ANIMAL CONTROL ADVISORY COMMITTEE
Nueces County Public Health District

The Minutes for December 16th, 2010
Members Present: Samantha Person, Bill Schroeder,Barbara Beynon,Heather Tamoski and Dr. Barbara Whitlock
Members Absent: Cheryl Martinez and Helen Sterbach

1. Call to Order:
Mr. Schroeder called the meeting to order at 12:30.
2. Discussion and possible Approval of Minutes from November 18th,2010
Ms. Beynon made a motion to approve the minutes,Ms.Person 2nd the motion all in favor motion passed.
3. Discussion and possible Approval of Absences from November 18!h,2010
Ms.Beynon was absence due to business. Dr.Whitlock made a motion to approve the absence,Ms.Tamoski 24d the motion all
in favor motion passed.
4. Discussion of Monthly Regorts
A. Zoonosis Report
Mr. Schroeder noted that the Zoonosis Report was attached for viewing. Ms. Beynon commented about the last bat we had
been in October or September. Ms.Copeland added it was the last positive bat. Ms.Hundley interjected that the front door was
locked,when we have an open meeting the door cannot be locked and the person in front said she didn't have a key.Mr.
Schroeder asked if the form that is enclosed in the Zoonosis report being giving to schools.Ms.Copeland replied that the state
provides the forms to the schools.
B. Shelter Report
Ms.Copeland informed the committee of the numbers for the shelter.There was a total of 783 for incoming animals;883
outgoing animals,euthanasia at 71%,73 bite cases,adopted out 4%and the total calls for service was 2,191.
Ms. Beynon asked that when you say euthanasia rate and I understand it's all animals;the 90 others are probably opossums.
Ms. Copeland replied that as I've explained in the past we don't do individual cards for individual wild animals.We do 10-20 on a
card at a time. Ms. Beynon added that when people hear this and the numbers are skewed a little high because of the others.

Ms.Copeland replied that you may consider it skewed a little high,I do believe it's accurate,and there are still living animals that
we're euthanizing. Ms. Beynon added that some people think that it's all dos and cats and the numbers are down. Ms. Beynon
added she didn't like opossums; Ms.Copeland added that she use to rehab them. Ms.Beynon asked if she's trapping m
asked if they could be rehabbed. Ms.Copeland replied at if she had a place,we use to have someone in the city that wanted to
but he was releasing them in his backyard.Ms.Copeland added that the opossums here aren't as healthy as the ones in
county where she came from.County opossums are healthier then city opossums.
C. Clinic Report
Ms.Copeland informed the committee there was a total of 111 surgeries for the month of November.Ms.Copeland added that
we are now getting Chameleon to do 2 reports for this and update it.You are aware of the problem we were having with the
report pulling from 2 different places on the surgery. They vAll also be working on a report for a"to do report'for the
veterinarians'office. Then they will be able to provide to the staff a computer generated list of medications that are being
dispensed to the animals. Dr.Whitlock asked if this will include heartworm medication. Ms.Copeland replied yes and it was
what started this. We had one format but it didn't address all the needs so they are helping us with the update. Dr.Whitlock
added that he will dispense the revolution to the kennel person and they will be able to give it to them.
Ms.Person asked what P&C meant on the shelter report. Ms.Copeland replied it's the name we have given to the Gulf Coast
fund for heartworm. The Humane society has a gala once a year where they raise money for their shelter and this year they
included us in the event. The money is still humane society money but they raise additional funds to pay for the heartworm
treatment for dogs that we have that test positive. We still send the animals to Gulf Coast and it increases those numbers we
would be able to send them. Ms.Beynon asked that the dogs getting heart worm treatment,they are paying for it and then they
go o Gulf Coast to be adopted. Dr.Whitlock asked if we treat them here or there. Ms.Copeland added that they are treating
them at Gulf Coast and they adopt them out.
