CALL TO ORDER A quorum was declared present and the meeting was called to order at 5:37 p.m. II. APPROVAL OF MINUTES Motion for approval of Planning Commission minutes of June 14, 2006,was made by Commissioner Martinez and seconded by Commissioner Braselton. Motion passed unanimously with Commissioners Pusley and Zamora being absent. III. PRESENTATION FOR ADOPTION OF THE DRAINAGE CRITERIA TECHNICAL DESIGN Angel Escobar and Valerie Gray presented the Storm Water Drainage Criteria Technical Guide to be submitted for approval with a brief slide show by William Green of Goldston Engineering,Inc. Mr. Escobar stated that the Technical Design Guide has been developed by City Staff,Goldston Engineering,Inc.,Maverick Engineering, Inc.,J. R. Thompson Engineering,Dodson &Associates and the Technical Advisory Group to examine and improve upon the levels of protection,outfall drainage,and elevation criteria within the City. Mr. Escobar stated that the objective is to present this guide approved and allow the City to proceed on schedule with an adopted master plan by year end. Public hearing was opened. Murf Hudson,Urban Engineering,2725 Swantner,Corpus Christi,Texas stated that the document does change the standards from previous master plans and will effect the ability for current development to be economically feasible. SCANNED Planning Comn Minutes June 28,2006 Page 2 There are technical issues and clarifications that still need to be answered and further discussion should be held prior to approval. The entire master plan and criteria plan should be adopted at the same time. In answer to Mr. Hudson's question,Mr. Escobar stated that by approval of the technical guide, it allows the City to proceed further with the design of the master plan sheets and design manual. It will also allow the City to foresee problems with the guide prior to approval of the fully adopted master plan. Information has been sent out to the TAG Team and the Peer Review Team for comments to insure that the City is not being too stringent. In answer to Commissioner Skrobarczyk's question,Mr. Escobar stated the goal is to have this guide approved and utilized immediately by developers and engineers. If the choice is to have the guide approved but not utilized until year end,the approval of the guide would still allow the City to proceed. This guide will be the basis for the future documentation. Commissioner Salazar stated his belief that the costs need to be addressed and determine what specific benefits will be seen. In answer to Commissioner Pusley's question,Mr.Escobar stated that upon adoption of the criteria plan,the current City projects would be implemented immediately through the CIP program. The timeline would be as follows: July 11 —City Council presentation and approval July 18—2nd Reading of Technical Guide(Revisions to be made) August—More technical meetings reviewing map sheets September/October—Revisions to Hydraulic Model and Storm Water Master Plan Sheets November—Distribution of Deliverables and notice to newspaper December 13—Planning Commission approval December 19—City Council 1"reading Chuck Urban,Urban Engineering,2725 Swantner,Corpus Christi,Texas stated the changes to the 25/100 storm are needed but the main question is the cost. Just for the small areas,the cost will be substantial. Mr.Urban stated that the full master plan needs to be seen before adoption and the percentages evaluated. Mr.Urban volunteered to perform a cost analysis on an existing project i.e., Rancho Vista Subdivision to ascertain if the percentages set out are accurate by the next Planning Commission Meeting. David Miller, 1906 Tolusa Rd.,Corpus Christi,Texas stated his residence was purchased twenty-two years ago and drainage problems have been experienced ever since. Flood insurance was not purchased at that time. The last two years the water has flooded into the area. The top soil has washed away and grass in the back yard does not exist. The water drains from the adjacent homes as the elevation in the newer homes are higher. The entire Douglas Subdivision experiences problems with the drainage and something needs to be done. Dan Leindecker,LNV Engineering, 901 Navigation,Corpus Christi,Texas stated the debate is between minimum standards and the cost factor. The minimum standards need to be determined and once that is accomplished,the cost factor needs to be decided upon to determine who pays for what. Public hearing was closed. Motion passed with a vote of five(5)to three(3)with Commissioner Zamora being absent. IV. PLATS Miguel Saldana read continued plat agenda item"a"(shown below)into the record and stated that the applicant has requested a continuance to the Planning Commission meeting of July 12,2006. Staff recommends approval. a. 0206039-NP022 Waldron Road Subdivision(Preliminary— 15.8985 Acres) Located south of Graham Road and east of Waldron Road. Motion for approval to recommend continuance of plat agenda item"a"to the July 12,2006 public hearing was made by Commissioner Braselton and