PLANNING COMMISSION MEETING

CALL TO ORDER
Chairman Mims called the meeting to order at 6:35 p.m. , and
welcomed new Commission member Richard Serna to the Planning
Commission. She described the procedure to be followed.
PUBLIC HEARING
NEW ZONING
Kids of the Neighborhood: 294-3
REQUEST: From "R-2" Multiple Dwelling District to "B-1"
Neighborhood Business District in
Southmoreland Block 10, Lots 4 and 5, located
on the south side of Clemmer Street,
approximately 150 feet west of Lewis Street.
Mr. Gunning described the land use and zoning in the
surrounding area, and stated that the applicant is requesting a
zoning change to provide off-site parking for child care center
employees. The property is currently occupied by two single-family
residences on separate lots.
Mr. Gunning summarized the Staff Report, informing the
Commission of applicable Policy Statements.
The applicant, Kids of the Neighborhood, operated by the
Christ Lutheran Church, is requesting a change of zoning to "B-1"

Neighborhood Business District on Lots 4, and 5 for purposes of
constructing an employee parking lot for the child care center.
The subject lots are located in the Southmoreland Subdivision,
which is predominantly zoned "R-2" Multiple Dwelling District. The
"R-2" District allows 14 .52 dwelling units per acre, and is
traditionally used for duplex and townhome developments. The
neighborhood is developed with a mix of single-family homes and
residences with detached apartments.
The subject lots are presently occupied by single-family
dwellings, which the applicant plans to remove. Single-family
residences abut the property on the west and east sides. The
adjacent land uses to the south consist of one lot with two
dwellings, a vacant lot, and a single-family residence.
The primary use is the church, with the child care center as
an accessory use. The main church building fronts on Ayers and
Clemmer Street (Lots 10, 11 and 12, Block 10 - zoned "B-4"
District) . The Church also owns 8 lots abutting to the east (Lots
7-9; 15-19) with Lot 19 located caddy-corner to the proposed
parking area.
The applicant was unable to purchase Lot 6 which separates the
existing parking from their proposed parking. If the subject lots
abutted the church property, the proposed parking lot would not
have been classified as off-site parking. Off-site parking
requires at least "B-1" District.
Approval of "B-1" District on an interior lot of a residential
neighborhood would set a precedent for future non-residential
rezoning requests. The subject lots are approximately 650 feet
east of Ayers Street, an arterial that has been developed as a
commercial corridor. The existing "B-4" District zoning
delineation should remain intact to protect this neighborhood from
commercial encroachment.
The child care center seeks only authorization to expand their
parking which can be accommodated through a special permit. The
parking area' s adverse impact on adjacent residences can be
buffered by the required landscaping and a screening fence
requirement set out as a special permit condition. Given the long
tenure of the Church' s presence in this area, as well as the day
care center, the neighborhood should not be adversely affected by
the expanded parking.
Mr. Gunning read to the Commission the pros and cons of this
application from the Staff Report (copy on file) .
Thirty three notices were mailed, one was returned in favor
and one in opposition. Staff recommends denial of "B-1"

Neighborhood Business District, and in lieu thereof, approval of a
special permit for an off-site parking lot subject to the following
conditions:
1) USE: The only use authorized by this special permit
other than the basic "R-2" Multiple Dwelling District
uses is an off-site parking lot associated with the child
care center and church located to the west;
2) SCREENING FENCE; a standard screening fence shall be
installed along the south, east, and west property lines
with the screening fence not exceeding three (3) feet in
height within the front twenty (20) feet. The screening
fence must be installed within one (1) year of the date
of this ordinance.
Mr. Henry Naw, Chairman of the Board, Rids of the
Neighborhood, appeared and stated that they need additional easily
accessible space for parking for the day-care center. He added
that parking would primarily be for staff of the day care center,
and the property would be maintained and landscaped in accordance
with the ordinance. Mr. Naw felt that it would be an improvement
to the area.
In answer to questions from Chairman Mims, Mr. Naw indicated
that they could let a contract for construction within 3-4 weeks,
and it is not feasible to purchase Lot 6 at this time.
In answer to questions from Commissioners, Mr. Naw stated that
the houses will be moved, and not demolished; the parking lot will
also be used by the Church; and that the majority of the parents
using the day care center live in the neighborhood, or go to school
at Del Mar College.
Mr. Oscar Dodier, 130 Watson, appeared in favor of a special
permit, but was opposed to "B-1" Neighborhood Business District.
The public hearing was declared closed.
Motion by Canales, seconded by Cook, that this application for
"B-1" Neighborhood Business District be forwarded to the City
Council with the recommendation that it be denied, and in lieu
thereof, approval of a special permit for an off-site parking lot
subject to the following conditions:

None.
MATTERS NOT SCHEDULED
Mr. Harvey informed the Commission that there will be a work
session at the next regular Planning Commission meeting on the
Southeast Area Development Plan. A public hearing will be
scheduled in the future. The Planning Commission will also
consider two contractual annexations at the next regular meeting.
Commissioner Cook asked Staff to let her know the dates of the
Community Development Block Grant meetings.
Chairman Mims referred to the Financial Statement that was
mailed to Planning Commissioners, and reminded them to complete it
and return it to the City Secretary's Office.
APPROVAL OF MINUTES
Chairman Mims had questions about the February 9, 1994
minutes, and Mr. Harvey advised that they can be corrected.
Motion by Cook, seconded by Taylor, and passed with Bertuzzi,
Hall and Perez being absent, that the minutes of the regular
meeting of February 9, 1994 be approved as corrected.
