Harvey, AIA, AICP, Director of Planning and Development Marcia Cooper, Recording Secretary Harry Power, City Planner Norbert Hart, Assistant City Attorney CALL TO ORDER Chairman Mims called the meeting to order at 6:30 p.m. , and described the procedure to be followed. PUBLIC HEARING NEW ZONINGS None. NEW PLATS Consideration of plats as described on attached addendum. OTHER MATTERS City Council Action Mr. Harvey reported the following action taken by City Council: 1093-1 - South Texas Lighthouse for the Blind City Council requested that Staff prepare a Special Permit to allow employee parking with screening requirement. 1093-2 - Whittle & Associates, P.C. MATTERS NOT SCHEDULED Commissioner Cook asked if the City Council received, in their recent package, a letter from Cullen Mall asking for a special district. Mr. Harvey replied that he was not aware of any letter in the package. He added that it may be about closing an easement on the property, or it could be a letter that was sent some time ago about the rezoning. The City Council will consider the Cullen Mall application on December 14, 1993 . Chairman Mims informed the Commission that she spoke to the Insight group of Leadership Corpus Christi, and they discussed the need for increasing the capacity at the wastewater treatment plants. She stated that there is a lot of development occurring, and if the capacity is not increased, the State can cut off hook- ups. APPROVAL OF MINUTES Motion by Cook, seconded by Taylor, and passed with Canales and Longoria being absent, that the minutes of the regular meeting of November 3, 1993 be approved. Salazar Engineer - Shearer, Plog & Associates Mr. Power informed the Commission that this plat has to be removed from the Agenda because of improper notification. Proper notification will be give, and the plat will be on the December 1, 1993 Agenda for action. 2. 1193100-P46 Bluff Estates, Lot 13-F (Final replat - 0.189 acre) Located southeast of Paloma Street and northeast of Jarvis Street Owner - Robert Pankey Engineer - Voss & Voss Mr. Power stated that there were no conditions remaining on this plat, and Staff recommends approval as submitted. No one appeared in favor or in opposition, and the public hearing was declared closed. Motion by Taylor, seconded by Perez, and passed with Canales and Longoria being absent, that this plat be approved. 3 . 099381-NP46 Behmann Subdivision, Block 2, Lot 3C (Final replat - 8.501 acres) Located between Ayers Street and Crosstown Expressway (State Highway 386) north of South Padre Island Drive (State Highway 358) Owner - Port City Automotive Parts Engineer - Bass & Welsh Mr. Power stated that there were no conditions remaining on this plat, and Staff recommends approval as submitted. No one appeared in favor or in opposition, and the public hearing was declared closed. 4 %NW 44•40 Planning Commission Meeting November 3, 1993 Page 4 Motion by Meinrath, seconded by Taylor, and passed with Canales and Longoria being absent, that this plat be approved. 4. 1193107-NP61 Caribbean Baptist Church Tract, Block 1, Lot 2 (Final - 3 .57 acres) Located south of Caribbean Drive and east of Waldron Road Owner - Caribbean Baptist Church Engineer - Urban Mr. Power stated that there were no conditions remaining on this plat, and Staff recommends approval as submitted. No one appeared in favor or in opposition, and the public hearing was declared closed. Motion by Taylor, seconded by Perez, and passed with Canales and Longoria being absent, that this plat be approved. 5. 1193108-NP62 Gatz Addition - O.C.L. (San Patricio County) (Final - 22 .226 acres) Located between County Road 66 & 66A and the Nueces Bay, west of County Road 75, extended, approximately three (3) miles west of the city limits of Portland, Texas, San Patricio County Owner - Kenneth F. & Suzanne L. Gatz Engineer - King & Petrus, Inc. Mr. Power stated that the following conditions have not been met: 1. Require a review by the General Land Office for designated boundary lines between the property owners and the state-owner submerged land, approved by the Commissioner of that office under the jurisdiction of the Coastal Public Lands Management Act of 1973, Article 5415e-1, V.A.C.S. 2 . Require a Corps of Engineers determination of any existing "wetlands" . Mr. Julius Petrus, King & Petrus, Inc. appeared and stated that the subject property is located within the City of Corpus Christi's extraterritorial jurisdiction, and, therefore, requires approval by the City of Corpus Christi before submittal to San Patricio County. L+ Planning Commission Meeting November 3, 1993 Page 5 Mr. Petrus addressed condition No. 1, stating that their property is above the elevation of the shoreline, and felt that it would be approved by the General Land Office. He felt confident that they would not be encroaching on State property, but offered to get approval from the General Land Office if necessary. Mr. Power indicated that the letter would be necessary for the files. Mr. Petrus addressed condition No. 2, stating that they have requested a determination from the Corps of Engineers, but they have not had a reply. He indicated that he will be contacting them within the next two weeks for a response. In answer to a question from Commissioner Hall, Mr. Petrus explained the process the plat has to go through before it is approved by San Patricio County. Mr. Harvey indicated that the Commission could table the plat, if the owner so desires. Mr. Petrus requested that the plat be tabled for two weeks. Motion by Taylor, seconded by Bertuzzi, and passed with Canales and Longoria being absent, that this plat be tabled for two weeks. 