seconded by Commissioner Skrobarczyk. Motion passed unanimously with Commissioner Zamora being absent. Miguel Saldana read continued plat agenda item"b" (shown below)into the record and stated the item had been submitted requesting approval for a variance request and plat action. b. 0606107-P046 Caribbean Subdivision(Final Replat-4.86 Acres) Located north of Haven Drive and east of Violet Road. i. Variance Request ii. Plat Action Mr. Saldafia stated the variance request involves exceeding the maximum cul-de-sac length of 750 feet. The road has two(2)bulbs which will provide emergency vehicles sufficient space to turn around when necessary. Staff recommends approval of the variance due to an extraordinary hardship to the property and stated the property is platted. Public hearing was opened. No one was present in favor or opposition. Public hearing was closed. Motion for approval of variance was made by Commissioner Huerta and seconded by Commissioner Braselton. Motion passed unanimously with Commissioner Zamora being absent. Planning Cumuli.",Minutes11.10 June 28,2006 Page 4 c. 0606116-NP060 Southlake Subdivision(Preliminary— 146.48 Acres) Located east of Rodd Field Road between Brooke Road(CR 26A)and Slough Road. i. Variance Request ii. Plat Action The first part of the variance request involves exceeding the maximum cul-de-sac length of 750 feet. Mr. Saldana stated this is a private gated subdivision and the applicant has provided access gates to the south,east and north of the cul-de-sac for emergency vehicles. The Fire Department has stated there is no objection to using these gates for entry. To the north of the main entrance of the cul-de-sac which borders Master Channel 27, emergency access will not be able to be obtained. Staff has no objection to the approval of the variance exceeding the cul-de-sac length. The second part of the variance addresses installation of sidewalks within the subdivision. Mr. Saldaha stated the platting ordinance section under"design standard"requires private streets to have sidewalks located on both sides of the subdivision. The applicant has requested sidewalks not to be provided and has stated that a compromise may be worked out with Staff as to where sidewalks would be installed. Staff is not in support of this request and does not see an extraordinary hardship in this instance. The third part of the variance involves a number of corner lots. These lots include(2) front yards, with a twenty-five(25)foot front yard setback and a side yard setback which fronts on another street but backs up to another lot. The applicant is proposing a fifteen(15) foot side yard requirement in lieu of the twenty-five(25) foot required setback. This twenty-five(25) foot requirement is part of the zoning ordinance and Staff does not find an extraordinary hardship to substantiate approval of their request. Public hearing was opened. Chuck Urban,2725 Swantner,Corpus Christi,Texas stated the subdivision will not consist of "public"traffic and the installation of sidewalks is opposed. Mr.Urban stated a willingness to place sidewalks in some areas of the subdivision but not necessarily on both sides of the street. The developer is attempting to develop something different with this project and would hope for consideration on the corner lots regarding the setbacks. The homeowners will have the full responsibility of maintaining the streets. In answer to Commissioner Pusley's question,Mr.Urban stated the streets are not dedicated. Regarding the setbacks,Mr. Urban stated a note would be placed on the plat restricting the driveways to be placed onto the street with the 25-foot setback. Mary Frances Teniente stated in respect to setbacks and frontages,the platting ordinance states that all private street access easements are to be treated as public street right-of-ways in determining building setbacks and frontages. Alton Scavo (developer and owner of project),Corpus Christi,Texas stated when the property was purchased,there were meetings held with Staff regarding a"PUD"which would involve approximately ten(10) corner lots with a more conventional layout. It was decided that a"PUD"would not be an option. The development plan is to build a more upscale development utilizing the lake on the property. Planning Comr`n Minutes June 28,2006 Page 5 In the current layout,there are sixteen(16)cul-de-sacs with a minimum amount of residences on each side of the street. With the deletion of the sidewalks,the owner is often more receptive to this type of property as it gives a more rural,larger look to the property. There has also been seven(7)acres dedicated by the owner to the City for Master Channel 27 which would deny the development access to Brooke Road. Public hearing was closed. Motion for approval of variance was made by Commissioner Braselton and seconded by Commissioner Salazar. Motion passed unanimously with Commissioner Zamora being absent. IV. ZONING 1. New Zoning a. Case No. 0606-05 and Plat 0606123-P058 Cross Roads Builders: From a"F-R"Farm-Rural