CALL TO ORDER The meeting was called to order by Chairman Winship at 1:31 p.m.and a quorum was declared. II. APPROVAL OF MINUTES 1. August 24,2011 Motion to approve the August 24, 2011 minutes was made by Board Member Spear and seconded by Board Member Hellums. The motion passed. III. APPEALS 1. New Appeal Jennifer Ramirez, Development Services, presented New Appeal item "a", stating the applicant requested a Variance to reduce the 20-foot front yard setback to 10 feet for the construction of a swimming pool. a. Appeal No.ZBA 0911-01—R. Mark Herndon R. Mark Herndon requests a variance to reduce the required 20-foot front yard setback to 10 feet. The subject property is described as La Concha Estates, Block 1, Lot 9, located east of La Concha Boulevard and north of Sea Air Lane. Mrs. Ramirez added that seventy-four (74) notices were mailed. One (1) was returned in opposition and two (2) were returned in favor. One of the two notices returned in favor was from Dale Demoss, President of the La Concha Estates HOA. 0 Zoning Board of Adjustment September 28,2011 Page 2 Mrs. Ramirez showed aerial views and photos of the subject property. The property lines surround the structure closely at the side and rear with limited space for new construction. There is also a significant slope variation of 5-10 feet at the rear yard. The public hearing was opened. The owner, R. Mark Herndon, came forward and stated that he was available to answer any questions the Board had. With no questions from the Board,the public hearing was closed. Board Member Pineda asked the reason for the opposition and Mrs. Ramirez answered there was no explanation given on the returned notice. Board Member Spear asked if the opposition was adjacent to the subject property and if there was a structure on that property. Mrs. Ramirez answered the property was to the north and was vacant. Chairman Winship requested a roll call vote and the roll was called. The motion passed unanimously with Vice-Chair Molina, and Board Member Johnson absent. IV. OTHER ITEMS Workshop next meeting V. ADJOURNMENT Motion to adjourn was made by Board Member Spear and seconded by Board Member Johnson.
