I. CALL TO ORDER
A quorum was declared and the meeting was called to order at 5:37 p.m.
II. APPROVAL OF MINUTES
Motion for approval of Planning Commission Minutes of March 8,2006 was made by
Vice-Chairman Garza and seconded by Commissioner Zamora. Motion passed unanimously with
Commissioner Pusley being absent.

A. CALL TO ORDER
B. BEACHFRONT CONSTRUCTION CERTIFICATE

Naismith Engineering,Inc. (Bella Vista): Consideration of a Beachfront
Construction Certificate of a 11 lot residential subdivision(Bella Vista)on a
1.734 acre tract.
Being 1.734 acres out of the La Concha Subdivision,Volume 2164, Page 254
Deed Records,Nueces County,Texas located along the south side of La Concha
Boulevard east of its intersection with State Highway 361 on Mustang Island,
Nueces County,Texas.
Mic Raasch reviewed the above request for construction of an eleven(1 1) lot subdivision located
on Mustang Island. The subject property which was platted approximately ten(10)years ago as
one(1) lot will include one(I)landscaped entryway lot and ten(10)residences with driveways,
walkways, and other associated residential improvements. There were ninety-five(95)notices
mailed out with zero(0)returned in favor or opposition. Staff recommends approval.
The findings are as follows:
1. Will be located landward of the Erosion Area Restriction Line and the vegetation
line;
2. Is not located on an existing or proposed public beach accessway;
3. Does not functionally support or depend on,or otherwise relate to proposed or
existing structures that encroach on the public beach;and
4. Is consistent with the City's Beach Access Plan and applicable state law.
Public hearing was opened.
Mark Matakis,Mayan Princess, 14350 Aquarius Street,Corpus Christi,Texas requested
a clarification regarding the language of a"Beachfront Construction Certificate"stating that the
property is not located on a beach front.

Mic Raasch explained that state law and local laws require all construction seaward of the
closest paralleling public road, in this case, State Highway 361,must be authorized with a
Beachfront Construction Permit.
Public hearing was closed.
Motion for approval was made by Commissioner Zamora and seconded by
Commissioner Skrobarczyk subject to the following findings:
1. Will be located landward of the Erosion Area Restriction Line and the vegetation

V. ZONING
1. New Zoning

City of Corpus Christi/Harbors Homeowners' Association: From"B-4"
General Business District with a"PUD-2"Planned Unit Development 2
to a revised"B-4"General Business District with a"PUD-2"Planned
Unit Development 2(allowing for consolidation of one of more lots and
storage of recreational vehicle/trailers)
Porto Bello Subdivision(The Harbors),Block 1,Lots 1-70 and 70A-150,
located west of U.S. Highway 181 and West Causeway Boulevard,east
of Rincon Road and Canal A and south of Nueces Bay.
Faryce Goode-Macon reviewed the above request for a revised"B-4"General Business
District with a PUD-2"Planned Unit Development 2. The subject property which was developed
in 1981 had a site plan showing 140 lots which approximately fifty lots have been developed into
single family residences. The owners are requesting removal of the building pad site that was
attached to the original site plan allowing consolidation of one or more lots for increase of lot size
and reducing density with an additional request for the purpose of providing a storage area for
recreational vehicles on Lot 3 of the subject property. If approved, Lot 3 will be screened with a
wood fence. After August 31,2008, if storage is still being utilized,a masonary wall with
landscaping will replace the wood fence.
In answer to Commissioner Pusley's question,Ms. Goode-Macon stated that the
subdivision has deed restrictions on the subject property.

Betty Black, 725 Crown Harbor, Corpus Christi,Texas stated that she was in favor of the
PUD request but was in opposition of the storage lot and believe it would not be an attractive
addition to the area. I own two(2)lots in the subdivision and believe it would diminish the value
of the lots.
In answer to Commissioner Skrobarczyk's question,Ms. Goode-Macon stated that the
boat storage is compatible with the"34"district.
Commissioner Zamora stated he was in favor of the removal of the building pad but not
in favor of the storage request.
Gus Leonos,46-47 Snug Harbor, Corpus Christi,Texas stated his opposition to the
storage area and believes it is a safety hazard. Mr. Leonos suggested approval of consolidation of
the lots and allowing the neighbors to discuss a solution for the storage lot. Mr. Leonos stated
that the storage was a temporary solution to the problem.
John Sloan, President of Harbors' Association,Corpus Christi,Texas stated that he was
the owner of Lot 5 and is in favor of the proposal. The boat storage area will temporarily solve
the parking of the boats and boat trailers. A large portion of the boats owned are in the water and
the subdivision has allowed individuals to screen their boats on their property,however,the main
issue is the boat trailers. There is no property on the subdivision owned for permanent boat
storage but the association has received permission from the owner of Lot 3 to utilize that lot for
boat storage until August 31,2008. The size of Lot 3 will hold a maximum of 8-10 trailers.
There is a current problem of residents parking their boats on the street and the subdivision has no
way of policing that. The lots in the subdivision are approximately 45 feet wide and will not
provide adequate space for parking. The deed restrictions and lease instructions prohibit
everything but boat trailers. I recommend approve of this request as submitted.
In answer to Commissioner Zamora question,Mr. Sloan stated storage would be on a first
come, first serve basis and the Board of Directors had voted on approval of it. Mr.Zamora stated
that this appears to be a temporary storage solution.
Vice-Chairman Garza stated he was in favor of the PUD-2 request but does not believe it
is right to approve the storage request. As the rest of this PUD develops,the boat storage will
become a problem.
In answer to Commissioner Pusley's question, Ms. Goode-Macon stated that the 13-0"
zoning does not allow outside storage. Commissioner Pusley stated he didn't believe the boat
storage fit within the subdivision.
Commissioner Braselton stated that the association should be in control of the boat
trailers.
Tom Riley,(owner of Lot 87),726 Crown Harbor,Corpus Christi,Texas stated his
agreement for the proposed PUD but has a problem with the storage and do not believe it should
included in this request.
Public hearing was closed.
Motion for approval of PUD-2 to allow for boat storage on Lot 3 expiring on August 31,
2007 and removal of building pad site was made by Commissioner Pusley and seconded by
Commissioner Martinez. After further discussion,Commissioner Pusley withdrew his motion.

Motion for approval of removal of building pad site was made by Commissioner
Skrobarczyk and seconded by Commissioner Zamora. Motion passed unanimously.

No one in favor or opposition.
Public hearing was closed.
Motion for approval was made by Vice Chairman Garza and seconded by Commissioner
Salazar. Motion passed unanimously.
