Commissioner Tamez and seconded by Vice-Chairman Garza. Motion passed unanimously with
Commissioner Pusley being absent.
Miguel Saldana read new plat agenda item "b"(shown below) into the record requesting
approval of a variance and plat. The subject property is adjacent to the North Beach area located
between Neal and Haynes Streets. On the east side of the property, there is an existed platted
road that is part of the beach with Neil and Haynes Streets being blocked off. Per the platting
ordinance, when a property is next to an unimproved street, the applicant is required to provide
construction of half the roadway. That road in all probability will never be built except possibly
as a boardwalk. The applicant will pay the park settlement fees, however, the applicant is
requesting a variance to refrain from paying the one-half road construction. Staff recommends
approval of variance and stated that plat approval is not contingent on approval of the variance.
Mr. Saldafia stated the plat is combining several lots into a large tract for a condominium
development. Staff recommends approval of the plat.

Motion for approval for"a, d and e for a time extension of six months, items "b and
c" a time extension for one year and approving item "f" for a time extension of sixty days
was made by Commissioner Huerta and seconded by Commissioner Pusley. Motion passed
unanimously.
IV. PLANNED UNIT DEVELOPMENT
a. Case No. 0107-04
King's Crossing Realty, Ltd.: A change of zoning from a "R-1 C" One-family
Dwelling District and "R-2" Multiple Dwelling District to a "R-2/PUD-2"
Multiple Dwelling District with a Planned Unit Development—2 Overlay
King's Crossing Unit 21,Block 1, Lot 1, located southwest of the intersection of
Cimarron Boulevard and Lens Drive.
Mic Raasch presented the above case requesting a "R-2/PUD-2" Multiple Dwelling
District with a Planned Unit Development-2 Overlay allowing development of one (1) single
family residence and 14 two-family townhouses on one platted lot with a private access drive.
The existing and future land use map calls for low to medium density residential development
for the subject property and surrounding area. A re-plat will be submitted within the next
month for action by the Planning Commission and prior to this case going to City Council.
There were thirty (30) notices mailed out with zero returned in favor and one returned in
opposition. Staff recommends approval subject to a revised site plan and nine conditions as
stated below:
1. Development must be in accordance with the attached site plan.
2. The one single-family residence and 14 two-family townhouses will be provided
access via a private access/private utility easement with a 24-foot wide drive.
3. The building envelopes may vary between 5,306 and 12,612 square feet.
4. The minimum separation distances of the building envelopes will be 10 feet between
buildings and 5 feet to adjacent property lines.
5. Only one access point to Cimarron Boulevard is permitted.
6. The maximum height of buildings must comply with the "R-2" Multiple Dwelling
District.
7. The minimum number of parking spaces must comply with Article 22 of the Zoning
Ordinance.
8. Visitor parking spaces shown on the site plan must be a minimum of nine feet wide
and 18 feet long.
9. The townhouse development must be constructed in accordance with the
requirements of the 2003 International Residential Code.

Chairman Stone stated Case Nos. 0207-01 and 0107-03 (listed below)have been tabled to
the February 21,2007 Planning Commission meeting per a request by the applicants.

Owen Norton: A change of zoning from a'B-4"General Business
District to a`B-4/PUD-2"General Business District with a Planned Unit

all of Lots 15, 16, 17, 18,and 19 of Surfside Addition, located north of
Caribbean Drive and approximately 200 feet east of Laguna Shores

Everhart Road and approximately 300 feet north of McArdle Road.

