CALL TO ORDER: 1:30pm II. APPROVAL OF ABSENCES: None III. APPROVAL OF MINUTES:May 25,2016 A motion to approve item"IIP'was made by Shawn Karaca and seconded by Burris McRee. Motion passed. IV. APPEAL—DISCUSSION AND POSSIBLE ACTION ON THE FOLLOWING 1. Continued Appeals a. Appeal No. ZBA 0516-01,NE Development Company: Requests a Variance to reduce the side yard setback from 30 feet to zero feet for a proposed multi-family building on the property described as Seaside, Block 4, East 0.243 acres of Lot 2R and Flour Bluff and Encinal Farm and Garden Tract, Section 1, 2.632 acres out of Lots 1 and 2, located north of Ocean Drive,east of Robert Drive,and west of Airline Road. Andrew Dimas, Development Services, read item "IV, la" into record as shown above. He presented several aerial views of the subject property. Staff recommends approval of this variance,with the condition of a 10-foot setback. A zero setback poses maintenance limitations. Ram Munoz, applicant, addressed the Board. Stated this request for variance does not allow for more density—still in accordance with the UDC.East side city requirement is 30 feet. Note:Taylor Mauck arrived after roll call,@ 1:35pm. Public comment was opened: • Bryan Stone, at PRD6 78413,addressed the Board, stated 30 foot setback is important to the 4600 Building. Also feels this is not an extraordinary condition and wants applicant to prove the hardship to support his request for a variance. • Mark Gilbreath (rep Scavo), at 5306 Holly Rd, Suite A, CC, TX 78411, addressed the Board, stated there are no factual bail that the land cannot be used reasonably. • John Bell (rep, Landmark Condo), addressed the Board,used Alta Plaza as an example—Council Did not want a wall of buildings. Would like to maintain openness on Ocean Drive. Feels applicant wants more density. • John Dykema (Landmark President), at 4500 Ocean Dr. CC, TX 78412, addressed the Board. Feels that rights will be denied. • Francisco Negross, condo owner at 4600 Building, addressed the Board. Feels there would be a "canyon effect";ie:parking garage,vehicles will be closer to their pier. • Patrick Biggins, Landmark Board, addressed the Board. Concerned about the effect of reduced views negatively impacting the valuation of all residents. • Ken Lokey,addressed the Board.4600 Building put their drainage on this property. • Phil Helm,4600 Building,addressed the Board.Drainage Mr.Lokey referred to is for Bay Tree. • Yvonne Youngblood, addressed the Board. Concerned that the area will look like Manhattan. Concerned about traffic. • Catherine Cox,addressed the Board. Safety concerns regarding the sidewalk to the pier—someone can drop things off the building and hurt someone walking out to the pier. After discussion amongst Board members, a motion to deny this appeal was made by Shawn Karaca and seconded by Tim Voorkamp. All required findings could not be met. All in favor,none opposed. V.