Ms.Tamoski asked about the"died ken"on the shelter report,wanted clarification that it means they died here. Ms.Copeland
replied yes;it could mean that they came in sick,occasionally not very often that a animal sustained a injury while here and one
in particular a few months ago where we had 2 dogs in a kennel that got into a fight and before we could get them broke up the
dogs sustained injury. Ms Tamoski also asked about'missed/memo'on the report. Ms,Copeland replied occasionally we will
have an officer come in;with el n it has the ability to document the animals,once that's done it puts them into a kennel
which is 2 separate processes. An officer may document an animal with ID#and put that into the kennel and walk away,forgot
to see what's available and then he loses the I s.Copeland added that later on I can run a report that will help determine
where the ID#is,a new one is made. Ms.Tamoski added that the 22 that we don't know where they are.Ms.Copeland replied
that they have been given ID#and a kennel card. The only problem is you get an ID#floating floafing around that needs to be fixed,
Ms.Beynon the numbers in the missed memos'don't count in your total. Ms.Copeland replied that it is in the total,you can see
the number and the percentage,it does make it skewed,but it's accounted for.
Ms. Beynon asked about the Trap-alter-release.Ms.Copeland replied that the program was over back in October.We will be
submitting our final totals to Petsmart and the board in January. Ms.Person asked if there is more funding will we move forward
with it. Ms.Copeland replied that at this point we need to come up with viable addition to the ordinance and give it to legal and
they will work on it;then forward to City Council to make it happen. Ms.Beynon asked if this is something that will be include
for January.Ms.Copeland replied that we will have the numbers.
5. Discussion of the ordinance reaarding g the falcon[y introduction of Jonathon WoW
Mr.Schroeder introduced Jonathon Wood.Ms.Copeland added that Mr.Wood has been living in the city and he does have
raptors,he has asked us to amend our ordinance so that he can remain in the city. Ms.Copeland added that she had been
doing some investigating on this and don't know a whole lot about it,he has been so informing. We have talked to Texas Parks
and Wild Life. Ms.Schenzel has very well at getting information for us but is out sick today. Ms.Copeland added that she had
put together information about the ordinance;there are a lot of questions still to answer. We have asked Mr.Wood to come and
talk to us about what he does and what he would like to see about the ordinance.
Mr.Wood informed the committee that he came to Corpus Christi 7 years ago and also has a home in New York in the Catskill
Mountains which is where the main head quarters. i travel all over the United States; I work in 28 states and a lot of the major

cities including New York City including birds of prey including eagles,hawks,falcons or owls. I am also one of the biggest
educators in the country for raptors and have a lot of my birds on various licenses. I am licensed with the Federal Government,
US Fish and Wild Life Service,Texas Parks and Wild Life and by every state I go into.
Dr.Whitlock asked if he was a rehabilitator.Mr.Woods replied I am a reh bllit for but I'm licensed mostly as an educator. To do
educational programs you have to have,if you are working with eagles you have to have an eagle permit,if you are working with
other raptors you have to have an educational exhibition permit. I also have one for endangered species for the occasions I am
working with those. I have birds that are native to the United States like the bald eagle. Then you have birds that are native to
other countries like a falcon from Iceland or owl from Europe. I have quite a collection of birds. I am a master falconer;that
sans I hunt with falcons;to do that anywhere in the country you have to have a falconry license. You can be an apprentice,
general or a master and then you need a federal ands to license. There is also 5 or 6 other falconers'living in the city of
Corpus Christi;they also have birds like I d . It has come to our attention that there is an ordinance against falconic forms.
Falconic forms are eagles,falcons or hawks. Mr.Woods added that he also has owls and it says nothing in the ordinance
against those.Those are called strig-a-forms is the Latin name,not sure historically how this ordinance started in your city, I
talked with Texas Parks and Wild Life before going in and asked if there were any other cities in Texas where they have this
ordinance and they didn't know of any.
