Chairman Berlanga opened the public hearing. No one appeared in favor or opposition. Public hearing was closed. Motion by Mims, seconded by Pusley, to approve the plat as submitted. Motion passed with Amsler and Zamora being absent. b. 020413-P8 King's Crossing Unit I.Phase 3.Block 25,Lots IA& IB&Block 41.Lot IA (Final—87.577 Acres) Located in the center of King's Crossing Subdivision and generally comprising the majority of the Country Club Golf Course. Mr.Power stated the applicant's engineer requested a continuance for two weeks. • Amsler entered at 5:43 p.m. Chairman Berlanga opened the public hearing. No one appeared in favor or opposition. Public hearing was closed. Motion by Pusley, seconded by Richter, to continue the plat for two weeks. Motion passed with Zamora being absent. Mr.Power stated that Staff recommended approval of New Plats c,d,and e as submitted. Chairman Berlanga opened the public hearing. No one appeared in favor or opposition. Public hearing was closed. Motion by Minis, seconded by Stone,to approve New Plats c, d, and e as submitted. Motion passed with Zamora being absent. Commissioner Stone abstained from participation on New Plat f and left the room. f. 020418-P13 Shoreline Oaks Subdivision (Preliminary—70.00 Acres) Located between Flour Bluff Drive and the Cayo Del Oso,south of the extension of Division Road. Mr.Power stated Staff recommends approval as submitted. Chairman Berlanga opened the public hearing. Angel Saenz, neighbor to the applicant, addressed the labeling of the subdivision on the map. He asked what the proposed development was planned to be. He also asked how large the park would be. Mr.Power stated that the standard would be approximately 3.5 acres,but due to the configuration would be in excess of the requirement. Mr.Saenz asked how many acres would be used to build homes. Mr.Power estimated there would be 5 or 6 acres that are not developable. He added that the lot sizes vary between 46 and 80 feet wide by 115 feet deep. The lots fronting the water are larger than the remainder of the subdivision,but everyone would have access to the shoreline. Public hearing was closed. Commissioner Richter questioned access for the subdivision. Mr. Power stated that there are three access points from Flow Bluff Drive. However,at the present time there would be only two until Purdue Road is developed. Commissioner Richter requested a future connection of Pinedale Drive or Pine Harbor Drive to align with Holly Road. Motion by Mims, seconded by Pusley,to re-open the public hearing. Motion passed with Stone abstaining and Zamora being absent.Public hearing was re-opened. Chuck Urban, 2725 Swantner, stated as stated, it currently zoned for a mobile home subdivision(T-1C). He provided a brief history of the proposal. He suggested an emergency secondary access point and not direct access to Holly Road. He did not see Holly Road being a major street unless funding becomes available from TxDOT. Mr.Urban provided an aerial photograph of the subject property. He agreed with identifying Lot 16 as an access road to Holly Road. Public hearing was closed. Motion by Amsler, seconded by Richter, to approve the plat as amended with the extension of Pine Dale Drive to extend to Holly Road with Zamora being absent and Stone abstaining. Motion by Smith,seconded by Minis,to approve g,h,and i as submitted with Zamora being absent. ZONING New Zoning 0204-04-Mostaghasi Investment Trust,Inc.: REQUEST: "F-R"Farm-Rural District to"R-IB" One-family Dwelling District on Tracts 1 and 3 and"B-3" Business District on Tract 2 on property located along Wooldridge Road to the south and 600 feet west of Cimmaron Boulevard. Ms. Goode-Macon provided a computerized slide illustration of the subject property and its surrounding area. She stated the use of each tract as being Tracts 1 and 3 are proposed for single-family residential subdivision and Tract 2 as proposed for retail development. (Zoning Report on file.) Staff recommends approval of the"R-1B" on Tracts 1 and 3 and denial of the"B-3"District on Tract 2 and in lieu thereof approval of"R-1B". There were 62. notices mailed with 1 returned in favor and 1 in opposition. Public hearing was opened. Bill Esmushen,6202 Coppedge Drive,asked what an"R-1B"district uses were.Mr.Gunning clarified they are single family dwellings. Mr. Esmushen expressed concern with additional apartment developments and future street construction. Mr.Kjar,2533 Fulton Drive,expressed concerns with traffic flow through subdivision. He also asked what size homes would be developed. Mr. Kjar asked about the drainage of the subdivision. He stated that there are issues with drainage in the area. David Williams, 2529 Fulton, requested a point of contact regarding future development in the area. He was referred to Ms.Mary Frances Teniente for future platting. Joann Sanchez, 2509 Fulton, asked what the time frame would be for the neighborhood people to know what would be developed. She also expressed concern with development of apartment complexes in the neighborhood,as well as traffic concerns. Jim Valo,Steve Roberts Associates,representing the applicant,stated the applicant is in agreement with the city's recommendation to have low-density development around the school. Tracts 1 and 3 are single family residential. He informed the Commission that housing prices would be $140,000-$170,000 and have 6000 square foot lots comparable to the adjacent neighborhood. Speed bumps would be addressed when the plan is finalized. Mr.Valo stated that Mr.