District to a "R-2"/"PUD-2"Multiple Dwelling District/Planned Unit Development-2 Sunshine Acres,a Portion of Block 11,Lot 13,located on the north side of Wooldridge Road and approximately 1,200 feet west of Rodd Field Road Robert Payne presented the above subject property(a new application from the request submitted in April,2006)requesting a change in zoning to a"R-2"/"PUD-2"Multiple Dwelling District/Planned Unit Development—2 for the purpose of development of twenty(20)townhouses comprising of five(5)buildings. The surrounding area consists of low-density residential with the future land use map recommending the same. The townhouses will consist of one (I)and two(2) story units ranging from 1,500 to 1,770 square feet on 2.48 acres. Planning Comr'1100n Minutes June 28,2006 Page 7 The applicant proposes to locate the townhouses next to the existing drainage ditch along the east side of the property with the parking area and private road to the west. There were fifty-two(52)notices mailed out with zero returned in favor and 28%returned in opposition. In view that this is a narrow 150 foot wide remnant of land making single family use an inefficient use of the property, Staff recommends approval subject to a site plan and the following conditions: 1. Height: Buildings shall not exceed two stories. 2. Liphtinp: Outdoor lighting shall be directed away from adjacent single family residential neighborhoods with no more than moon light(two lumens)at the property lines of the property. 3. Time Limit: Construction of the townhouse project shall commence within two(2) years from the approved ordinance date of the"R-2"I"PUD-2"overlay and construction shall be completed within five(5)years from the approved ordinance date of the"R-2" with a"PUD-2"overlay,or the PUD-2 expires. In answer to Commissioner Pusley's question,Mr. Payne stated that the rear portion of the townhomes will back up to the Windsong residential development and the drainage ditch and currently there is no fencing requirement for this project. Public hearing was opened. Joe Garcia(representing Cross Road Builders),4626 Weber Road, Corpus Christi,Texas stated that the proposed townhome development is comprised of a 150 foot wide piece of property, 600 feet in depth with four(4)plexes with five(5)buildings. There will be two story units in the center of the development with single story units on the outside with identical buildings made of stucco and 30-year composite roofing. Fencing will be around the gated complex with a homeowners association in place to take care of all maintenance. There will not be a dumpster location as all trash will have individual private pick up. Infill development for the City has been requested and it is possible on this piece of property. In answer to Commissioner Huerta's question, Mr. Garcia stated there will be a separation of sixty(60)feet from the residential development. In answer to Commissioner Pusley's question,Mr. Garcia stated the neighborhood association will be collecting dues and each unit will be owner occupied. Regarding the fencing,Mr. Garcia stated that it will be a six(6)foot wood fence with stucco columns every twenty(20)feet. Miguel Saldafa stated that the drainage easement is approximately 120 feet in width. Regarding the landscaping, Mr. Garcia stated that the strip outlined on the site plan is intended to be a landscape strip with low shrubs and trees. This will help to screen the separation between the townhomes and the residential area. Miguel Saldafia stated there is a fifteen(15)foot utility easement along the west property line so trees would not be recommended in that area. Mr. Garcia stated the intent is to put the utility easement below the drive areas in the development along with installation of a fire hydrant. The far west side will be dedicated to the landscaping with the east side serving the utility easement. Jon Keith,2422 Windsong,Corpus Christi,Texas stated that the first time notification was received regarding this case in April,there were seventy-five notices in opposition. With this case, there were some neighbors that did not receive notification. Planning Como`n Minutes June 28,2006 Page 8 Mr. Keith stated that his residence was purchased twenty-one(21)years ago and at that time there was a vacant lot at this location and was told that the land would stay vacant and not be developed. Mr.Keith stated his opposition to the construction of this development. This is a very narrow area which includes a large drainage ditch.The whole area is surrounded by single-family residential housing that opposes the construction of this multi-family development. Regarding the landscaping,there is no space to put trees in the area. Barry Dalton, 2429 Windsong, Corpus Christi,Texas stated that this is a tiny piece of land and was built on a one hundred(100)year flood plain. The floor plan is very deceiving as to what it actually is. Mr. Dalton stated he was also told that it would never be developed. Patricia Trujillo,2430 Windsong,Corpus