II. APPROVAL OF MINUTES
Motion for approval of Planning Commission Minutes of March 22,2006 was made by
Vice-Chairman Garza and seconded by Commissioner Martinez. Motion passed unanimously with
Commissioners Braselton,Huerta and Pusley being absent.

Abel Villarreal, 6902 Sandra Lane,questioned the future improvements to be made for
the sidewalks and drainage on Wooldridge Road.
Miguel Saldafia stated there is a 2004 bond issue approved for Wooldridge Road
specifically the area between South Staples Street and Rodd Field Road and is currently being
designed to include curbs,gutters and drainage. The 2004 Bond information is available on the
City's website under the Engineering Department.

IV. ZONING
1. New Zoning
a. 0406-02
Wind Vane of Aransas,Inc.: From a"B-4"/"SP"General Business
District with Special Permit to an"1-3"Heavy Industrial District
Ebony Acres,Lot 17,located along Leopard Street, 100 feet west of
Lantana Street and 525 feet west of North Padre Island Drive.
Adriana Trujillo presented a powerpoint presentation on the above case showing the
subject property located on Leopard Street and west of Lantana Street and outlining the
surrounding existing land use which consists primarily of industrial and commercial property.
The subject property is being used as a paint and body shop and the applicant is requesting the
"1-3"Heavy Industrial District for the purpose of developing an impound yard on the back
portion of the property. Staff recommends denial of the"1-3"Heavy Industrial District and in
lieu thereof,approval of a revised Special Permit subject to four(4)conditions. There were
fourteen(14)notices mailed out with one(1)received in favor and one(1)received in opposition.
In answer to Commissioner Skrobarczyk,Ms. Trujillo stated that the revised Special
Permit would be only for the one hundred seventy-six (176)feet in the rear portion of the
property similar to the adjacent property to the east which also contains a special permit.
Public hearing was opened.
Jessica Nelson,5713 Leopard Street,Corpus Christi,Texas stated that there is no activity
visible from the street.
Chris McVain,5713 Leopard Street,Corpus Christi, Texas stated that their main
objective is to get on the City rotation for impound yards.
Public hearing was closed.
Motion for approval of a special permit was made by Commissioner Zamora and seconded
by Commissioner Martinez subject to four(4)conditions and limited to one hundred seventy six
(176)feet of the back portion of the subject property. Motion passed unanimously with
Commissioners Braselton,Huerta and Pusley being absent.

Mirabal Development Group: From a"R-1B"One-family Dwelling
District to a'R-2"Multiple Dwelling District
Bass Subdivision,Block 28,Lots A and B,located east of Airline Road
on the north side of Sandra Lane.
Robert Payne presented the above case requesting a"R-2"Multiple Dwelling District.
The subject property is located north of Sandra Lane, a typical country road,and east of Airline
Road. The surrounding area includes a single family residential area and vacant areas. The
request consists of two(2) lots with a single family residence located on one of the lots with 262
feet of frontage and a depth of 636 feet.

To the rear of the subject property is a drainage ditch separating the area in the back
from the residential subdivision directly to the north. The subject property fronts onto Sandra Lane
which has no curb or gutters and only 18-24 feet of pavement. The future land use for this area
calls for single family development. The main issues in this community have been the
infrastructure. The City does not have a concerted plan for this area directed at the infrastructure.
The bond programs primarily go to major streets which would not apply here. There were twenty
(20)notices mailed with one(1)returned in favor and one(1)returned in opposition. Staff is
recommending denial,however Staff would be receptive to a Planning Unit Development-2 which
would include infrastructure improvements through the platting process.

