The meeting was called to ceder by Chairman Garza at 5:36 p.m.and a quorum was declared.
IL APPROVAL OF MINUTES
A. May 25,2011
Motion to approve the May 25, 2011 regular Planning Commission minutes was made by
Commissioner Tamez and seconded by Commissioner Taylor. Motion passed unanimously with
Commissioner Martinez,Commissioner Kelly and Commissioner Adame absent.

The public hearing was opened.
Donald Zimmerman,Community Plans and Liaison Officer for Naval Air Station-Corpus Christi,
came forward and stated the plat was within an Accident Potential Zone 1 but not noise contour,and as
such, may he subjected to noise and or risk from low flying aircraft. The project is viewed as
compatible development. Mr. Zimmerman recommended a note be placed on die plat to restrict
incompatible land use,to encourage the use noise abatement in future construction and to direct lighting
downward without reflective surfaces.
The public hearing was closed.

The public hearing was opened.
Donald Zimmerman,Community Plans and Liaison Officer for Naval Au Station-Corpus Christi,
came forward and stated the plat was not located within an AICUZ defined boundary and was not
within a noise contour. Mr. Zimmerman continued the plat was in close proximity to aircraft transit,
arrival,departure and operational routes,and as such,may be subjected to noise and or from low flying
aircraft. Mr. Zimmerman recommended a note be placed on the plat stating that developers should be
encouraged to utilize noise abatement in the construction of dwellings within these plats, lighting be
unidirectional downward without reflective surfaces below the lighting and voluntary disclosure to
buyers of Navy Flight Operations and the potential aircraft noise.
The public hearing was closed.
Motion to approve New Plats item"c" was made by Commissioner Nadkarni and seconded by
Commissioner Taylor. Motion passed unanimously with Commissioner Kelly and Commissioner
Adame absent.
Commissioner Skrobarczyk asked if the recommendation given by the public should be placed
directly on the plat and Johnny Perales,Development Services,responded that staff needed to conduct
research on the language within the new Unified Development Code.
B. ZONING
1. New Zonkmg
Mr.Dimas presented New Zoning item"a"and staff recommended approval.
a. Case No.061141 Pad of Carpus Christ: A change of zoning
from the "R-1B" One-family Dwelling District to the "1-3"
Heavy Industrial District
The property to be rezoned is approximately two (2) tracts,
totaling approximately 144.93 acres, of submerged land owned
by the Port of Corpus Christi Authority,abutting to south end of
the former Ingleside Naval Base and along the Corpus Christi
Ship Channel.
Commissioner Skrobarczyk asked if the change of zoning would have a negative impact on
recreational uses and Mr. Dimas responded the owner may have limited public access. A brief
discussion was held on the public accessibility of the subject area.

Vice-Chairman Huerta inquired about the City's jurisdiction over the Port of Corpus Christi
• Authority issues and Mr. Dimas stated the subject area was within the City limits and the City could
enforce codes and building permits.
Commissioner Tamez asked about the recently annexed property being zoned"R-IB"One-family
Dwelling District and Mr. Dimas answered the 'R-IB" One-family Dwelling District and the "FR"
Farm Rural District were the most common districts when incorporating new land.
The public hearing was opened.
Tim Clower, representative,came forward and stated the property was being leased by the Port of
Corpus Christi Authority through the General Land Office. Mr. Clower continued that the prior
industrial use of the subject area would not change, patrol boats will be present when the ships were
transferring material and the piers were no longer owned by the Port of Corpus Christi Authority.
The public hearing was closed.
Motion to approve New Zoning item "a" was made by Vitt-Chairman Huerta and seconded by
Commissioner Skrobarczyk. Motion passed unanimously with Commissioner Kelly and Commissioner

IV. PRESENTATION AND POTENTIAL ACTION ITEM
A. EROSION RESPONSE PLAN
Robert Payne,Development Services,presented material for the Erosion Response Plan.
Commissioner Skrobarczyk asked how Nueces County had jurisdiction over Corpus Christi but
not Port Aransas and Mr. Payne answered that the decision was made before 1986 and further research
needed to be done on the jurisdiction issue.
Commissioner Tamez inquired about the height of the structures shown in the presentation and
Mr. Payne answered the structures are approximately fourteen (14) feet and structures within eroding
areas and flood zones am required to be on pilings. Mr. Payne stated the vegetation line is slowly
moving west.
Commissioner Skrobarczyk recommended that the fifty-one percent rule not be applied to
properties with certain criteria and Mr.Payne responded that the rebuilding issue was the most difficult
part of the language to understand.
Vice-Chairman Huerta cited as an example of structures located around Galveston,Texas.
The public hearing was opened.
Carl Badalich, PO Box 18150, Corpus Christi,TX 78480, came forward and stated the City was
causing a problem by digging the beaches down and moving the vegetation line. Mr. Badalich
expressed concern on the City's techniques to clean the beaches. Mr. Badalich recommended staff
change the language of Section 15.17.0 of the local government Erosion Response Plan and that staff
conduct a study on rebuilding sand dunes.

Motion to recommend the draft Erosion Response Plan be forwarded to the General Land Office
as presented by staff was made by Commissioner Skrobarczyk and seconded by Commissioner
Martinez.
V. DISCUSSION AND POTENTIAL ACTION ITEM
A. REZONING OF TRACTS OF LAND LOCATED ON DORTHY DRIVE
Miguel Saldana, Development Services, presented material for the potential zoning case. Staff
expressed concern with the commercial traffic onto the residential street.
Vice-Chairman Huerta asked about the property owners and Mr. Saldafia responded the
properties were owned by different people and the property owners were looking to sell the property. A
brief discussion was held on expansion of the commercial properties.
Commissioner Martinez commented that the Planning Commission and staff would look
favorably on the rezoning if the access was restricted onto Dorthy Drive. Mr. Saldana stated staff was
not in favor of rezoning at this time.
Commissioner Taylor commented on the screening and service uses of streets that have
commercial and residential was adjacent from one another.
Commissioner Slcrobarczyk expanded on Commissioner Taylor's comment by stating Dorthy
Drive would be used as a service route for occasional delivery trucks. Mr. Dimas commented on the
application of buffer yards as proposed by the new Unified Development Code. Mr. Saldafa added that
shopping centers mentioned earlier have collector streets behind the property which makes the
commercial traffic acceptable.
Commissioner Tamez agreed with Commissioner Skrobarczyk and commented that the applicant
has the right to request a specific zoning that staff would review and present to the Planning
Commission.
Commissioner Skrobarczyk inquired about the proposed zoning for the two properties and Mr.
Saldafia responded that a Special Permit would be used to restrict access onto Dorthy Drive.
Vice-Chairman Huerta asked for clarification on the Planning Commission action and Mr.
Saldafia stated the Planning Commission may initiate the rezoning and then approve a Special Permit
with specific conditions.
A brief discussion was held on the future development and restrictions of Special Permits within
the subject area.
Commissioner Tamez commented on utilizing mixed uses that allow pedestrian access.
