting the remaining owners. Mr. Cantu
asked what other agencies were they needing a permit from to conduct this survey and they responded
with GLO,TCEQ,TXDOT,City of Port Aransas,Corp of Engineers. Mr. Jacobs mentioned his concern
of the water wells in the area and they said they are asking the owners if there are any and they will take
them into account when conducting the survey. Mr. Cooper asked when they are planning to start the
survey and they answered in late August with the majority of the survey to be conducted in late
September. Mr. Cantu provided a list of restrictions that had been requested on prior seismic permits for
review by the Oil and Gas Advisory Committee and copies of certificate of insurance were also provided
from Southwestern Energy Company and Global Geophysical Services, Inc. The itemized restrictions
consisted of 1. Oil and Gas Well Division must be notified of commencement and specific location of
seismic operations at 361/826-3961 or 361/533-0258(Jesse Cantu for the Superintendent); 2. Jesse Cantu
the Pipeline Safety Engineer for the Petroleum Superintendent must be notified prior to any operations on
city property at 361/533-0258; 3. Permittee must maintain a valid certificate of public liability insurance
at Oil and Gas Well Division Office during operation. A two million ($2,000,000) comprehensive
general liability insurance certificate naming the City of Corpus Christi as additional insured must be
maintained with the city Oil and Gas Well Division; 4. Maximum duration of a permit is six(6) months
but it does not need to be consecutive months. Any operations after the initial three months must be
approved thin an amended permit applied for during the first three months; 5. Notice of seismic survey
shall be published every Sunday in a newspaper of general circulation for the cities of Corpus Christi,
Port Aransas and Portland prior to and during operations. In lieu of publishing frequent notices, a one
time notice of seismic survey with a minimum size of 5" X 8" shall be published in the official city
newspaper and the Flour Bluff Sun prior to the commencement of shooting;6.No shothole discharges on
weekends and holidays;7. Shooting is permitted during daylight hours only; 8.Working hours shall begin
no earlier than 7:00 am and end at 5:00 p.m.; 9.Nothing granted by this permit authorizes operations on
city streets, city street right-of-ways, and on city property except as granted by the Traffic Engineering

Department and the Oil and Gas Well Division or the specific city department; 10. Permit does not grant
use of City Marina facilities; 11. Any city property or land damaged as a result of the geophysical
operations must be promptly restored to the condition that existed prior to the operation or restitution
made; 12. Notice of seismic survey shall be posted at applicable public boat ramps; 13. Any operations
creating a public nuisance to shoreside activities may be required to be suspended or modified; 14. MI
seismic markers in bay must have reflectors or reflective tape; 15. Shotholes must be a minimum of 500
ft. from houses and 300 ft. from pipelines, streets and businesses. Explosive discharges shall not exceed
5.5 lb.maximum dynamite charge per 80-100 ft.depth. There shall be no shotholes within 1,250 feet of a
home or business; 16. In marine areas, shotholes to be a minimum of 500 ft. from pipelines and wells
unless waived by owner; 17. In marine areas, shotholes to be 5.5 lb. maximum dynamite charge per 80-
100 ft. depth below mudline. Mr. Cooper ricked for interpretation of the amounts quoted on the
certificates of insurance and replied he felt they were sufficient. Ms. Hundley stated the wording on
item 4 needed to be con noted to read the term of the pemtit is for three months and if granted an
extension will be an additional three months consecutively. She said the intent of the ordinance is to
allow the Petroleum Superintendent to grant one extension of time for an additional three months if
requested in writing during the first three months for cause. Ms. Hundley stated item 4 would be
corrected administratively and did not need a motion to correct. Mr. Cooper made a motion to amend
item 5 to read "Notice of seismic survey shall be published every Sunday in a newspaper of general
circulation for the cities of Corpus Christi, Port Aransas, Portland and the Flour Bluff Sun prior to the
commencement of shooting and asked that the ads include a phone number to contact for any questions
that may arise"and strike second portion beginning with in lieu of. Ms.Arnold seconded the motion and
the amended item 5 was unanimously approved. Mr. Cooper made a motion to delete item 7 and amend
item 8 to read "Working hours shall begin no earlier than 7:00 a.m. and end at 6:00 p.m." Mr. Jacobs
seconded the motion and the amended item 8 and deletion of item 7 was unanimously approved. Mr.
Cooper made a motion to delete "There shall be no shotholes within 1,250 feet of a home or business"
from item 15. Mr. Jacobs seconded the motion and the amended item 15 was unanimously approved.
Ms. Arnold made a motion to recommend the Petroleum Superintendent grant the seismic permit to
Southwestern Energy Company based on the compliance of the required restrictions including the
amendments. Mr.Cooper seconded the motion and all were in favor.
Mr.Cabasos asked about the Texas Public Information Act film that needed to be watched by the
Committee and was told staff was waiting for the vacancies to be filled. He asked the members to
continue to work on promoting others to apply for appointment to the Committee. There being no other
business,the meeting adjourned at 11:00 a.m.