Mr.Wood also added that he has worked in some of the largest cities in the country including New York and they do not have the
ordinance against raptors. I also do commercial work,movies,commercials and television shows.At this time I have a bird in a
boardwalk empire HBO movie. I also just got another movie I will be flying to New York for one of my eagles. I am a
professional,this is my corporation. I travel all around and this came to my attention and what we are attempting;there is one
other involved as far as falconers didn't want to stick their neck into it,because nothing has happened to them and at this time
would rather not show face and said he would take care of it. Ms.Copeland interjected to point out with the investigating that we
have done I have learned that do what Mr.Wood does he literally has to jump tru some of the toughest hoops federally and in
the state,so he has gotten to the place where he is at he's not done so by doing it wrong but by doing it very right.Mr.Wood
stated at he had worked professional wild life license more than anyone in the United States;my license book is thicker than
y briefcase. It takes weeks to do reports,some stales I need more than 1 permit to go into. To become a master falconer
takes more time than getting a PHD. It takes about 5 years as an apprentice,there are people that start in the city as an
apprentice falconer. To arrive at getting a falconer license,it's not like you have an ordinance where you could get a pet falcon
for a present and not know how to handle it and then cause problem for a neighbor.To arrive that way you can either own a bird
or go thru a bunch of hoops. You have to have a sponsor,have equipment inspected,have a facility inspection and pass written
tests before you can even start. Once you start you don't even have a bird,then you get authorization to get your first bird and
proceed i that There is a phenomenal amount of red tape before you're able to get one of ese birds.The birds are hungry
they are dangerous to prey they don't attack people or attack people in the wild.
These are birds that in the city of Corpus Christi we do some hunting here and out on Mustang Island there are some duck
ponds. I have one of my falcons trying to hunt ducks out there. The falconers t are in the city don't even hunt here because
there are not any good places. We go out west to Beeville,the hunting is better there. Corpus Christi is known as a city with
the most birds. As a falconer If 1 take a falcon and fly it on Mustang or Padre Island,wild falcons come in and try to chase our
birds away. I had one incident where one of the wild a to knock one of my falcons into the Gulf of Mexico,which is one of the
reasons why we try to avoid hunting here. It also doesn't mean that falconry is oin to have a huge foot hole in a City of
Corpus Christi whether you have a ordinance against it or not. I'm not too sure how the ordinance started but I'm here for any
questions and what we can do in changing the ordinance. There are 2 circumstances,there are falconers that are part-timers
they have their regular jobs and falconry as a hobby. Then I am unique in the city in that falconry is my hobby but I am also
professional master falconer and educator. It comes under the same heading with raptors being prohibited in the city.
Dr.Whitlock asked how you would like to see the ordinance changed. Mr.Wood noted that this is your ordinance;you've been
to the aquarium and the bird show there,they have raptors in their bird show. They are in a commercial district; I will help the
work on their show. I sell them some of the birds they use in the show and I set up big shows. At this time I have one of the
biggest bird shows in the country will be setting up at Six Flags. It is called the Great Adventure New York, New Jersey.Once I
o that they have offered me 3 shows,they will be coming one of my clients and will be setting up the show every year.The
ordinance here says no raptors in residential and all these carpenters live at their residence, My residence on Padre Island,
when I first came here I didn't know anything about this. I bought a house and the tat next door where I keep the bird pans,RV. It
passed the state federal Inspection,which allowed me to have my state license.I also have a Zoological permit. I spend
approximately 3 months in Corpus Christi, I could move to another city if it comes down to that. I do love Corpus Christi, I love
that it's a city with the most birds. I am also sponsored by ikon. What we see in the future is akin Corpus Christi even more

of a hub for bird watching. I want to work on making is a bird destination. I work some of the biggest bird festivals in the
country, I also promote bird watching. I do tee programs,did a 100 year anniversary for the Boy Scouts at Texas A . I am
also doing a free program for the Flour Bluff Schools this next month. I spend less amount of time at our New York house,my
corporation is based there but Texas is my residence.
Mr.Wood added that my family is here,my daughter is 11 and has grown with show business and one day will take it over. She
loves it here,attends school 3 months of the year and the rest is home schooling. We have an unusual lifestyle;we travel and
live in the RV most of the time. Dr.Whitlock commented that she didn't feel there was a problem in changing the ordinance so
that someone like you keeps the falcons or owls. I would like to see something regulated to where there wouldn't be a problem
with back door people trying to do the same thing. Mr.Wood added having the state and federal license.Mr.Schroeder asked if
that was already in place. Mr.Wood replied yes it is. Mr.Wood added for example if your neighbor found a hawk and it had
bad wing and put it in a cage in their back yard,they don't have to worry about the City,they have to worry how they are now
breaking a state and federal law. So they don't have to worry about Texas Parks and Wild Life and the US Fish and Wild Life
Service. There are heavy penalties for what they are doing. Some people have weird pets in the cities;you would probably be
amazed at what people have. We come across occasionally in this country where someone gets caught with bird and it's
confiscated by the state agency.The procedure is brought to our rehab center,the Aquarium or the Ark, Weareloldpeople
have such as a red tail hawk and it's determined whether it's going to be rehabilitated or released to the wild,or go into an
education program like 1 have. Mr.Wood pointed out that he has 65 birds;he usually travels with 15-20 f them, Most of them
are in New York,I have a caretaker for them. The bulk of the birds I have are handicapped,the golden eagle on the brochure
she passed away,had her for 16 years. She was blind in one eye and missing toe which you can see in this picture. There is
new golden eagle that has a wing injury;most of the birds I have on the permits are handicapped birds, Whereas the falconry
birds are not they are fully flighted ready to go out and hunt. I have one bald eagle that has an injured wing.
