McDonald(Alternate) Morgan Spear(Alternate),Absent Absent I. CALL TO ORDER A quorum was declared and the meeting was called to order by Chairman Mauck at 1:30 p.m. II. APPROVAL OF MINUTES Motion to approve the minutes from the December 16, 2009, hearing was made by Board Member Molina and seconded by Board Member Johnson. Motion passed unanimously with Vice Chairman Winship being absent. III. APPEALS 1. New Appeal(s) a. Appeal No. ZBA 0110-02 Jay C. Crick: Request to consider a Special Yard Exception to reduce the front yard setback from(25)feet to(10) feet The subject property is located at 302 Wray Lane,Bluff Estates Subdivision, Lot 9D,located approximately 720 feet southeast of Ocean Drive. Andrew Dimas,Development Services,presented the above appeal via PowerPoint. The applicant requested a Special Yard Exception to reduce the front yard setback from(25)feet to(10)feet. The Subject Property is located at 302 Wray Lane, Bluff Estates Subdivision,Lot 9D,located approximately 720 feet southeast of Ocean Drive. Staff Analysis: The request for the Special Yard Exception(SYE)is to reduce the required front yard setback of(25)feet to(10)feet.The appellant wishes to install a 16' x 26' in ground swimming pool at his residence for personal use.According to his land use statement the only location for a pool of this size to be installed is in the front yard.The appellant further claims that it is"impossible"to place the pool in the rear yard due to the lack of space, as well as,the absence of access to said pool. However, swimming pools are considered an accessory building and require a building permit. According to Section 27-3.02.01,no accessory buildings are allowed to project beyond a required yard line along any street.Therefore, accessory buildings are not allowed in the front yard of a property. Out of the twenty-four(24)notices sent out,zero was returned in favor or in opposition. Zoning Board of Adjustment Minutes January 29, 2010 Page 2 of 2 Chairman Mauck opened the public hearing. Jay Crick,applicant,came forward stating he was available for any questions. No one came forward in opposition. Chairman Mauck closed the public hearing. Motion was made by Board Member Johnson, In accordance with Section 29-4 of the Zoning Ordinance, I move that Appeal No. ZBA 0110-02, a request for a Special Yard Exception to reduce the front yard setback from 25 feet to 10 feet, located at 302 Wray Lane, Bluff Estates Subdivision, Lot 9D,be approved, based on the finding and that in the Board's opinion and as a matter of fact, such a special yard exception will not substantially affect adversely the uses of adjacent and neighboring property permitted by the Zoning Ordinance. The motion was seconded by Board Member Tinney and the motion passed unanimously with Vice-Chairman Winship being absent. IV.DISCUSSION—PARLIAMENTARY PROCEDURE Mr. Dimas presented a quick reference guide to Robert's Rules of Order. Mr. Dimas reviewed some of the more common points of order including no rebuttals during the Public Comment portion of the hearing. V.ADJOURNMENT Motion for adjournment was made by Board Member Tinney. Motion seconded by Board Member Johnson. Motion passed unanimously with Vice-Chair Winship being absent.