James Mirabal,Mirabel Development, 6614 Belvoir, Corpus Christi,Texas stated that the
development is a low-density, townhouse development with ten(10)units per acre,three stories
of living space with the first floor being the parking garage. Mr. Mirabal stated his willingness to
accept a Special Permit or a PUD(Planned Unit Development)and to turn Sandra Lane around.
The proposed project is of a first class quality and would enhance the neighborhood.
In answer to Commissioner Skrobarczyk's question,Mr. Payne stated that another option
to improve the infrastructure would be a voluntary paving assessment program whereby 51%of
the property owners between Airline and the drainage ditch would first have to agree to be
assessed for street improvement.
Ms.Teniente stated that funding for a voluntary paving program would still be dependent
on the City having funds.
Mr.Mirabal stated there was limited traffic on Sandra Lane at this time.
Mr. Payne stated that approval of a Planned Unit Development would require tabling so
site requirements could be completed and a plat submitted.
In answer to Commissioner Zamora's question,Mr.Mirabal stated a revised site plan
could be developed within thirty(30)days.
Commissioner Zamora stated his preference toward a PUD approval.
In answer to Commissioner Skrobarczyk's question,Mary Frances Teniente stated the
infrastructure would be addressed through the platting process which could be completed and
brought before Planning Commission sometime in May.
Darin Keeler,6909 Windy Creek, Corpus Christi,Texas stated Sandra Lane is short of a
dirt road. Our house was purchased with the knowledge that the property behind us would be a
residential area. Now,there will be a three story project right behind us. All of the neighbors we
spoke to are against this project. We are speaking on behalf of some of the neighbors that were
unable to attend. We did research regarding the surrounding zoning prior to purchasing our
home. An apartment building is not what this neighborhood needs. The future owners of these
new subdivisions will not realize what development is going in around them. In comparison to
Cimarron and Yorktown,this area will have the same problem and it will be a safety concern
along with a problem with drainage.
Michelle Mirabal, 6614 Belvoir,Corpus Christi,Texas stated that the proposed
townhome development would not be apartments.

Mr. Mirabel stated the proposed development will contain homes in the$225,000 price
range. A gated community with a homeowner's association is proposed and will not have the
atmosphere of apartment living. There is a drainage ditch between this property and the other
properties 55 foot setback with an additional 15 foot setback. The top floor will house the master
bedroom with a focal point being in the center of the property. On the second floor,the balconies
will be in the rear located near the kitchen area with the third floor balcony facing the center focal
point of the pool and not the neighborhood across the drainage ditch.
In answer to Commissioner Salazar's question,Mr. Payne stated restrictions could be
made regarding the balconies and the windows on the back side of the building through a PUD
zoning. The case could be tabled for four(4)weeks to allow time for the site plan and plat to be
developed.
Abel Villareal,6902 Sandra Lane, Corpus Christi,Texas stated that he had lived there
for twenty(20)years and own the ten(10)acres located next to the subject property. Mr.
Villarreal stated that he was not against development. Mr.Villarreal stated his concerns and
questions regarding the property such as the difference in density between the"R-2"Multiple
Dwelling District and the"A-I"Apartment House District,the timeline of Block 27,Lot H,how
blueprints could be obtained of what was going to be developed,what kind of fence will be built,
how close will the properties be to the property line and once the project is completed how many
tenants will be residing in full occupancy,There is a large safety issue with the pedestrians and
the speed of the motorists on Sandra Lane. Also, $300,000 for a town home is a high price.
Sandra Lane is a two lane roadway with drainage ditches on each side. When does the City plan
to widen Sandra Lane to accommodate the increase in traffic and install drainage with gutters and
curb. There is currently no plan in place. If there is an additional 200-300 tenants are added,it
will create too much traffic.
Barbara Kilgroy,6805 Sandra Lane,Corpus Christi,Texas stated that her property is
located across from the subject property and was purchased in 1979. At the time of the
development of the Teachers' Credit Union,the City promised that zoning would not change in
this area. When the school bus is dropping the children off,no other car can pass. There is a lot
of traffic on Sandra Lane and a large portion of neighbors that would be upset at this extra traffic.
Sandra Lane is not a two lane street. You can barely pass. This is a safety issue. I am very
opposed to this request.

In answer to Commissioner Skrobarczyk's question,Ms. Teniente stated that without a
bond program,the infrastructure will not move forward. The only option is for the developer to
improve the properties' infrastructure.
Motion was made by Vice-Chairman Garza to table the case to May 31,2006 to allow time for the
necessary documentation to be completed and work out details for the project and seconded by
Commissioner Salazar. Motion passed unanimously with Commissioners Braselton,Huerta and
Pusley being absent.
Commissioners Salazar and Stone encouraged the developer to work with the
surrounding neighbors.