Ms.Copeland interjected to ask Mr.Wood some questions which some have already been answered. As we walk thru the
process would you be able to help us prepare something to send to the legal department. Mr.Wood replied yes.We have an
organization called North American Falconry Association which is the countries then you have what is called the Texas Falcon
Association,we watch over each other. If you wanted to become a falconer you need to find a sponsor. If you live in Corpus
Christi,there are only a few of us. We have to screen you before we would want to think about sponsoring you.It's what we do
for a living and with what spare time you have to work with the birds.You need to sponsor and that sponsor has the responsibility
over you for 5 years. If you do something wrong,mistreat the bird then you have to deal with me and the falconry community s
whole. You won't get into the clubs or organizations without a recommendation s well. The process is strict and up until the
early 16 's eagles,hawks,falcons were considered vermin. Many states and cities would pay a bounty to go out and shoot a
hawk,not sure if Corpus Christi would,a kid would get out of school grab his 22 rifle and shoot red tail hawk and bring the dead
body to the town hall and get.50 cents because people thought this birds were dead. Up until the early 1960's which is not too
long ago,the whole thing changed over to Raptors especially with DDT.We found out thru the off spray the bald eagle,peregrine
falcon how harmful that was.We realized that these birds were actually beneficial to the environment and they are killing rodents
and owls that eat 2,000 mice in year. The whole thing changed in the 60's,the falconry used to be that there weren't any
regulations against it. All of a sudden it became illegal,no one could touch a bird,and you couldn't have touched a feather. The
country changed over to having regulating falconry;federally and tru state agencies. The first licenses were issued in 1973,
which is a decade later and I am one of the first recipients of one. I have been a falconer for 42 years.
Mr.Wood added that it's unlike anything else; I'm not sure what restrictions there are with pythons and lizard and different kinds
of pet's people have,this is incredibly restricted, This is one of the reasons why there are so few people doing it because once
they realize what they are up against they take it and go.
Ms.Copeland expressed the appreciation for all the information;the reason we asked Mr.Wood to come is because you will be
seeing some things that we are going to be bringing forward and would like you to be willing to review it and will prepare to go to
city council.Legal will also be reviewing it and as the committee I would like the support this to city council. We did this with the
lson ordinance,and we would like to be able to go forward and say the committee does support this. We are not asking the
support today because you are going to have to see what we are bringing forward to you for the ordinance. Mr.Wood asked if
he could make a suggestion is when any changes are made if you put in that anyone involved in falconic,is when you have state
and federal license. Mr,Wood added that as an example he could do shows in malls,festivals,with a show in the city that you
need a commercial exhibitors permit to do this,or you can get a waiver for the permit. Ms.Copeland and Ms.Schenzel gave me
a waiver this past Saturday to do this program for the Boy Scouts instead of buying the$200 permit they gave me the waiver
permit to do it. You might want to put in place a permit where there is no charge if needed,although you may not want the extra
paper work. Our interest is to have the ordinance changed so it allows for us to keep birds in the residential area.

Ms.Copeland added that the animals would need to be registered with the city and that would they be following all the federal
regulations. I don't feet that it's going to be that big of a change. I do feet that it will happen quickly. Ms.Beynon added that you
also want owls. Mr.Wood replied that you don't list owls;you list it as raptors which would cover eagles,hawks and owls loo.
