STAFF: Andrew Dimas, ZBA Administrator Buck Brice, Assistant City Attorney Kristy Glick, Recording Secretary Bill Green, Assistant Director of Development Services Present: Chair Shawn Karaca, Vice -Chair David Walker, Burris McRee, Tim Voorkamp, Michael York, Absent: Bryan Johnson APPROVAL OF MINUTES: January 23, 2019 Motion to approve this item was made by Tim Voorkamp and seconded by Burris McRee. Motion passed unanimously. APPEALS — DISCUSSION AND POSSIBLE ACTION ON THE FOLLOWING: 1. Appeals Appeal No. ZBA 0219-01, Habitat for Humanity of Corpus Christi: Variance to eliminate the zoning district buffer yard requirement between the "RS - 4.5" Single -Family 4.5 District and the "IH" Heavy Industrial District on a tract of land addressed as 1902, 1906, 1910, and 1914 Lipan Street and Lots 6A, 7A, and 8A, Block 4, Brennan Addition and 0.104 acre tract being all of Lots 11, 12, the south 9.0 feet of Lots 13 and 14, Block 4, Brennan Addition, as shown on a map recorded in Volume 8, Page 33, Map Records of Nueces County, Texas and a 316 square feet tract out of Lots 13 and 14, Block 4, located on the north side of Lipan Street, east of North Port Avenue, and west of Coke Street. Andrew Dimas, Project Manager, made the staff presentation. Motion to approve was made by Vice -Chair David Walker and seconded by Burris McRee. Motion passed unanimously. b. Appeal No. ZBA 0219-02, Carlos C. Ruiz: Variance to allow for the reduction of a street yard setback from 20 feet to 7.5 feet on a tract of land addressed as 1101 Green Field Drive and described as Lots 14 and 14A, Blocks 11 and 11A, Village on the Green, located along the west side of Green Field Drive, south of Green Tree Drive, and west of Navigation Boulevard. Andrew Dimas, Project Manager, made the staff presentation. The applicant's representative, Mr. Miguel Saldana, AICP, spoke in favor of the variance request. Mr. Saldana also explained the history of the Village on the Green subdivision and its status as a former Community Unit Development (CUD). Motion to approve was made by Vice -Chair David Walker and seconded by Burris McRee. Motion passed unanimously. Appeal No. ZBA 0219-03, Anthony Montana: Special Use Exception to allow for an accessory building to exceed 50% of the total square footage of the main principal structure allowance set by the Unified Development Code (UDC) on a tract of land addressed as 214 Louisiana Avenue and described as Lot 4, Block 11, Del Mar, located in the northeast corner of the intersection of Louisiana Avenue and Santa Fe Street, east of South Alameda Street, and west of Ocean Drive. Andrew Dimas, Project Manager, made the staff presentation. The applicant's representative, Mr. Michael Benning, P.E., spoke in favor of the Special Use Exception (SUE) request. Mr. Benning explained that the use of the accessory building is for a personal gym. Mr. Benning further explained that there will be no residential components (i.e. bedrooms, kitchen, bathroom, etc.) located in the accessory building and no plumbing will be installed. Mrs. Dorothy Spann, 502 Del Mar Boulevard, spoke in opposition of the Special Use Exception (SUE) request. Mrs. Spann cited concerns about creating non -conforming structures in the Del Mar Subdivision. She also cited concerns about the possible conversion of the accessory building to a short-term rental use (aka AirBnB). Motion to approve was made by Vice -Chair David Walker and seconded by Michael York with the condition that no plumbing or cooking/food preparation area be added to the accessory building. Motion passed with one vote of opposition by Tim Voorkamp. IV. DIRECTOR'S REPORT: No report given. V. PUBLIC COMMENT: No public comment given. VI. ADJOURNMENT: 2:16 P.M.
