Staff recommends approval. f. 0307036-P011 Vista Hermosa Subdivision Phase II(Final— 19.89 Acres) Located west of Kostoryz Road and north of Holly Road. Public hearing was opened. William Pittaway, 5421 Crockett St.,Corpus Christi,Texas stated ownership of five other properties located on Crockett Street. From review of the plat, it shows Crockett Street is one of a number of streets that will be outlets for the subject property and stated opposition to that. Planning Commission MinuteSSI March 21,2007 Page 3 Mr. Pittaway stated the neighborhood had dead end type streets, is quiet and he has lived there for thirty years. With the added traffic from this development, it will be a detriment to the neighborhood. In October of last year, there was another development created where the streets were redone to accommodate inlets and there was no mention about additional subdivisions. It was promised by the City that after the first of the year,there would be another meeting held with the neighborhood to discuss any related problems. If there are outlet streets added similar to the other subdivision, speed bumps may be a suggestion along these streets. Mr. Pittaway stated concern about safety, traffic and his property investment and stated many people were not contacted about their streets possibly being made into outlets. Frank Garcia, representing Landmark Valley Homes, Corpus Christi, Texas stated after purchase of the property, meetings were held with the City-Development Services prior to the platting process. It was the desire of the owner to close off these streets but was advised against it. In working with the City,effort has been made to discourage a lot of through traffic onto those streets. Many of the streets are not through streets and the majority of traffic will be accessed from Santa Olivia Street to come out onto Holly Street. On the west side (Phase 1 of the project) drivers will access Richter to reach Holly Street. Public hearing was closed. Motion for approval of a time extension of six months for plat agenda items "a-h" was made by Commissioner Pusley and seconded by Commissioner Kelly. Motion passed unanimously with Commissioners Skrobarczyk being absent. IV. ZONING 1. New Zoning a. Case No. 0307-07 Kris D. Hawkins: A change of zoning from"R-1B"One-family Dwelling District to an"A-2"Apartment House District Blue Water Subdivision, Block 1, Lot 6A and the north 25 feet of Lot 6B, located between Laguna Shores Road and Marlin Drive and 500 feet south of Yorktown Boulevard. Bob Payne provided a Power Point presentation for the development of a bed and breakfast inn to be used as overflow accommodations for the Bluff Landing Lodge and Marina. The subject property consists of one residential platted lot with surrounding land use consisting of single family development and a "R-2" Multiple Dwelling District located to the north. Conversion of the building to a commercial use will require compliance with the commercial Building Code prior to receiving a Certificate of Occupancy. There were twenty-one notices mailed with one received in favor and three received in opposition. Staff recommends denial of this request due to the mid-block location in a residential area. Public hearing was opened. Neale Van Streepen(Representative for Kris Hawkins), 5716 W,290 West, Austin,TX., stated the property of approximately 1500 square feet will provide sleeping accommodations for 24 lodgers with one kitchen and dining area, a wraparound deck and off street parking. Planning Commission Minute March 21,2007 Page 7 The facility will not be changed structurally,and no catering will be done at the facility, no major functions or parties, and will be rented primarily from Thursday to Sunday to provide accommodations when Bluff Land Marina and Lodge is occupied. This request is an integral part in making the marina successful. Public hearing was closed. In answer to Commissioner Pusley,the offsite parking will consist of four parking spaces underneath the facility with a driveway as well. In answer to Commissioner 1-luerta regarding the possibility of a Special Permit for this request, Faryce Goode Macon stated Staff had reviewed that option but chose not to recommend it because of the short distance the house is located from the marina. Vice-Chairman Garza stated concern with granting zoning in a mid block location. It appears the marina will be successful and Bluff Landing has been good neighbors. Motion was made by Commissioner Pusley and seconded by Vice-Chairman Garza for a Special Permit subject to a site plan and the following three conditions: 1. A Bed and Breakfast Inn is permitted. 2. No major functions or parties larger than fifteen people. 3. Special Permit stipulating that the bed and breakfast inn is fully functional within a period of two years. Motion passed unanimously with Commissioner Tamez voting no and Commissioner Skrobarczyk being absent. b. Case No. 0307-08 Paisano Contractors LLC: A change of zoning from"R-IB"One-family Dwelling District to a"B-1"Neighborhood Business District Barcelona Estates Unit 3,Block 9,Lot 1, located along the southwest intersection of Kostoryz Road and Masterson Drive. Bob Payne presented the above case for a development of four commercial speculative tracts. The subject platted property consists of 3.83 acres, and is currently vacant. The Richter Drainage Ditch to the south is zoned an "A-I" Apartment House District, vacant property zoned "B-1" Neighborhood Business District is located to the east and low density residential property to the west. There were five notices mailed with zero returned in favor or opposition. Staff recommends approval of the"B-1"Neighborhood Business District. Public hearing was opened. No one was present in favor or opposition. Public hearing was closed. 