Christi,Texas stated the property was purchased as a retirement home a year ago. Due to the information received that no development would occur on the adjoining property,wall-to-wall windows were installed overlooking my back yard. With the development of these townhouses,there will be no privacy available to me and the resale value of the property would not equal what has been spent on the property. Ms.Trujillo stated that there is a very old bridge located on Wooldridge near the drainage ditch which is not safe and there will be a problem with emergency vehicles accessing this development. Mary Myress,stated her property is located across the ditch on Woodway Drive and stated opposition to two(2) story buildings looking into her property. The residents on Cimarron Drive have been very unhappy with the apartment development that was built next to a residential development in their area which is similar to what is being proposed here. Also,Wooldridge Road is very narrow and won't be fixed until at least 2008. There will also be increased traffic with this development. Public hearing was closed. Commissioner Braselton stated that the development would only improve the property as it is now. Additionally,the price of the townhomes will be pretty substantial and similar to the ones that are very nice which are located on Airline Road. Commissioner Salazar stated that with the size of the property,this is probably the only thing that could be done with the property. Otherwise,the property would just stay vacant,and for the property owner,that would not be an option. With 1600 square feet townhouses, I don't see the de- evaluation. This is something supported by Staff and will be a gated community with certain conditions to be placed upon it. In answer to Commissioner Pusley's question regarding drainage, Mary Frances Teniente stated that the plan improvements do not require an additional drainage easement dedication. There is a need for a small part of parcel acquisition at the corner of the ditch for access and that is being worked out with the developer. Commissioner Pusley stated that Mr.Garcia has submitted a nice plan but also very sympathetic to the neighbors. In answer to Commissioner Huerta's question,Mr. Garcia stated that with the size of the property, no developer would do a single family residential development. A flagged lot design would only accommodate two(2)to three(3)homes. Motion for approval of a'R-2"P'PUD-2"Multiple Dwelling District/Planned Unit Development—2 was made by Commissioner Martinez and seconded by Commissioner Braselton subject to a site plan and the following conditions: Planning Comin Minutes June 28,2006 Page 9 1. Height: Buildings shall not exceed two stories. 2. Liphtinp: Outdoor lighting shall be directed away from adjacent single family residential neighborhoods with no more than moon light(two lumens)at the property lines of the property. 3. Motion passed unanimously with Commissioners Huerta and Pusley voting no and Commissioners Stone and Zamora being absent. Plat No. 0606123-P058 Sunshine Acres,Block 1.Lot 13R(Final Replat—2.50 Acres) Located north of Wooldridge Road and west of Woodway Drive, both west of Rodd Field Road. Miguel Saidana stated that the plat had been submitted for approval and the applicant is working on the easement drainage ditch. Staff recommends approval. Motion for approval of plat was made by Commissioner Martinez and seconded by Commissioner Salazar. Motion passed unanimously with Commissioners Huerta voting no, Commissioner Pusley being out of the mom and Commissioners Stone and Zamora being absent. b. Case No.0606-07 Roy D. Bennett: From a'R-1B/SP"One-family Dwelling District with a Special Permit to a"B-1"Neighborhood Business District Guth Parkside Annex,Lot 4A,Block 1, located along Rand Morgan Road and approximately 410 feet south of Up River Road Shannon Murphy provided a Power Point presentation of the above case and surrounding area which is located along the eastern portion of Rand Morgan Road requesting a"B-P" Neighborhood Business District for the purpose of commercial development. Mrs. Murphy stated that the prospective buyer of this property is interested in starting a business involving transporting disabled adults. The subject property is located in a`R-1B"One-Family Dwelling District and received a Special Permit in 1984 to allow for commercial use to operate a trampoline repair business. The surrounding land use is a mixture of single family residential and general commercial business with the future land use map supporting commercial uses. There were fifty (50)notices mailed out with zero returned in favor and 14.64%received in opposition. Staff recommends denial of a"B-1"Neighborhood Business District and,in lieu thereof,approval of a "B-I A"Neighborhood Business District. Public hearing was opened. Roy Bennett, 11105 Birdwood,Corpus Christi,Texas stated his preference for the request would be a"B-1"on the front portion and a"B-1A"on the back portion of the property. Public hearing