Ms.Copeland added that is why he is using the term raptors.Mr.Wood added that the exotics are not regulated by the state or
federal government. The reason I have them is use them for commercial for example,I can't use this golden eagle for a
commercial for Exxon Mobil but I could use an exotic eagle from another country. The last commercial I did was with Regis and
Kelly which was a bank commercial,they wanted an owl,had to use an exotic owl for commercial purposes. There isn't really
anyone that gets in the country at gets a hold of the exotic raptors because the people that sell them and deal and breed the
won't sell them or give them to someone who doesn't have permits like I do.In the long run you do not need permit,so
someone could give you one of these birds. I personally don't know how many there are,there are probably some people that
have exotic raptors,don't know how they got a hold of a but they do.
Dr.Whitlock asked if the exotic raptors are not required to have a Texas or federal permit. Mr.Wood replied Texas doesn't
regulate e this is where you might want to keep track with a permit or something.Ms. Copeland asked how the exotic raptors
like the lions,tigers and bears they may not permitted but you can find them on a Internet easily. Mr.Wood added no not
easily,you could came up with them but wouldn't sell them unlike the tiger people. Some breed them and might make a couple
of grand on one. Mr.Wood added that raptor people are different We police ourselves very well,we are skeptical with new
comer that wants to become a falconer. Mr.Schroeder asked in reference to this discussion and the possible changes,will there
be a recommendation on how many.Mr.Wood replied that it is already regulated:an apprentice falconer can only have 1 bird,a
general falconer only 3 and master falconer 5 birds. Mr.Wood also added that he has more because of all the licensing I have.
Ms.Copeland added that doesn't include the owls, Mr.Wood replied that none of the falconers train owls;they only do the
hawks and falcons. Ms.Copeland e t it would be something a would want to cover number wise. Ms.Hundley added
yes because of it being in residential area. Then you have other provisions that govern hunting,you do hunt with them correct.
Mr.Wood replied yes,you need to have a hunting license.Mr.Schroeder asked if that was a special falconry hunting license.
Mr.Wood replied no,just a regular hunting license that anyone can get. Ms.Copeland added that it could beregulated,Ms.
Hundley added that that there is some trying duck hunting on Laguna re and there is no hunting allowed in a city. Ms.
Hundley added that there may be a way to regulate as such.
Ms.Copeland pointed out to the committee that she wanted Mr.Wood to come and know what they would like to see done. Mr.
Wood wanted to add that there are people that have propagation permits,in other words they breed birds. Most of the birds we
get we don't trap in the wild,we buy them from breeders; I also breed;I do certain species. There are some including myself
may have a propagation permit which I do have one for New York;have one for propagating raptors and the birds may have 5-1
babies depending on how many eggs ey have. You would want to do a restriction on the amount of numbers;that would be an
issue that might come u . Ms.Copeland replied that we already have number restrictions.Ms.Hundley interjected that would
not cover this instance. Ms.Hundley added that there is provision that would allow for educational but there are still steps to
o thru.
Dr.Whitlock asked for clarification that exotics don't need a Texas permit,do they need the federal permit. Mr.Wood replied no
and added that you could cover that by the requirement of having a state and federal permit for a raptor. Even though they don't
need it for that they do need to be licensed falconer or reabilitator. Ms.Hundley asked for clarification do you keep a Zoological
permit. Mr.Wood replied yes;that's what covers me for doing any programs. In other states they call it something else it's
usually called education or exhibition, Mr.Schroeder asked if the other members of the organization;do they also have the
ability to go around you do. Mr.Wood replied that Texas has eased up on a lot of the regulations; I stated before that
master can have 5; 1 meant ftl the master can have more than 5 birds right now. Even though I am a falconer I am allowed to
come into Texas with my hunting license and my federal falconers'license, I personally don't need Texas license and don't
have one. Mr.Wood also added that he was talking with m yesterday and not sure what good it would do to have one
because I am already covered. The question being someone with a falconry e it in addition to the hunting can they do a
program at a school, I believe the state allows them too that. They wouldn't be able to charge for it. Mr.Wood added that he
was going to be doing 2 bird shows at his daughter's school In February and anyone is welcome to come.