1.1110 11.10 Planning Commission Minut March 21,2007 Page 8 In answer to Commissioner Pusley, Faryce Goode-Macon stated the setback for a `B-1" Neighborhood District requires a 10 foot setback adjacent to the neighborhood. The setback could be five feet per story up to a maximum setback of thirty feet if the applicant constructed a multi story building. Motion was made by Commissioner Pusley and seconded by Vice-Chairman Garza for a "B-I" Neighborhood Business District. Motion passed unanimously with Commissioner Skrobarczyk being absent. c. Case No.0307-09 Southside Ventures, L.P.: A change of zoning from"A-1"Apartment House District and"B-I"Neighborhood Business District to a "R-IC"One-family Dwelling District Foxwood Estates Phase II, Block 2, Lot 4, located on Grand Junction Drive,300 feet west of Everhart Road. Dan McGinn presented the above mentioned case for a proposed development of single family dwellings on 4,500 square foot lots. The subject property is 9.70 acres and is currently vacant with surrounding land uses of primarily vacant land with a multi family development to the south. This request is part of a larger zoning change that was approved in December, 2005 that was approximately twenty-seven acres in size. The zoning changed from a "R-1B" Single family Dwelling District to an "A-1" Apartment House District which requires a 6,000 square square foot lot for single family development. Staff recommends the change in zoning to the "R-1C"One-family Dwelling District. Public hearing was opened. No one was present in favor or opposition. Public hearing was closed. Motion was made by Commissioner Pusley and seconded by Commissioner Kelly for a "R-1C" One-family Dwelling District. Motion passed unanimously with Commissioner Skrobarczyk being absent. d. Case No. 0307-10 Leer Properties Inc.: A change of zoning from"R-1B"One-family Dwelling District to a"B-1"Neighborhood Business District 2.297 acres out of Lot 6, Section 13,Flour Bluff and Encinal Farm and Garden Tracts, located 300 feet north of South Padre Island Drive,300 feet south of McArdle Road,and 100 feet east of Prince Drive. Dan McGinn presented the above case requesting a"B-1"Neighborhood Business District for a commercial site with specific uses undetermined. The subject property is comprised of 2.297 acres and is currently vacant with surrounding land uses of low density residential, commercial properties fronting McArdle Street and a mini storage facility to the east. The applicant owns the one acre contiguous tract that fronts on SPID and plans to develop the two properties into one commercial site. Staff recommends approval of a 'B-1" Neighborhood Business District. In answer to Commissioner Pusley regarding changing the zoning to a `B-1A" Neighborhood Business District,Faryce Goode-Macon stated this would require a 50 foot setback for loading areas,which would make development of the property even more difficult. Public hearing was opened. Ricardo Marroquin, 1302 Whitaker Drive, Corpus Christi, Texas stated that he was forced to retire because of disability and health reasons. We have a grocery store, drug store and shopping center and don't want to be forced out of this district. We have been a hard working family and the majority of the neighborhood is retired people. It is a very nice neighborhood that keeps the yards up. The bar down the street has been a tavern there for years, and there is a very nice restaurant and beauty shop in this area. Additional neighborhood commercial is not needed and this is the second time it has come before the Planning Commission. John Peterson, Corpus Christi, Texas stated no notice was received. My biggest concern is that they have no idea what the development will be. My back fence looks into the field everyday and I am expanding to remodel my home. If this is rezoned, it may effect my property's resale value. I think we should be more informed. Beatriz Soliz, 1301 Whitaker, Corpus Christi, Texas stated living in this neighborhood since 1977 with my husband almost ready to retire. We don't want to make any changes and we don't know what the owner's business intentions are. There is already noise coming from the Ford dealership and this is a very quiet neighborhood. The neighborhood consists of only about three streets and the neighbors would like to keep it that way. Roel Rodriguez, 1000 International Airport Drive, Corpus Christi, Texas stated part of the problem is McArdle traffic and often instead of taking McArdle, I take the access road to get out. We have traffic accidents all the time on McArdle and Whitaker and McArdle and Prince. I believe this development will increase traffic to an unbearable level. When I moved here thirty- three years ago, it was single family development. Through the years, the neighborhood has compromised and now there is a large amount of business encroaching into our area. Sandra Masterson, 1309 Whitaker, Corpus Christi, Texas stated they bought their property in 1985 because it was quiet and it was safe to walk to the grocery store and some of the other entities. The entrance to this property is located at Winston, a very small street and I wonder how tracks could maneuver through these streets. Lewis Schooley, 1341 Prince, Corpus Christi, Texas requested the definition of commercial zoning. Mr. Schooley questions the benefit value to this neighborhood and statied opposition to this request. Public hearing was closed. Motion to deny the"B-1"Neighborhood Business District was made by Commissioner Pusley and seconded by Commissioner Huerta. Motion passed unanimously with Commissioner Skrobarczyk being absent. VI. DEFERMENT AGREEMENT: SIDEWALKS ONLY VISTA HERMOSA SUBDIVISION PHASE 1 Juan Perales presented the above mentioned deferment requesting the sidewalk improvements to be deferred along the following streets; Richter Street, Candace Street, San Javier Street, Ryland Street, Santa Olivia Street, Santa Ana Street, Santa Sofia Street and Santa Lucia Street to avoid damage during residential construction and allow the developer to obtain the 75%acceptance and plat recordation. The developer has agreed to provide a letter of credit in the amount of$116,754 which is equal to 110%of the estimated cost of construction. Motion for approval of the deferment was made by Vice-Chairman Garza and seconded by Commissioner Braselton. Motion passed unanimously with Commissioner Skrobarczyk being absent. VII.
