CALL TO ORDER: 1:30 p.m. Present: Shawn Karaca, David Walker, Burris McRee, Tim Voorkamp, Gordon Robinson Absent: Bryan Johnson APPROVAL OF MINUTES: July 24, 2019 Motion to approve this item was made by Tim Voorkamp and seconded by Burris McRee. Motion passed unanimously. APPEALS — DISCUSSION AND POSSIBLE ACTION ON THE FOLLOWING: 1. Appeals a. Appeal No. ZBA 0719-02, George H. Acker, Jr.: Special Use Exception to allow for an accessory building to exceed 50% of the total square footage of the main principal structure allowance set by the Unified Development Code (UDC) on a tract of land addressed as 4653 Callicoate Road and described as Lot 2-13, Block 2, Fallins Riverside, located on the west side of Callicoate Road, south of Up River Road, and east of Rehfeld Road. Andrew Dimas, Project Manager, made the staff presentation. After deliberation, a motion to deny the requested special use exception was made by Shawn Karaca; seconded by David Walker. Motion passed unanimously. b. Appeal No. ZBA 0819-01, South Shore Homes, Inc.: Variance to allow for the reduction of the side yard setbacks on a tract of land addressed as 1714 Duval Court and described as Lot 1, Block 6, Summer Breeze Phase 2, located along the north side of Duval Court, east of Scarlet Oak Drive, and north of Yorktown Boulevard Andrew Dimas, Project Manager, made the staff presentation. Chuck Clark, the applicant, spoke in support of the requested variances. Mr Clark explained the character of the neighborhood and the need for the variance to maintain the visual aesthetic of the surrounding properties. Asia Benavides, the property owner, also spoke in support of the requested variance. After deliberation, a motion to approve the requested variance was made by David Walker, seconded by Tim Voorkamp. Shawn Karaca recused himself. Motion passed unanimously. c. Appeal No. ZBA 0719-01, Fosters Dynamic Designs, LLC.: Variance to allow for a single-family home to encroach 3.6 -feet into a utility easement and corner street yard setback, a variance to allow for a garage door to be setback at 6.4 feet, and a variance to allow for a single-family home to encroach into a side yard setback on a tract of land addressed as 3729 Berkeley Drive and described as Lot 3, Block 4, Manhattan Estates Unit 7, located in the northwest corner of the intersection of Berkeley Drive and Mets Court, and north of Lipes Boulevard. Andrew Dimas, Project Manager, made the staff presentation. David Foster, the applicant, spoke in support of the requested variances. Mr. Foster explained the process of obtaining the building permit and the construction of the single-family home. Discussion between the applicant, City staff, and Board members revealed the timing of inspections during the construction of the home and the process of approving the residential building plans. After deliberation, a motion to approve the various requested variances was made by Shawn Karaca; seconded by David Walker. Motion passed with four votes in favor and one opposed with three conditions. 1. The parking pad site behind the single-family home is expanded to 20 - feet by 26 -feet. 2. Widen the driveway apron to 40 -feet. 3. The driveway may not be enclosed by a fence or gate. IV. DIRECTOR'S REPORT None. V. PUBLIC COMMENT: None. VI. ADJOURNMENT: 2:45 p.m. araca, Chairperson
