FUTURE SCHEDULED MEETINGS Mr. Gunning, Director of Planning, informed the Commission that the proposed Zoning Text Ar::cydments were scheduled for a public hearing on June 6, 2001. He continued that staff needed to discuss rely issues regarding bed and breakfast uses. He added that the Commission could decide not to pursue an amendr.::nt to all U) bed and breakfast uses. C J Commissioner Amsler said that he would not be attending the June 6, 2001 meeting due to a szlz..duling conflict with the Economic Development Corporation(EDC)trip to LaFayette, Louisiana. OTHER MATTERS Mr.Gunning said that the Planning Commission's report on Affordable Housing was forwarded:: :he City Council for their review. The report was provided for Council's review and future consideration. Commissioner Pusley highlighted items discussed at a meeting between bed and breakfast o••:rers and Staff. There were two (2) owner/operators in attendance. Mr. Pus added that there are r.'.o 12) types of bed and breakfasts. He said that he was concerned about having over-re_aiation. Commissioner Sween-McGloin asked about a Shoreline Drive re-alignment study. Mr. Gunning said that the City would he addressing the downtown transportation plan including Shoreline Drive and that the p would have to be presented to the Planning Commission. Time Extensions a. 059939-NP24 The Palms At Waters Edge—O.C.L.(Final Replat—36.200 Acres) Located between State Highway 361 (Park Road 53)and the Gulf of Mexico approximately 10 m:_s south of Port Aransas,Texas Mr. Power said that because of a city beach access plan, Staff believes it is in the best interest to _rant an additional time extension. He added that the Corps of Engineers Land Office and the County are also involved. Mr. Power informed the Commission that the previous extension was supposed to be the fourth and last extension,but due to circumstances that have arisen due to bankruptcy proceedings. He said that Staff would recommend an additional extension. * Pusley arrived at 6:45 p.m. Chairman Berlanga opened the public hearing. In response to Commissioner Zamora, Wiley Eaton,Gardenridge,Texas,said that he had a permit:o begin the development of the project and that construction plans were submitted. There was complica:on with the easement and had to stop construction due to beach access problems. Commissioner Sween-McGloin expressed concern with allowing another extension after inforr..ang the applicant that the previous extension would be the last extension granted. In response to Commissioner Pusley, Mr. Doyle Curtis, Assistant City Attorney, said that the subject property is located outside the city limits,but within the extraterritorial jurisdiction,but not located within Port Aransas city limits. He explained that there has been residential development on Mustang Is:and,but there are some improvements which require additional time for development. 0 Planning Commission Agenda May 23.2001 Page 4 Public hearing was closed. Motion by Cheek, seconded by Salazar, to approve a six-month time extension. Motion passed with Sween-McGloin voting Nay and Mims being absent. * Zamora left at 6:50 p.m. ZONING CASES Dunhill Enterprises.L.L.C.: 0501-02 REQUEST: "A-1"Apartment House District to"R-1B"One-family Dwelling District on property des-Ced as Flour Bluff and Encinal Farm and Garden Tracts,Section 52, Lot 15 and located on the c_-a side of Yorktown Boulevard,approximately 650 feet east of Waldron Road Mr. Saldaiia presented a computerized slide illustration of the subject property and the surround= area. The subject property is the only 20-acre parcel of land zoned an "A-1" District in the area. Adjacent to worth, south. and east. there are 2,620 acres of land zoned an"R-1B"District that contains a mixture of undevelo land, single-family residences and an air training field. Adjacent to the west, there are 17.72 acre of land zoned a 'B-3" District and contains mini-storage facility,boat storage, retail store, church and undeveloped land. Northw tst from the subject property, the area contains 57.28 acres of land with single-family residences, a church and und:•eloped land. The applicant has requested a change of zoning from an"A-1" Apartment House District to an "R-1E" One- family Dwelling District in order to develop a single-family residential subdivision. The subdivision is pined to contain modular buildings instead of the conventional on-site built homes, but will not prohibit the on-s::e built homes. According to Building Inspection, the difference between a modular home and a manufactured hors is on State-mandated standards and its classification. Although single-family residential development is allowed under the current"A-1"District,wider streets and larger water and sewer lines would be required than if it were z.aed an "R-1B" District. The subject property is located between partially developed commercial properties "B-3" Business District, on the west and single-family residences, "R-1B" District to the west with direct access to a collector street. Yorktown Boulevard. As requested, the "R-1B" District is an expansion of the "R-1B- district adjacent to the north,south and east. As proposed,the modular homes will have to comply with the standar:_of the City. According to the applicant, these modular homes are constructed in Houston and will be shied and assembled on the site. All foundation work will be required to be in place and inspected by the City le'?re the homes are installed. The subject property is located within the Flour Bluff Area Development Plan's future land map recommends the area to develop with medium density residential. The requested"R-1B"District permits a density within the allowable density of the medium density residential. Therefore, the requested "R-1B" D aict is consistent with the adopted Plan's future land use map. Staff recommends approval of the rezoning request There were 43 notices mailed to property owners within a 200-foot radius of the subject property of which ncr.e were returned in favor or opposition. A letter was received from Naval Air Station - Corpus Christi suppor ng the rezoning request. Chairman Berlanga opened the public hearing. No one appeared in favor or opposition. Public :::wring was closed. Commissioner Richter said that the current"A-1" District is a good transition between the existitr "B-3" and"R-1.B"Districts. In creating a neighborhood residences would not want businesses allowed in"B-3"District to be adjacent. She asked what the square footage of the homes would be and why a change from"A-1"Distrix:to"R- IB" District was needed when "A-1" District allows modular homes. Mr. Saldafa responded that the :nodular homes would be 1,200 square feet. He explained that a single family residential area could be developed i-an"A- l" District, however, the"A-I" District requires larger water and sewer lines and wider streets which increase the cost of the lots. He continued that the street right-of-way is 50 feet for single-family districts and 60 ::et for apartment districts. • • Planning Comr::.:on Agenda May 23.2001 Paae 5 Coma::. ::oner Richter said that she did not believe the land use needed to be changed because c: ::ie use and that the trar.::::on to"R-1B" District would not be necessary. She agreed with saving the developer rr._=zy and using the land in :he best way.Commissioner Pusley concurred. CommIssroner Pusley asked for information regarding the modular homes. Mr. Saldafia explained that the homes are ship rci from Houston, Texas and assembled on the lot. The homes will be placed on a found_=on and required to mee: all city codes. He added that there would be approximately 43 homes in the subdivision. Motion by Sween-McGloin,seconded by Salazar,to approve Staff's recommendation. Motion pariied with Richter voting Nay and Mims and Zamora being absent. Minora:Opinion: Commissioner Richter said that she supports the residential development. but does not agree with downzoning. ADJOURNMENT Motion by Salazar, seconded by Pusley, to adjourn the meeting. Motion passed with Mims and Zamora being absent.