was closed. Planning Com4n Minutes June 28,2006 Page 10 Faryce Goode-Macon stated that if the`B-1"and"B-1A"zoning is split within the property, an additional metes and bounds will be required. Motion was made for approval of a"B-1"Neighborhood Business District by Commissioner Skrobarczyk and seconded by Commissioner Salazar. Commissioners Pusley, Braselton and Huerta stated their support of a'B-1"/"B-IA" Neighborhood Business District split on the property. Commissioner Skrobarczyk rescinded the motion for a'B-1"Neighborhood Business District. Motion was made for approval of a"B-I"Neighborhood Business District on the front portion of the property and a"B-1A"on the rear portion of the property per the metes and bounds description by Commissioner Salazar and seconded by Commissioner Skrobarczyk. Motion passed unanimously with Commissioner Pusley voting no and Commissioners Stone and Zamora being absent. c. Case No. 0606-08 Access Properties,Ltd: From a"T-1B"Manufactured Home Park District to a"B-4"General Business District for Tract 1 and "1-2"Light Industrial Use for Tract 2 Tract 1: Being 8.84 acres out of 27.82 acres and Tract 2: Being 9.35 acres out of 27.82 acres,both in Farias Grant out of Luby Tract 6,Abstract 592, located at the intersection of CR 52 and US Hwy 77 Shannon Murphy provided a Power Point presentation of the above case as outlined in the summary report listed below: • The applicant is requesting a change of zoning for 18.19 acres out of a 27.82 acre tract from "T-IB"Manufactured Home Subdivision to"B-4"General Business District for Tract I and"1-2" Light Industrial District for Tract 2. • The subject property is being subdivided out of a 27.82 acre tract of Farias Grant out of Luby Tract 6 Abstract 592 and is currently undeveloped. It is located on US Highway 77 at the intersection with County Road 52. • The applicant proposes a light industrial subdivision with lots at one to two acres for the use of small contractors(such as plumbing and electrical) and auto repair shops. The auto repair shops would be located in the requested "B-4" District and the contractors' shops would be located in the requested "1-2" District. The applicant is requesting "1-2" for the property in the rear for the purpose of allowing outside storage for plumbing and electrical contractors. • The "BA" District provides for all types of commercial and miscellaneous service activities, particularly along certain existing major streets where a general mixture of commercial and service activity now exists. The "1-2" District is intended for light manufacturing, fabricating, warehousing and wholesale distributing in high or low buildings and also permits outside storage that is screened from view from the at-grade public right-of-way. Planning Corms Minutes June 28,2006 Page I I • County Road 52 will be extended into the subject property. Currently the alignment proposed by the applicant differs from the location shown on the Urban Transportation Plan and will need to be recognized on the plat. County Road 52 is a recommended arterial street with an ultimate 100' right-of-way, four travel lanes and a landscaped median. The Urban Transportation Plan states the purpose of a secondary arterial as providing citywide traffic mobility but functions at a lower level and places more emphasis on land access. The primary function of arterials is to provide efficient movement. Traffic generated from this project would have direct access to County Road 52. • Properties immediately adjacent to the north and northwest of the subject property are zoned "B-4"General Business District and"F-R"Farm-Rural District. The properties to the east and northeast are zoned"F-R"Farm-Rural District. The property to the south is zoned"T-1B" Manufactured Home Subdivision. The current zoning to the west is"B-4"General Business District. • The subject property is currently vacant. Staff is reviewing the adopted future land use mobile home designation in the area.Light industrial land use is being considered as an alternative due to proximity to US Highway 77(NAFTA corridor)and the area's isolation from adjacent properties due to a CP&L easement and drainage easement to the north,railroad line to the east, and US Highway 77 to the west. There were nine(9)notices mailed out with zero returned in favor or opposition. Staff recommends approval of this request. In answer to Commissioner Pusley's question,Faryce Goode-Macon stated the Urban Transportation Plan indicates there will be a buffer between the light industrial use and the existing manufactured home park to the south with the extension of County Road 52. FUTURE SCHEDULED MEETINGS Faryce Goode-Macon stated that the Planning Commission meeting of October 18, 2006 will need to be cancelled due to the upcoming APA conference being held in Corpus Christi. Motion for cancellation of the October 18,2006 was made by Commissioner Braselton and seconded by Commissioner Salazar. Motion passed unanimously with Commissioners Stone and Zamora being absent. B.
