1. CALL TO ORDER

A motion to excuse Mr. Mauck's absence was made by Mr. McMullan and seconded by Mr. Karaca.
Motion passed.
III. APPROVAL OF MINUTES: February 24,2016
A motion to approve its "III"was made by Mr. McRee and seconded by Mr.Voorkamp. Motion passed.
V. APPEAL-,DISCUSSION AND POSSIBLE ACTION ON THE FOLLOWING
1. New Appeals
a. Appeal No.ZBA 0316-01 (16-12500001)
New Action Mobile Industries,LLC,request a Variance to reduce the

The subject property is being described as Kelly Margaret Land,Block 10,
Lot 1, located on McGloin Road,east of Bockholt Road,and no of Joe
Mireur Road.
Andrew Dimas, Development Services, read item "a"' into record as shown above. He presented several
aerial views of the subject property. The purpose of this appeal is to request a variance to eliminate the
required 25-foot zoning district buffer yard where an industrial use is redeveloping adjacent to a single-
family district. The adjacent uses are either industrial or vacant agricultural lands.The property is different
from the surrounding properties since it is the only industrial property adjacent to single-family properties
that were part of a mass annexation in 1962. The requirement of the zoning buffer yard was not due to the
applicant's own actions.The buffer yard requirement is a result of the adjacent properties in zoned 46
6"" at the time of annexation. Under today's Unified Development Code (UDC), newly annexed properties
are initially zoned"FR7 Fa rrn Rural District rather than "RS-6" Single-Family. Had the adjacent property
been zoned "FW' Farm Rural, the buffer yard would not have been required. Due to the difference in
zoning districts, the Unified Development Code (UDC) requires a zoning district buffer yard. As per
section 7.9.6.A a"Type E"buffer yard will be required. A"Type E"buffer yard consists of a minimum 2 ®
foot wide buffer yard and a minimum of 50 points. He also informed the Board that of the I I public
notices mailed, zero notices were returned neither in favor nor in opposition. Staff recommends approval
of the variance request.

After Staff's presentation,Mr. Mauck opened the public hearing. Representing the applicant,Mr.Chris
Rickman at 809 Gleneagles Court,Baltimore, Maryland,addressed the Board. He explained t®the Board
that the storage of modular buildings would not be allowed within the buffer yard and therefore,reduces
the total area available to the business for storage.
With no one else coming forward,Mr. Mauck closed the public hearing. A motion to approved item"a"
was made by Mr.McRee and seconded by Mr, Voorkamp. Motion passed.
V. DISCUSSION AND POSSIBLE ACTION ON BOARD MEMBER REAPPOINTMENTS,TERM
EXPIRATIONS,ALTERNATES,AND CHAIRMAN/VICE CHAIRMAN NOMINATIONS
No action was taken on this item,but for the record,Tim Voorkamp and Shawn Karaca would like to be
reappointed and no longer of the alternate positions.