—Mostaghasi felt that tract 2 should be developed commercially,but the City has taken the stance that this area should be zoned residential due to the undeveloped road(Wooldridge) and the nearby school. He added that he believes the applicant is being penalized for the city not widening the road for the B-3 district. Q Planning Commission Minutes February 25,2000 Page 6 Requested a lesser zoning classification for apartment zoning district for tract 2 such as A-2. Commissioner Stone stated he lived on Fulton Drive previously and added that the neighbors concerns are valid. He suggested that the applicant needed to address neighbor concerns prior to the plat being presented to the Commission. Vice Chairman Mims suggested a B-IA District for the subject property. Mr. Gunning stated that apartments are allowed in the B-1A District. Vice Chairperson Minis also asked where Wooldridge was on the Capital Improvement Program list of long range street improvements. Chairman Berlanga suggested an AB District for the subject property. Commissioner Stone asked what were the requirements for the proposed subdivision on Tract I. Ms.Teniente stated that an access point would be requested to Wooldridge Road. She added that her staff would work with the applicant to achieve the best possible access for the development. With regard to the number of units allowed per acre for the B-1 and the B-IA, Ms. Goode-Macon stated that the B-I allows 36.3 units per acre and the B-IA allows 14.52 units per acre. Commissioner Salazar stated that he would prefer that the area have a neighborhood retail center but not an apartment development. Mr. Gunning suggested that tract 2 not be rezoned and await the development of Wooldridge Road to decide the appropriate zoning and added that he would support the apartment district and B-1A. After discussion regarding the options for B-1A, and R-1B, the applicant requested a continuance for two weeks. Public hearing was closed. Motion by Minis,seconded by Salazar,to approve Staffs recommendation for denial of the B-3 District on Tract 1 and with Zamora being absent. 0204-05-Richard 0.Sema: REQUEST: "R-1B" One-family Dwelling District to "B-1" Neighborhood Business District on property located along Elizabeth Street to the west and 100 feet north of Baldwin Boulevard. Ms. Goode-Macon presented a computerized slide illustration of the subject property and its surrounding area. She stated the proposed use is a convenience store. (Zoning report on file.) Public hearing opened. Richard Sema,5329 Fulwell,stated he was available for questions. Public hearing was closed. Motion by Salazar,seconded by Mims,to approve as submitted. Motion passed with Zamora being absent. 0204-06-Maurice C.Hunsaker and Walter Day: REQUEST: "F-R" Farm-Rural District to "12-1C" One-family Dwelling District on property located along County Road 26-A to the north and 2,000 feet east of Rodd Field Road. Commissioner Amsler abstained from participation and left the room. Ms. Goode-Macon presented a computerized slide illustration of the subject property and its surrounding area. She stated the proposed use is a single-family subdivision containing 93 lots. (Zoning report on file.) Staff recommends approval of the rezoning request. Motion by Salazar,seconded by Pusley,with Amsler abstaining and Zamora being absent. 0204-07-James Paul Allison and Doug Adams: REQUEST: "F-R" Farm-Rural District to "1-3" Light Industrial District on property located along Saratoga Boulevard to the south and west of S.H.286. Ms. Goode-Macon presented a computerized slide illustration of the subject property and its surrounding area. She stated the proposed use is for industrial,office,and warehouse. (Zoning report on file.) Staff recommends denial of the 1-3 District and in lieu thereof recommends approval of the 1-2 District. There were 12 notices mailed with one received in favor and one received in opposition. Public hearing was opened. No one appeared in favor or opposition. Public hearing was closed. Motion by Pusley,seconded by Mims,to approve staff recommendation. With Zamora being absent. 0204-08-Hogan Development Company,L.P.: REQUEST: "F-R" Farm-Rural District to "R-IC" One-family Dwelling District on property located along Wooldridge Road to the south and east of Rodd Field Road. Commissioner Amsler abstained from participation and left the room. Ms. Goode-Macon stated that the information contained in the packet has been changed. After discussion with the developer,the developer proposed alternatives to the transportation plan. Ms. Goode-Macon presented a computerized slide illustration of the subject property and its surrounding area. She stated the proposed use is a single-family subdivision containing 300 lots with 100 lots in Phase 1. (Zoning report on file.) Staff recommends approval of the rezoning request. There were 21 notices mailed with I received in opposition and 0 in favor. Public hearing was opened. John Bell, Primavera Street, distributed aerial photographs of the proposed development. Mr. Bell explained the proposed development and access roads. He stated the development was similar to the Victoria Park subdivision in the area. Public hearing was closed. Mr. Gunning expressed concern with the alignment of the Oso parkway as proposed by the applicant. Staff would prefer to discuss the matter with the applicant's engineer. Motion by Smith,seconded by Mims,to approve r-1 c.with Zamora absent and Amsler abstaining. ZONING/PLATTING ORDINANCE TEXT AMENDMENT-Amendments increasing penalties for code violations per Estate law. Zoning fines are increased from a maximum of$1,000.00 to$2,000,and platting fines being increased from $100.00 to$500.00 2000 to be in accordance with state law. ti Ii Planning Commission Minutes February 25,2004 Page 8 Chairman Berlanga opened the public hearing. CONSOLIDATED ANNUAL ACTION PLAN FY 2004—Fund Allocations Community Development Block Grant(CDBG),HOME Investment Partnerships,Emergency Shelter Grants were presented by the Department of Neighborhood Services. Minutes will be provided under separate cover. NONPUBLIC HEARING AGENDA ITEMS APPROVAL OF MINUTES January 28,2004 minutes were approved. February 11,2004 minutes were not presented.
