I. CALL TO ORDER The meeting was called to order by Chairman Winship at 1:30 p.m.and a quorum was declared. 11. APPROVAL OF MINUTES 1. April 27,2011 Motion to approve the April 27, 2011 minutes was made by Board Member Johnson and seconded by Board Member Spear. Motion passed unanimously. III. APPEALS 1. New Appeal Lisa Wargo, Development Services, presented New Appeal item "a", stating the applicant requested a Variance from the 25-foot side yard and rear yard setback. a. Appeal No.ZBA 0511-01 Gary Heath, requests a Variance from the 25-foot side yard and rear yard setback. The subject property is Country Creek Unit 6, Block 2, Lot 12, located north of South Staples Street and west of South Oso Parkway along the south side of Barnard. Alternate Board Member McMullan inquired about the required 25-foot side yard requirement and Miguel Saldafia, Development Services, responded that the 25-foot is required for the "RE" Residential Estate District due to the openness of the lots. In response to Board Member McMullan, Mr. Saldana stated all of the properties have septic systems. The public hearing was opened. Mr. Garcia stated the structure was used for parking an RV. Chairman Winship asked how much of the yard area did the septic system take up and Mr.Garcia responded he did not know. A brief discussion was held on the septic system. Board Member Spear inquired about changing the deed restrictions and Mr. Garcia responded the dead restrictions cannot be altered. Board Member Spear recommended reducing the width of the proposed structure. Chairman Winship inquired about relocating the structure sideways on a different part of the lot and Mr. Garcia stated relocating of the structure would result in maneuvering issues for the RV. Board Member Spear inquired about the type of material to be used for the proposed structure and the purpose of the stairs. Mr. Garcia answered the structure would be made out of brick veneer and the stairs are to lead to the second floor where the air conditioning unit would be placed. Board Member Spear recommended relocating the air conditioning unit downstairs. The public hearing was closed. Miguel Saldana, Development Services, stated the Board must find a specific finding to approve or deny the appeal. Deborah Brown, Assistant City Attorney, read from the Zoning Ordinances to help describe the specific finding. After further discussion, Board Member McMullan commented that the cause of the problem was poor planning. Vice-Chairman Molina recommended reducing the width of the proposed building and Board Member Johnson commented that the appeal was a convenience issue. In accordance with Section 29 of the Zoning Ordinance, Board Member Johnson moved that Appeal No. ZBA 0511-01, a request for a Variance from the 25-foot side yard and rear yard setback, for property described as Country Creek Unit 6,Block 2,Lot 12,be denied,based on the specific findings as illustrated in Section 29 of the Zoning Ordinance could not be made,and that in the Board's opinion and as a matter of fact, such a Variance will substantially affect adversely the uses of adjacent and neighboring property permitted by the Zoning Ordinance. The motion was seconded by Board Member Spear. Chairman Winship requested a roll call vote and the roll was called. Motion passed unanimously. IV. ADJOURNMENT Motion to adjourn was made by Board Member Spear and seconded by Board Member Johnson.