Mr.Wood added that he works with Chambers of Commerce all over the country and here in Corpus is a very hard city to work
in. I set up shows for free at malls throughout the United Stales,but none of the ones here are interested even it being free. I
have a desire to bring this to Corpus Christi and promote birds in the city and the tourism it can bring. Our city is a best kept
secret in America. It has great potential. I see all of America from small towns to some of the largest doing shows.Mr.Wood
wanted to end that not just being 'bird man',but an entrepreneur,marketer and promoter at heart. I would like to be a key

person to get this implemented and promote the birdie .Mr.Wood added that there is a permit which is bird abatement permit,
which is licensed by the federal government, They use their trained falcons to chase starlings and pigeons away. Mr.Wood
added that he has birds that he has sent to the Napa Valley of California where they chase birds away from their grapes which is
effective.
Ms.Copeland thanked Mr.Wood and that when you get back let us know and we will arrange a time to meet with you on this
matter. Mr.Wood asked that the falconry issues;you take these to City Council as the next step. Ms.Copeland replied that
once it's put together it goes to legal,Mr.Wood asked how long does this normally take. Ms.Hundley added that it depends on
how staff works it out and it comes back to the committee for a recommendation and the calendar. Ms.Copeland added that
with a alsson ordinance was about 1 %months. Ms.Hundley added that it could be a month,could be 3 months. Mr.
Schroeder added that when you get back it will all be looked at. Ms.Copeland added that she and Ms.5cenzl have met in
regards to this. Mr.Wood added that if there were to be mlit which would come from a neighbor as a noise violation.
Ms.Copeland replied that we will talk about how everything is cleaned and food and how all is ken care of Also discuss the
distance between the neighboring homes around you, Ms.Hundley asked if he has the commercial animal establishment permit
now. Ms.Copeland replied no. Ms.Hundley that is where residential use comes in,he bought his for residential enjoyment and
it's whether that is considered a compatible use or whether the council or City Manager directs. This is a matter that the zoning
commission should look at before the council. You have to look at that the hunting components,so today was just a discussion
about the proposed changes and draft. Mr.Wood added that when you have an inspection like a falconer has to have which his
6 ft y 6 ft by . It's called a mews,and they have to have that in the yard inspected;next to that what is called a weathering
pen where the bird can get out in the sunlight and that has to be approximate dimensions which is chain length like a dog run,
which needs to be inspected by state. You have to have the equipment for the birds,gloves,scales. They do not get a bird until
they have all of that.
Ms.Hundley pointed out that is what some of the questions that the aftomeys'from our office will be asking;with the permission
from the committee. Ms.Hundley asked if you desire to hunt in the city with your birds. Mr.Wood asked if Mustang Island was
a pad of the city. s.Hundley asked about the state park and pointed out that the city limits go up to Port Aransas and we have
some inside the left side of the highway;we are in counties.Ms. Hundley asked if you are hunting with a birds now. Mr.Wood
replied usually the hunting Issue deals with fire arms obviously.There are places in the country that someone like me couldn't
hunt because there is a fire arm issue. Is there a laket'no hunting`in the city, Ms.Hundley replied we allow duck hunting on
e Laguna Madre,although the hunting also applies to guns and bow and arrows;hunting being the pursuit of a live animal. If
you are hunting with your birds now;one of the questions may be how come your words differentiate between the kitten on the
ground and the opossum. These types of questions will come up if you are hunting in the city.
Mr.Wood added that it comes down to the person arriving at a time and a place for their first hunt and knowledgeable enough
at they are not going to be hunt in their own back yard. The birds won't go after other species,falcons hunt other birds.The
hawks do,they will do rabbits.Mr.Wood added that falcons don't like cars,people;we don't like people seeing what we are
doing. We go the most remote place we find. The falcons won't go after ducks because they are too close to the road.The
only duck ponds we do are way out on Mustang that you hike to.The licensed falconer is already dealing with the issues they
won't be in the backyard doing this.We do hunt ducks out there but in Texas we have to get permission from each land owner to
o out on to their property to hunt with the falcons. The people that don't make a living and are falconers',they love the birds
and love seeing them fly.

Mr.Schroeder informed the committee the event' rshing with the K- ' 'is on December 91h from 10-1m as an open house
event. Mr. Schroeder said he would be dressed up as Santa and taking pictures. We will provide a date for our next event in
2011 once the date is set. Mr.Schroeder added that he and Ms.Martinez will be on the 6 and 7 am morning show at Kill Chan.

Ms.BeynDn asked for the information on tracking enforcement and citations.Ms.Copeland replied that she has talked with
Chameleon on the changes of the percentage report and asked them if they could include the citation numbers.