Robert Payne presented the above case requesting a 'B-1" Neighborhood Business
District on two platted lots for the purpose of developing a skin care clinic/beauty salon and
to make available commercial capabilities for an adjacent lot. The existing land use is low-
density residential and a professional office for the subject property. The future land use map
calls for mostly commercial development. There were thirty (30) notices mailed out with
sixteen (16) notices returned in favor and zero returned in opposition. Staff recommends
approval of the"B-I"Neighborhood Business District as submitted.
Public hearing was opened.
Richard Sema, 5329 Fulwell, Corpus Christi, Texas stated ownership of a ten year
old real estate business located on Lot 12 which at the time of the purchase was zoned an
"AB" Professional Office District. Mr. Sema stated his intention is to continue conducting
real estate business at this location with no commercial aspirations at this time but would like
the rezoning for future potential commercial uses. Mr. Sema thanked the Commission for
their consideration.
Irme R. Gomez, 745 Everhart, Corpus Christi, Texas stated that she would like to
relocate her existing skin care clinic at 745 Everhart to 4814 Everhart(subject property—Lot
13). Ms. Gomez stated that she will be remodeling the house to a clinic and has been
approved for an SBA loan.
Public hearing was closed.
Motion for approval for a `B-1" Neighborhood Business District was made by
Commissioner Pusley and seconded by Commissioner Martinez. Motion passed
unanimously.
c. Case No.0207-03
Rodd Field 19,Ltd.: A change of zoning from an"A-1"Apartment
House District to an"AB"Professional Office District
13.24 acres out of the southwest one-half of Lots 7 and 8, Section 19,
Flour Bluff and Encinal Farm and Garden Tracts, located 400 feet west
of Rodd Field Road and approximately 700 feet south of Holly Road.
Mic Raasch presented the above case requesting an"AB"Professional Office District for
the purpose of developing a hospital and medical offices to be located west of Rodd Field Road
and south of Holly Road. The subject property consists of 13.24 acres with proposed
development to connect to the property which fronts on Rodd Field Road and currently zoned a
"B-4" General Business District. Vehicular access will be exclusively from Rodd Field Road.
No traffic will be accessed through the surrounding residential neighborhoods. Mr.Raasch stated
there were thirty-three(33)notices mailed out with one(I)received in favor and zero(0)returned
in opposition. Staff recommends approval of the"AB"Professional Office District.
In answer to Commissioner Pusley,Mr.Raasch stated the building setback from
residential properties fronting on Savoy Street on to the subject property will be 25 feet.

In answer to Commissioner Tamez, Ms. Goode-Macon stated the lighting requirements
for this development is the same as an"A-1"Apartment House District.
Public hearing was opened.
Julie Hampton, 2206 Savoy Street, Corpus Christi, Texas stated opposition to the above
zoning request along with many of the neighbors having the same opinion. The area is primarily
farmland which makes this request inconsistent to the area. The lighting and noise is a concern
along with property values being lowered and having our backyards connecting to the subject
property.
Commissioner Pusley stated that the "AB" Professional Office District is probably a
better option than the current zoning of"A-1" Apartment House District which only requires
a ten foot setback and may include overhanging balconies. One option may be for the
neighborhood to meet with the applicant and possibly agree to include some deed restrictions
to handle the lighting issues,etc.
Tim Clower, Clower & Company (owners of Rodd Field 19), Corpus Christi, Texas
stated that this property is located on a major arterial, Rodd Field Road. To the south of the
subject property is an "1-2" Light Industrial District with Bay Area Mini Storage located in that
area and to the east is business zoning. Traffic will not be overly active with mixed medical
offices and some surgical units which won't carry a high volume of traffic. The entrance will be
on Rodd Field Road with the"B-4"General Business District zoning located in the front portion.
Regarding the lighting, we will make every effort to keep the lighting directed away from the
adjoining residences to the west.

Motion for approval of the"AB"Professional Office District was made by Commissioner
Braselton and seconded by Commissioner Tamez. Motion passed unanimously.

Motion to approve Chairman Stone's absence from the Planning Commission meeting of
January 24, 2007 was made by Commissioner Pusley and Commissioner Skrobarczyk. Motion
passed unanimously.
C. OTHER MATTERS
Faryce Goode-Macon stated that the CDBG process has changed and Planning
Commission will no longer be reviewing the CDBG applications. It has been determined that per
the federal requirements only one(1)public hearing and technical workshop is needed.