6. 1193109-NP63 Wood River Unit 6, Block 46, Lots 5 and 6, (Final replat - 4 .79 acres) Located north of FM 624 and east of Wood River Drive Owner - The Bank of Alice Engineer Urban Mr. Power noted that an additional lot has been included in this replat, and stated that there were no conditions remaining. Staff recommends approval as submitted. No one appeared in favor or in opposition, and the public hearing was declared closed. Motion by Taylor, seconded by Perez, and passed with Canales and Longoria being absent, that this plat be approved. t Sea/ *fis0 Planning Commission Meeting November 3, 1993 Page 6 TABLED PLATS A. 099384-P38 Ferias Grant Subdivision, Block 3, Lots 7 & 8 (Final - 2 .824 acres) Located west of Loma Alta Road south of Leopard Street Mr. Power stated that this plat was originally tabled on October 20, 1993, and again on November 3, 1993 by the Planning Commission, in order to add a requirement for a 275' horizontal radius to the centerline of Loma Alto Street and street dedication. Mr. Power noted that Staff has met with the prospective purchaser, and they are approaching a resolution of the additional right-of-way. The property owner is requesting that this plat be tabled for an additional two weeks. Motion by Hall, seconded by Bertuzzi, and passed with Canales and Longoria being absent, that this plat be tabled for two weeks. B. 109387-P40 Cullen Place, Block A-1 & B-1 (Final reDlat - 7 .371 acres) Located east of Airline Road and bounded by Alameda Street on the north, and Belmeade Street on the south At the applicant' s request, the Planning Commission tabled this plat on October 20, 1993 to allow changes to the initial lot configuration. On November 3, 1993, the Planning Commission continued tabling this plat until such time the adjacent companion plat to the east is also ready for Planning Commission action. Mr. Power noted that this plat has been modified from 3 lots to 2 lots, and the owner has resolved the lot configuration. Motion by Taylor, seconded by Hall, and passed with Canales and Longoria being absent, that this plat be removed from the table. Mr. Power stated that Staff recommends approval as submitted. Mr. Bob Wallace, 350 Grant, appeared and stated that Whataburger has expanded the size of the property they requested, which eliminated one lot. 4 Planning Commission Meeting November 3, 1993 Page 7 No one appeared in favor or in opposition, and the public hearing was declared closed. Motion by Taylor, seconded by Meinrath, and passed with Canales and Longoria being absent, that this plat be approved. C. 1193103-NP57 Lokey Subdivision, Tract 513, Lot 7 (Final replat - 3 .248 acres) Located south of Holly Road, east of Lokey Street This plat was tabled on November 3, 1993 at the owner' s request to allow more time to discuss street construction requirements with Staff, and possibly pursue a construction deferment. Mr. Power stated that Staff recommends approval as submitted. Mr. Harvey clarified that the Planning Commission would be approving the plat for one-half the street with curb and gutters. Sidewalks will not be required. The applicant intends to seek acquisition of the property across the street, and if acquired, will request that the street be closed, and replat the property into one lot. If the property is not acquired in 6 months, he will pursue a deferment contract. Approval of the plat does not relieve him of constructing the one-half street. Motion by Hall, that this plat be approved. Vice Chairman Taylor asked if the owner can build his building while he negotiates, to which Mr. Harvey responded in the negative. He added that the property has to be appropriately platted to obtain a building permit. The owner can request a construction deferment, put up a guarantee of money, and then be recorded, after which he can obtain a building permit. Commissioner Bertuzzi suggested that the City put a lien on the property in lieu of the owner putting up money to build the street, and felt that there must be some way that the property can be platted in order to allow the owner to build his building, and not develop the road until the property across the street is developed. Discussion followed, where it was pointed out that construction of the half-street is a requirement of the v 'vast Planning Commission Meeting November 3, 1993 Page 8 platting process, and that the property may not develop with storage units, but could be developed with other uses, with the need for a continuous street and several curb cuts on Lokey Street. Mr. Hart pointed out that there is a third alternative available to the Planning Commission, namely granting a variance based on hardship, but he could not justify such a van: -ce in this case. Mr. Harvey read the conditions for a hardship from the Platting Ordinance, and stated that it is Staff' s opinion that this plat does not qualify for a hardship. Mr. Hart informed the Commission that if the owner requires a deferment, the Planning Commission may establish a time limit in its recommendation to the City Council. Motion seconded by Cook, and passed with Canales and Longoria being absent. (H404MC)
