I. CALL TO ORDER

A quorum was declared and the meeting was called to order by Chairman Winship at 1:30 p.m.
II. APPROVAL OF MINUTES
Motion to approve minutes from the August 25, 2010 hearing was made by Board Member Johnson and
seconded by Board Member Hellums with the following corrections, page 2, case 0710-02, 5th paragraph
(Chairman McMullan)changed to Board Member McMullan.Page 3, 1st paragraph,
(Board Member Morgan)changed to Board Member Spear.

III. APPEALS
1. New Appeal
a. Appeal No.ZBA 0810-01
Chris Mandell a representative of Horton Automatics,a division of
Overhead door,Requests a Special Use Exception(SUE)for the
installation of an above ground fuel tank.
The subject property is Corpus Christi Industrial District Section 2,Block
9,Lot X-3,located at 4242 Baldwin Boulevard,intersection of Airport
Road and Baldwin Boulevard.
Andrew Dimas, Development Services, presented New Appeal item "a" Appeal No. ZBA 0810-01 via
Apple Keynote, stating the applicant is requesting a Special Use Exception(SUE) for the installation of an
above ground fuel tank.
In response to Board Member Molina,Mr.Dimas stated that the case was already presented to council.
In response to Chairman Winship, Mr. Dimas stated that the UL2085 tanks are triple lined, they are three
tanks in one.
Public hearing was open.

In accordance with Section 29 of the Zoning Ordinance, Board Member Johnson moved that Appeal No.
ZBA 0810-01, a request for a Special Use Exception (SUE) for the installation of an above ground fuel
storage tank located at Corpus Christi Industrial District Section 2, Block 9, Lot X-3, located at 4242
Baldwin Boulevard, be approved, based on the finding and that in the Board's opinion and as a matter of
fact, such a special use exception will not substantially affect adversely the uses of adjacent and
neighboring property permitted by the Zoning Ordinance. The motion was seconded by Board Member
Hellums. Chairman Winship requested roll call. Janysse Delgadillo, Development Services, called role.
Motion passed unanimously.
b. Appeal No.ZBA 0810-02
Oscar and Angelita Vasquez,Request a Special Yard Exception to
reduce the side yard setback on the northern boundary of the subject
property from ten(10)feet to five(5)feet to allow for construction of a
single family dwelling.
The subject property is Meadow Park Subdivision,Block 25,Lot 4B at
525 Mohawk Street,approximately 250 feet north of the intersection of
Baldwin Boulevard and Mohawk Street.
Andrew Dimas,Development Services,presented New Appeal item"b"Appeal No.ZBA 0810-02 via
Apple Keynote, stating the applicant is requesting a Special Yard Exception to reduce the side yard setback
on the northern boundary of the subject property from ten(10)feet to five(5)feet to allow for construction
of a single family dwelling.
In response to Board Member Molina,Mr.Dimas stated that there were 21 notices sent out with 2 in favor
and none in opposition.
Public hearing was open.
Esteban Alaniz,the family's builder,stated that Mr.Vasquez and Mrs.Vasquez started the process of
trying to build their house in January 2009. They claimed they were never told about the ten(10)foot
setback.
The public hearing was closed.
In accordance with Section 29 of the Zoning Ordinance, Board Member Hellums moved that
Appeal No. ZBA 0810-02, a request for a Special Yard Exception to reduce the side yard setback on the
northern boundary of the subject property from ten (10) feet to five (5) feet to allow for construction of a
single family dwelling, located at 525 Mohawk Street, be approved, based on the finding and that in the
Board's opinion and as a matter of fact, such a special use exception will not substantially affect adversely
the uses of adjacent and neighboring property permitted by the Zoning Ordinance. The motion was
seconded by Board Member Johnson. Chairman Winship requested roll call. Janysse Delgadillo,
Development Services,called role.Motion passed unanimously.
c. Appeal No.ZBA 0810-03
Gary C.and Christina Perry ,Requests a Special Yard Exception to
reduce side yard setback from twenty-five(25)feet to fifteen(15)feet for
construction of an accessory building;Variance to regulation regarding
accessory buildings to allow for construction of a 2,000 square foot
accessory building.
The subject property is Westridge Acres Unit 1,Block 1,Lot 8,located at
1625 Wooldridge Boulevard approximately 1,200 feet south of the
intersection of Graham Road and Westridge Boulevard.
Andrew Dimas,Development Services,presented New Appeal item"c"Appeal No.ZBA 0810-03 via
Apple Keynote,stating the applicant is requesting a Special Yard Exception to reduce side yard setback
from twenty-five(25)feet to fifteen(15)feet for construction of an accessory building;Variance to
regulation regarding accessory buildings to allow for construction of a 2,000 square foot accessory
building.
In response to Board Member Johnson,Julio Dimas,Development Services, there are some easements that
are in place where the building will go.
Public hearing was opened.
In response to Chairman Winship, Garry Perry,applicant, stated that the septic system is located to the left
of the house and setback twenty(20)to thirty(30)feet behind the home.
In response to Chairman Winship,Julio Dimas stated that the subdivision had a special permit,the division
is on a septic system but the main trunk line is not connected to the city's system.The request was made in
case of future growth in the subdivision.
In response to Board Member McMullan,Julio Dimas stated that the plan review has not yet been made the
plan must first pass through the Zoning Board of Adjustments.
Public hearing was closed.
In response to Vice-Chairman Molina, Deborah Brown, assistant City Attorney, stated that the zoning of
the property already explained the restrictions.
In accordance with Section 29 of the Zoning Ordinance, Board Member Johnson moved that
Appeal No. ZBA 0810-03, a request for a Special Yard Exception to reduce side yard setback from 25 feet
to 15 feet for construction of an accessory building and a Variance to regulation regarding accessory
buildings,to allow for construction of a 2,000 square foot accessory building, located at Westridge Acres,
Unit 1, Block 1,Lot 8, located at 1625 Westridge Boulevard,be approved, based on the finding and that in
the Board's opinion and as a matter of fact, such a special use exception will not substantially affect
adversely the uses of adjacent and neighboring property permitted by the Zoning Ordinance. The motion
was seconded by Board Member Molina. Chairman Winship requested roll call. Janysse Delgadillo,
Development Services,called role.Motion passed unanimously.
III. ADJOURNMENT
Motion to adjourn was made by Board Member Spear and seconded by Board Member Hellums. Motion
passed unanimously and meeting was adjourned at 2:14 p.m.
