On a motion by Mr. Jacobs, seconded by Mr. Ruiter,the minutes were unanimously approved. Mr.Woodcock asked if there was any other old business to discuss and there being none he asked the Petroleum Superintendent for his report. Mr. Heidecker discussed the application to conduct a seismic survey from PGS Onshore that would encompass Nueces Bay, the port area and a portion of Corpus Christi Bay. He stated that PGS Onshore have agreed to submit a letter to the City holding them harmless of any damages. Mr. Ruiter asked what the survey would entail. PGS Onshore representatives discussed the permitting, the identification of hazards, and the actual seismic survey procedures. Mr. Rosas said the actual survey should take 45 to 50 days and they would not have a problem with the three (3) month permit with the option to extend the permit for three (3) additional months if needed. The provided list of restrictions were agreed upon except that the working hours were amended to reflect work to begin no earlier than 7:00 a.m. and end at 7:00 p.m. and shothole discharges will be allowed on weekends and holidays in undeveloped areas. Mr. Woodcock asked about boaters in the area and the PGS Onshore representatives stated that reflectors and reflective tape will be used during the survey besides flyers being posted at boat ramps and notices will be published in the newspaper. The survey will consist of Pentolite as the energy source for shotholes in Nueces Bay, airguns in Corpus Christi Bay portion only, and possibly urban vibrator may be used on land. Mr. Cahasos asked about their previous survey and Mr. Heidecker stated it took place in the Calallen area and extended to Flour Bluff with no reported problems. Mr. Woodcock asked if there were any other questions and entertained a motion. Mr. Jacobs motioned that a seismic survey permit be granted with the provided restrictions: Marine Seismic Survey Restrictions -Permit does not grant use of City Marina facilities; All seismic markers in bay must have reflectors or reflective tape; Oil and Gas Well Division must be notified of commencement and specific location of seismic operations; Permittee must maintain valid certificate of public liability insurance in Oil and Gas Well Division Office during operation; Maximum duration of permit is six (6) months but it does not need to be consecutive months. Any operations after the initial three months must be approved thru an amended permit applied for during the first three months; Any operations creating a public nuisance to shoreside activities may be required to be suspended or modified; Shothole, 5.5 lb. maximum dynamite charge per 80-100 ft. of depth below mudline; Notice of seismic survey shall be published every Sunday in the official city newspaper for the city of Corpus Christi and the city of Portland prior to and during operations;Notice of seismic survey shall be posted at applicable public boat ramps; Shotholes to be a minimum of 500 ft. from pipelines and wells unless waived by owner; Working hours shall begin no earlier than 7:00 am, and end at 7:00 p.m. Land Seismic Survey Restrictions — Nothing granted by this permit authorizes operations on city streets, city street right-of-ways, and on city property except as granted by the Traffic Engineering Department and the Oil and Gas Well Division or the specific city department; The Petroleum Superintendent must be notified prior to any operations on city property at cell phone number 361/438-7792; My city property or land damaged as a result of the geophysical operations must be promptly restored to the condition that existed prior to the operation or restitution made; Shotholes must be a minimum of 500 feet from houses and 300 feet from pipelines, SCANNED Oil and Gas Advisory Comniga Minutes October 13, 2004 Page 2. streets and businesses; Explosive discharges shall not exceed 5.5 lb. maximum dynamite charge per 80- 100 ft. depth; Shooting is permitted during daylight hours only; A two million dollar($2,000,000)public liability insurance policy certificate naming the City of Corpus Christi as additional insured must be posted with the city;No shothole discharges on weekends and holidays except in undeveloped areas. Mr. Ruiter seconded the motion. All were in favor and the motion passed unanimously. There being no other business,the meeting adjourned at 11:10 a.m.