Mirabal Development Group: From a"R-1B"One-family Dwelling
District to an"A-1"Apartment House District
Bass Subdivision,Block 27, Lot H, located east of Airline Road on the
south side of Sandra Lane.
Robert Payne presented the above case requesting an"A-I"Apartment House District for
development of condominiums on one(1)acre with two(2)buildings consisting of ten(10)units
each. The subject property is located on the south side of Sandra Lane with single family
residences on either side of the site. However,most of the property along Sandra Drive is vacant
and if it were developed with multi-family uses,traffic could increase to at least 5,000 trips per
day. There were twelve(12)notices mailed with one(1)returned in favor and two(2)being
returned in opposition. Staff is recommending denial and,approval of a Planning Unit
Development-2 which would include infrastructure improvements through the platting process.
In answer to Commissioner Zamora's question regarding the voluntary paving
assessment program,Mr. Payne stated information could be compiled and be presented on May
31,2006 on the guidelines of the program. Mr. Payne stated that the four(4)year bond programs
provide a portion allotment to the assessment program. However once that money is used,the
area needs to wait another four(4)years for the next bond program or some other funding source.

lames Mirabal,Mirabel Development,6614 Belvoir,Corpus Christi,Texas stated his
desire to table this request to May 31,2006. Mr. Mirabal stated his intention to use this time to
meet with the neighborhood.
In answer to Commissioner Zamora's question regarding being able to provide a sixty(60)
foot right-of-way to meet the neighborhood's needs,Mr. Payne stated the options could be a bond
program or participation from the property owners through the voluntary street assessment program.
Mr. Payne indicated that there is a waiting list but the program could be a way to improve the entire
street.
In answer to Commissioner Skrobarczyk's question,Mary Frances Teniente stated that
within a platting situation,the City would have the authority to request a sixty(60) foot right-of-
way.
Abel Villarreal, 6902 Sandra Lane,Corpus Christi,Texas stated this project abuts up to his
property. Mr. Villarreal stated that along the street there are a large portion of pot holes. Mr.
Villarreal stated he is interested in seeing that the infrastructure is there. The citizens in this area
have paid through bond elections for other streets to be improved and now the City is asking us to
pay our street improvements. This neighborhood pays taxes and has paid a lot of money for our
properties. This development is in the middle of Sandra Lane and the builders need to be held
accountable for the street improvement.
In answer to Commissioner Zamora's question,Mr. Payne stated that the PUD-2 gives the
ability to add any height restrictions that you choose.

George D. Shaffer: From"R-1B"One-family Dwelling District to an
"AB"Professional Office District
Martine Lot I,Block 3,located on Violet Road and 185 feet south of
Windsor Sheet.
Sylvia Arispe presented the above case with a powerpoint presentation reviewing the
subject property located on Violet Road and south of Windsor Street. The surrounding area
consists of single family residences with a mobile home park subdivision located to the west.
The proposed request is for an"AB"Professional Office District for the purpose of developing an
eight(8)unit apartment house, single houses or professional office spaces. The current and
future land use recommends single family residential zoning for this area. There were thirteen
(13)notices mailed with zero(0)returned in favor or in opposition. Staff recommends denial
and,in lieu thereof,approval of a"R-2"Multiple Dwelling District that would provide a buffer
near the surrounding residential and mobile home park area to the west.
Public hearing was opened.
George Shaffer,4617 Nueces Bay Boulevard,Corpus Christi,Texas stated his agreement
to change his request to a"R-2"Multiple Dwelling District.
Elizabeth Tamez representing Alma Tamez, 11229 Windsor, Corpus Christi,Texas
questioned if the zoning was tied only to the subject property and not the surrounding area. Ms.
Arispe confirmed that it was tied only to the subject property.

Motion for approval of a"R-2"Multiple Dwelling District was made by Commissioner
Zamora and seconded by Commissioner Salazar. Motion passed unanimously with Commissioners
Braselton, Huerta and Pusley being absent.

Commissioner Salazar requested a report and discussion on an ordinance change for
homeless shelters which would provide an appropriate zoning for the shelters.
Vice-Chairman Garza stated the importance of improving the infrastructure in some of
these isolated areas in Corpus Christi and also in the Flour Bluff area that are in desperate need of
sheet improvements. There needs to be some way that additional money is generated and
allocated in providing for expanded infrastructure needs. I'm not sure what can be done but
something needs to be done.

Mary Frances Teniente stated that other cities are using impact fees which are tied to
permit fees or meter hook-ups and then they structure their capital improvement program through
those fees.
Chairman Stone stated that looking at what other cities are doing on infrastructure
improvement would be a positive step.
